Ordinance No. 2386

An ordinance authorizing and -directing the issuance of
$300,000.00 of negotiable coupon bonds of the City
of Salina, Kansas, for the purpose of paying the
cost of erecting a Military Monument and purch asing
a site therefor, in the City of Salina, providing
for the levy of a tax for the payment of the same
and directing the sale and delivery of such bonds.
WHEREAS, a petition was presented to the City Council
properly signed by over 1100 electors, the same being more
than twenty-five per cent (251a) of the electors of the City
of Salina as shown by the vote. for the Secretary of State
at the last preceding election, setting forth that such
electors desired a Military Monument erected in the City of
Salina to be known as a "Memorial Community Building",,.
Said petition stated the -approximate cost of such memorial
to be in the sum of $300,000.00, and requested the Mayor
and City Council to call, an election for the purpose of vot-
ing bonds in said sum for same; and,
WHEREAS, thereafter at a regularly constituted meeting,
the City Council duly considered said petition, and found
the same to be in.all respects as required by law, setting
forth the character of the Military Monument desired to be
erected, the approximate cost thereof,- and further found that
said petition was signed by more than twenty-five per cent
(251p) of the electors of the City as shown by the vote for
Secretary of State at the last preceding election; and,
WHEREAS, the Mayor and City Council directed that the
following proposition be submitted to the electors of the
City at the next regular City election:
"Shall the City 6fsSalita Issue its bonds
..in the sum of 300,000.00 for the con-
struction of a .Memorial Community Com-
munity Building as a military monument
in accordance with the provisions of
Chapter 279, of the Laws of 1919", and
WHEREASP before submitting said proposition said Coun-
cil determined by an order entered, that the indebtedness
for said Military Monument should be paid by an issue of bonds
to be known as Memorial Hall.Bonds; and
WHEREAS., after due notice of said election, as provided
by law,.. a majority of the electors of the City voted in favor
of the erection of said Military Monument and the Mayor and
City Council after due and careful canvass of the ballots cast
in said elent ion declared that the proposition carried and
that said bonds should be issued therefor; and,
WHEREAS, the site of such Military Monument has been
duly determined as provided by law; and
WHEREAS, all acts, conditions and things required to
be doneprecedent to and in the issuance of bonds of the
City of Salina, in the aggregate amount of $300.,000.00 to.
construct said Military Monument have been properly done,
happened and been performed in regular and due form, time
and manner as required by the constitution and laws of the
State of Kansas, NOW) THEREFORE,
Be It Ordained By the Board of 6ommissioners of the City
of Salina, Kansas:
SPCtion 1. That the negotiable coupon bonds of the City
of Salina, State of Kansas, be and the same are hereby author-
ized and directed to be issued in the aggregate amount of
,300,000.00 to pay the cost of said Military Monument, and
the Mayor and City Clerk are hereby directed to execute and
deliver said bonds as provided herein.

Section 2. Said bonds shall be dated January 1, 1921,
shall bear interest at the rate of Five and one-half per cent
(5e) per annum, payable semi-annually on the first days of
January and July of each year, (except that the first coupon
shalll be for one year), which interest shall be evidenced
by coupons attached to and numbered to correspond to the
bonds to which they belong, and shall bear the lithographed
signatures of the Mayor and City Clerk, which signatures
said officials hereby adopt as their official _signatures,
to said coupons. Said bonds shall be signed by the Mayor
and attested by the City Clerk and have the seal of the City
of Salina, affixed thereto. All of said bonds and interest
coupons shall be payable at the office of the State Treas-
urer of the State of Kansas, in the City of Topeka, Kansas,
the same being the fiscal agency of the State of Kansas,
and shall be registered by the City Clerk and also with the
Auditor of State of Kansas, and the full faith, credit and
all of the -resources of the City of Salina, Kansas, are hereby
irrevocably pledged for the prompt payment of the principal
and interest of said bonds as the same severally mature.
Section 3. It is hereby specifically found that said
amount of $300,000.00 -does not exceed the cost of said Mili-
tary Monument, the site thereof and the expenses of said
election, or, more than 1 � of the assessed valuation of the
City of Salina, Kansas. All of said bonds shall be in de-
nomination of $1_,000.00 each and shall be numbered and be-
come .due and payable as follows:

Section 4. Said bonds and, the interest coupons shall

in the State -of Kansas, acknowledges itself i1ndebted. and for
value. received, hereby promises to pay to the bearer on the

with interest thereon from date hereof, at the rate of five
and one-half per centum (5.j�;) per annum, payable semi-annually
on the first days of January -and July of each year, on the
presentation of coupons hereto attached, as they severally

money of the United States of America, at the office of the
State' Treasurer in the City of Topeka, State of. Kansas, and
for the prompt payment of the principal..and interest of this
bond when due, the full faith, credit and resources of the
City' of Salina, Kansas, are hereby irrevocably pledged.
THIS BUND is one of a series of Three Hundred (300)
bonds of like date and tenor, except as to maturity, numbered
from one to three hundred (1 to 300) inclusive, amounting in
the aggregate to Three Hundred Thousand Dollars (300,000.00)
issued for the purpose of erecting a Memorial Hall and purchas-
ing a site therefor in the City of Salina and in pursuance of
and in compliance with the laws of the State of, Kansas.
AND IT IS HEREBY CERTIFIED AND RECITED, that all condi-
tions,

of the State of Kansas, to' exist, happen or be performed pre
cedent' to and in the issuing of this bond have existed, happened
and been performed in regular and due form and time as required
by law, and that the total indebtedness of the said City, in-
clud ing this issue of bonds, does not exceed any constitutional
or statutory limitations.

Section 5. The City of Salina, Kansas, hereby assumes
and promises the holders of said bonds that said City will
make prompt payment of the bonds and interest coupons at the
respective times set out herein, and it is hereby made the
duty of the proper city officials to levy annually, at the
time of making the levy for other City taxes, a tax sufficient
to pay the interest .and principal on said bonds as the same
severally mature.
Section 6. All .ordinances and parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 7. This ordinance shall be in full force and
take effect from and after its passage, approval and publi-
cation once in the official City paper.
