An ordinance providing for the construction of certain sewers
in the City of �alinna, Kansas, letting the contract
therefor and providing .for the payment of the cost of
the same.
`WHEREAS, plans and specifications for certain sewers, here-
inafter described have been ;Wade and propared by the City Engin-
eer, filed with the City Clerk and adopted by the IMayar and
Council upon. the 17th day of November, 1919, and
WHERDIS, Amerman and nyder, for and in consideration of
the payment of the sums hereinafter mentioned have agreed to
construct the same in accordance with such plans and specifica-
tions, Now therefore,
BE IT ORDS INED by the Mayor and Council Of the city of Salina,
Kansas
Section 1. That the*Mayor and Council deem it necessary
and therefore hereby order that the following described sewers.
be built and, constructed, and manholes and catchbasins be built
and constructed at and for the price and . prices hereinafter men-
tioned for each sewer so to be built and constructed as follows,
to -wit:
1450 feet of 12 -inch sewer on Tenth Street and Grand Aven-
ue at and for the price of One (:-1.85) and 85100 Dollars per
lineal foot for the number of feet actually built and construct-
ed

and Thirteenth Streets south of Grand avenue at .arid for the price
of One. ($1.50) and 50/100 Dollars per lineal foot for the number
of feet actually built and constructed and two (2) manholes com-
plete with cast iron top and trap at and for the price of Seven-
ty ($70.00) Dollars each.

950 feet of 10 -inch sewer between Tenth and Eleventh Streets
from South Street north at and for the price of One (<$1.55) and
55100 Dollars per lineal foot for the number of feet actually
built and constructed and two (2) manholes complete with cast
iron top and trap at and for the price of Seventy-ffive (A75.00)
Dollars each.
465 feet of 10 -inch sewer on tdilson Street from Highland Av-
enue to Ninth Street at and for the price of One 01.40) and
40100 Dollars per lineal foot, for the number of feet actually
built and constructed and two (2) manholes complete with cast iron
top and trap at and for the price of Fifty-five (55.00) Dollars
each. '
Taking up the concrete base and asphalt top at Highland k4ve-
nue and Wilson Street, about twenty (,'0), square feet, and replac-
ing same with like material at and for the price of Forty (40.00)
Dollars.
Section 2. The plans and specifications fo the said City
Engineer of Salina, Kansas, for the sewers above described, dated
November 17th, 1919, and now on file with the City Clerk are -here -
by
re -here -by adopted and approved as and for the plans and specifications for
such sewers and are hereby made a part of tills ordinance. All work
herein specified and described shall be done in accordance with
the plans and specifications and under the direction of the City
Engineer.
Section 3. The contract is hereby let to Amerman and Snyder
for the building and construction of the sewers, and manholes here-
tofore described at and for the prices hereinbefore mentioned.

Section 4. It is hereby found and determined that the
prices hereby agreed.to be paid for each of said sewers, and
manholes, is less than the estimated cost of such sewers, and
manholes, and the estimates made by the City Engineer therefor,
and now on file with the U it y Clerk.
Section 5. The person to whom said contract is awarded as
aforesaid, shall execute a written contract With the said City
for the purpose of building and constructing such sewers and
manholes as aforesaid, and shall file with the City Clerk a good
and sufficient bond in the total sum of said contract, condition-
ed that he will build such sewers according to said specifications;
that he will refill the ditches made in the streets and alleys
under which such sewers' shall be laid and constructed; that he
will fulfill the guarantee required in said specifications; and
that he will hold and save harmless the City of Salina from all
damage to persons and property which may arise through the care-
lessness or neglect of said contractor or his servants and em -
ployees; that he will protect said City from all liens or claims
for labor and material used and employed in the building of such
sewers.
Section 6. The cost and expense of constructing such
sewers shall be assessed against all lots and pieces of ground
contained in the City of Salina as a sewer district, as provided
by Ordinance No. 613, passed and approved December 23rd, 1887,
and the Ma or and Council are hereby authorized to provide for
the payment of the cost thereof by installments instead of levy-
ing the entire tax or special assessments at one time, and for
such installments they may issue sewer improvement bonds of the
City of Salina, payable in installments of equal amounts each
year, none of which bonds nor the installments thereof shall riun
longer than ten years nor bear interest exceeding five per cent
per annum, and such bonds may be delivered to the contractor
building such sewers in payment thereof '-ar, the Mayor and Council
may sell said bonds at not less than their par value and pay said
contractor out of the proceeds thereof, and for the purpose of
paying principal and interest on each of sad bonds as they sever-
ally become due, the iliayor and Council shall each year, during
the life of said bonds levy'an assessment or special tax against
all taxable property in said City at the assessed value thereof
for general revenue purpose, in an amount sufficie nt ,to pay the
pay the principal and interest of said bonds for that year; and
the City Clerk shall certify said assessments and special taxes
as they are severally made and levied as aforesaid, -to the County
Clerk of Saline County, Kansas, at the same time and in the same
manner as other taxes of said City are certified.
Section 7. That said contractor shall properly refill all
excavations made in the construction of the above described sew-
ers accordingto the plans and specifications of the City Engin-
eer therefor and shall properly refill said excavations if any
sinking or depression appears therein within a period of one
year after the acceptance of said sewers by the aforesaid City.
Section 8. This ordinance shall take effect and be in
full force from and after its publication once in the official_
City paper.

City of Salina, Kansas, letting the contract therefor and pro-
viding for the payment of the cost of the same.
WHER'r:AS, plans and specifications for certain sewers, here-
inafter described have been made and prepared by the City Engineer, filed
with the City Clerk and adopted by the mayor and Council upon the 17th
day of Rovember, 1919, and
WHEREAS, Amerman and Snyder, for and in consideration of the
payment of the sums hereinafter mentioned have agreed to construct the
same in accordance with such pians and specifications, Now 'Therefore,
BE IT ORDAINED by the Mayor and Council of the City of Salina, Kansas:

Taking up the concrete base and asphalt top at Highland Avenue
and 'Wilson Street, about twenty (20) square feet, and replacing same
with like material at and for the price of Forty 040.00) Dollars.
Section 2. The plans and specifications of the said City
Engineer of Salina, Kansas, for the sewers above described, dated Povem-
her 17th, 1919, and now on file with the City Clerk are hereby adopted
and approved as and for the plans and specifications for such sewers and
are hereby made a part of this ordinance. All work herein specified and
described shall be done in accordance with the plans and specifications
and under the direction of the City Engineer.
Section S. The contract is hereby let to Amerman and Snyder
for the building and construction of the sewers, and manholes hereto-
fore described at and for the prices hereinbefore mentioned.
