2397 Creating City Offices1 1 1 1 1 -- - - - ORDINANCE- NO 2397 - - - - - - - - ubli-shed_in The Salina Evening Jour_nal July 6119��) An ordinance classifying, creating and establishing certain departments and offices, for the conduct and control of the governmental and administrative affairs of the City of Salina, Kansas, pursuant to the provisions of Chapter 86, of the Session Laws of Kansas for 1917, relating to the government of all the cities in Kansas and to establish an optional form of government after the adoption of the provisions of said Act; defining and fixing the duties of the officers and employees within said departments and offices, and repealing all ordinances or parts of ordinances in conflict with its terms. BE IT ORDAINED by the Board of Commissioners of the City.of Salina, Kansas: Section 1. GOVERNING BOARD: That there be and hereby is ,created and established a Governing Board which shall consist cf the number of commissioners to be elected as provided by stat- ute, the qualifications of such commissioners together with their terms of office, oath and bonds to be such as is prescrib. ed by law. There shall be no distinction made as to the title or duties among the commissioners except as the Board shall orgainize itself for the transaction of business. The Board shall choose its own chairman and shall determine its own order of business. The chairman of the Board shall have the title of Mayor during the term of his office and shall be official head of the City on formal -occasions. The commissioners shall receive as -salary. payable as presurived law. The governing Board shall meet regularly once each week and oftener if busi- ness requirss,-and special meetings thereof may be held on writ. ten call signed by a majoritymof the commissioners. All regulw and special meetings shall always be open to the public. It shall be'the duty of the commissioners as such Govern - ing Board to pass all ordinances needful for the protection, safety and welfare of the City as providied by law and to pro- vide for and create such departments and offices as shall be necessary to carry out the provisions of the forem of govern- ment defined in Chpate-r 86, Session Laws 1917 and amendements thereto and to determine the salaries to be paif all City offi- cials and employees within the limitations of the law. The Board shall appoint, a Manager who shall be reponsible for the efficient administration of the City's manager. Section 2. ADMINISTRATION: That there be and hereby is created the office of City Manager and the administration of -tie affairs and business of the City shall be in his hands. He shall be appointed by the Governing Board, and shall hold his office at the pleasure of the Board; he shall be chosen solely upon the basis of administration ability, and his choice shall not be -limited by any..resident qualifications. 127 12S Such Manager shall be responsible.for the administration of all of the affairs of the City. He shall see that the laws and the ordinances are enforced;.he shall.appoint and -remove all heals of departments and all -the subordinate officers and employees. All appointments made.by-him shall be made upon the basis of merit and fitness alone. He shall have the option to require the appointment of a Civil Service Commission, as established by the provisions of Article 22, chapter 18, of the General Statutes of 1915, with such amendments thereto as may hereafter be provided by the Legislature; he shall -be responsible for the discipline of all appointive offices, and may, without notice, cause the affairs of any department, or the conduct of any officer or employee to be examined. He shall prepare and submit the annual budget to the Governig-Body and also keep the city fully advised as -to the financial conditions and needs of the City. He may make recommendations to the Commissioners on all matters concerning the welfare of the City.and shall have a seat but no vote -in all public meetings of the Governing Body. The Citta Manager shall "take an oath for the faithful perfor- mance of his duties as City Manager, and shall cause a bond, with proper securities, approved by the Judge of the District Court of Saline County, Kanszs, in the sum of $5,000.00, conditioned for the faithful performance of his duties as City Manager, to be exe- cuted and filed with the City Clerk. He shall.receive a salary fixed and payable as defined by ordinance. Section 3. DEPARTMENT OF FINANCE: That there be and hereby. is created a Department of Finance which shall have general control of the financial.affairs of the City. A Director of Finance will be in charge of the Department, subject to the supervision of the City Manager. He shall be appointed and hold his office at the pleasure of the City Mamager., He shall also be ex -officio City Clerk of said City, and shall -perform all the acts and duties pre- scribed by Statute and Ordinance, concerning City Clerk. He shall attend all meetings of the Board of Commissioners, keep a true record of it's proceedings and shall also keep a record of all his offi2ial.act-s, and.when necessary shall attest them. He shall also keep and preserve in his office the corporate seal of the City together with all records, public papers and documents of the City not beloning to any.other officer. He shall be author - ized to administer oaths. He shall also perform such other and further duties as are now provided by law and ordinance-, and are 1 1 1 1 1 i 1 1 not inconsistent with the provisions hereof. He shall give a good and sufficient Surety Company Bond to the City to be approved by the Board of Commissioners, in the sum of $59000.00, conditioned for the faithful performance of his duties; that he will punctually pay over to the. City Treasurer all monies received by him either as Director of Finance or City Clerk anal,that he will save the City free from all loss caused by his neglect or malfeasance in office. 13e shall receive a salary fixed and payable as defined by ordinance. For the further administration of the affairs of the De- partment of Finance, the following offices are hereby created and employments authorized, to -wit: .(a) A. -.City Treasurer, whose duty it shall be to safely keep and account for all the moneys of the City, coming into his hands. He shall give a good and sufficient Surety'/Company Bond inthe sum of ,gp50,000.00, to be approved by the Board of Commission- ers, said bond to be conditioned for'the faithful discharge of his duties, and to the effect that such Treasurer shall keep safely all public moneys intrusted to his care and shall save said City free 'and harmless from all loss caused by neglect of duty or malfeasance in office. The accounts of the City shall be kept by the Treasur- er:in such way that a full and comprehensive statement of the City finances may be made each month. Expenditures shall be legal and moneys ..paid out bj the City Treasurer only on the basis of the appropriations in the budget and on the authority of warrants iissued by the Director of Finaneq countersigned by the City Manager. In no case shall warrants be issued to exceed the balance in the fund drawn against. All moneys belonging to the City shall be deposited with responsible and sol- vent Banking Institutions which will pay the highest interest on funds deposited, and said interest shall accrue to the benefit of the City. He shall perform such other and futther- acts and duties as may be prescribed by law. He shall receive a salary fixed and payable as defined by ordinance. (b) All necessary stenographic and clerical forces may be employed from time to time as may be necessary, the salaries to be fixed as defined by ordinance. 129 Section 4. DEPARTIKENT OF LAVT: That there be and hereby is created and established a Department of Law, for the administration -of the legal affairs of the City of Salina; and the supervision and control of the said Department shall be in the hands of a Director who shall be known as the City Attorney. He shall be charged with the general direction and supervision over the legal affairs of the'City, and shall advise with,and attend all meetings of the Board of Commissioners. For the further administration of the affairs and duties relating to the department of law the follwoing offices are hereby created and employments authorized, to -wit: (a) An assistant City :Attorney whose duties shall be to assist the*City Attorney under his direction in all legal matters appertaining to the City, and to advise with and attend all meet- •ings of the Boa rd of Commissioners during the -absence of the City Attorney. He shall receive a:salary fixed and payable as defined by ordinance. (b) A Police Judge whose duties -shall be'to try all cases brought into police court, and who shall have power to bring before said police court all parties for trial upon complaints duly and properly made, and who shall possess and exercise all the powers j as conferred and.defined by law. He shall furnish a Surety Com- pany Bond approved by the Board of Commissioners in the sum of $1$000.00, and shall receive a salary payable as defined and fixed by ordinance. Each and all of the officers and employees named shall be appointed by and hold their respective offices at the pleas- ure of the City Manager; they shall perform, in, addition to -the duties above specified, such other and further'duties as are now or may hereafter be required of them by law or ordinance. Section 5. DEPARTIZ) NT OF PUBLIC SAFETY: That there be L and hereby is created and established a Department of Public Safety, embracing and including the superintendency and control of the Police and Fire Departments. The affairs of the said Department of Public.Safety.shall be under the immediate super- vision of a Director who shall be ex -officio Chief of Police$ subject to the approval and direction of the City Manager. He shall be appointed by,/and hold his office, at the pleasure of the City Manager. For the purpose of the further administration of the affairs of the said Department of Public Safety, the following subdivisions are hereby created 'and the employments are.authorized: 1 1 1 i 1 1 1 (A) POLICE DEPARTMENT. The officers and employees, elassi fication and salaries now effective by ordinance relating to the Police Department shall remain in full force and effect, and An - changed. Provided, however, that the appointment of all members of the Police Department shall hereafter be made by and they, shall hold their respective offices at the pleasure of the City Manager, subject to the limitations of law. (B) FIRE DEPARTMENT. The officers and employees, clas- sification and salaries now effective by ordinance relating to the Fire Lepartment shall remain in full force and effect, and unchanged. Provided, however, that.the appointment of aiell.mem- bers of the Fire Department shall hereafter be made by and they shall hold their respective offices at the pleasure of the City Manager, subject to the limitations of law. Section 6. DEPARTMENT OF PUBLIC SERVICE: That there be and hereby.is established and created a Department of Public Sen vice, which shall embrace the superintendence and control of Pub lie Improvements, Streets, alleys.and sewers. The affairs of sail Department of Public Service shall be in charge of a Director of Public Service who shall be ex -officio City Engineer. He shall be a civil engineer and shall prepare plans and specifications and estimates for and superintend the construction of all public improvements, do all surveying and engineering -ordered by the Board of Commissioners and perform all other duties pertaining to his office. He shall give good and sufficeint Surety Company Bond to such City, in the sum of $5,000.00, conditioned for the faithful discharge of the duties of his office and to save the City harmless from all loss caused by neglect of duty or malfeas ante in office. He shall receive a salary fixed and payable as defined by ordinance. For the purpose of the further administration.of the affairs of the said Department of Public Service, the following offices are hereby created and employments authorized. to -wit: (a) A Superintendent of. Streets, alleys, and sewers,*who in addition to the duties now prescribed bJr law and ordinance, shall have under his special charge and control, the cleaning of_guttres, storm water sewers and paved streets. He shall re- ceive a salary fixed and payable as defined by ordinance. (b) All other employes such as Inspectors, Rodmen, Instru- �ment Men, Teamsters, Street Employees and Laborers that may be needed for the._prosecution of work in connection with the De- partment of Public Service shall be employed, and the employ- ment is hereby authorized, by the City Manager whenever it is deemed necessary and expedient: The salaries and wages paid to.such persons employed to be fixed and payable as defined by ordinance. Each of said officers of the Department of Public Service shall be appointed by and hold office at the pleasurer of the City Manager. Section /. For the further administration of the af- fairs and business of the City of Salina, the following offices are hereby created and employments authorized, to -wit: (a) A Superintendent of Parks who shall be in charge of all the parks,parkways, and boulevards belonging to or under the control of the City and shall improve, maintain and regulate the same in accordance with instructions given him by the Board of Commissioners or the City Manager. (b) A Sanitary and Health Officer whose duty it shall be to make all investigations of conditions pertaining to health and sanitation and to see that the rules and regulations of the Kansas State Board of Health are fully complied with. Each of. .the above officers shall be appointed by and hold their office at the pleasure of the City Manager. Their salaries shall be fixed and payable as defined by ordinance. Section S. That the Board of Commissioners may create and establish additional departments'and'offices as may be necessary for the purpose of a more efficient administration and as busi- ness may demand. Provided, when other departments and offices are created and established the officers in charge shall be ap- pointed by and serve at the ple asure of the City Manager and that the duties to be performed and compensation be defined and fixed by ordinance. Section 9. That all ordinances or parts of ordinances in- consistent or in conflict with the terms of this ordinance be and the same are hereby repealed. Section 10.
