2315 Improving Putnam AveA 454 CD ORDINANCE NO. 2315 (,Published in The Galina Evening Journal January 2�th, 1920) An Ordinance providing for the paving, curbing, guttering, exca- vating and grading of Putnam Avenue from the south line of South Street to the north line of Morrison Avenue, specify- ing the manner of construction, providing for the cost there- of and the manner of payment . WHEREAS, a' petition has been presented to the Mayor and Council requesting the Mayor and Council to pave, curb, gutter, excavated' and grade Putnam Avenue in the city of Salina, Kansas, from the south line of South street to the north line of Morrison Avenue,* and WHEREkS, said petition has been examined and found to contain the names of a majority of the resident owners of real property.:lia- ble for taxation, NOW Th aEFf'ORE, BE IT ORDALI'ED by the Mayor and Councilmen of the City of Salina: Section 1.. That it is necessary and is hereby ordered that Putnam Street in the City of Salina, Kansas, from the south line of South Street to the north line of. Morrison Avenue be paved with such material as the Mayor and Council shall hereafter select and desig- nate. Such paving to be of such width as the Mayor and Council shall hereafter determine and shall extend to the lot line on such street at the intersection of such street with any other street or alley. Section 2.' It is necessary and hereby ordered that said streets, within the limits aforesaid, be curbed and guttered on both sides thereof with cement curb and gutter, the curb part there- of to be six (6) inches in thickness and the gutter part thereof to be forty-two (42) inches in width from the back edge of such curb- ing and guttering to the paving line on said streets. The lot line edge of such curbing and guttering shall be set such distance from the center of said streets as the Mayor and Council shall hereafter determine; Provided, however, that at the intersection of such street with any other streets and alleys such curbing and guttering shall return to the lot line of such streets. Section 30' All.excavating, rolling and grading for the pro- per construction of such paving, curbing and guttering shall be done and such paving, curbing and guttering shall be laid and construct- ed on the established grade of said streets as heretofore or here- after established by the ordinances of the City of Salina. Section 4. The City Engineers s plans and specifications and estimates of cost for the making of the improvements herein provided for, filed with the City Clerk on the 5th day of January, 1920, are hereby adopted and approved by the Council. 1 I 1 1 1 1 1 1 1 d; Section 5. The k'ayor and Council shall hereafter by ordi- nance determine the kind of paving, curbing and guttering to be placed on the above described streets, and shall let a contract for the construction of such paving, curbing and guttering to the most satisfactory and responsible bidder or person. Section 6. After the passage and publication of this ordi- nance the Mayor and Council shall appoint three disinterested heuse- holders of the City who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the cost of said improvements, shall, within ten days after having been notified of their appointment , proceed to appraise said .lets and pieces of ground liable to taxa- tion for such improvements, without regard to the improvements thereon, and after making said aPPraisement's, shall return the same to the Mayor and Council, the said Mayor and Council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisements, of which spe- cial session, due notice shall be given in the official City paper, and at said special session the Mayor and Council shall, if they deem it just and proper alter or change such appraisements. Section 7. -� or the purpose of paying for such paving, curb- ing, guttering, excavating and grading, the Myaor and Council are hereby directed and authorized toissue bonds of the City cif Salina, in an amount not to exceed the contract price therefor, and to run for such a period of time as the Mayor and Council shall determine, not to exceed, however ten years from the date of such bonds, and to be .payable in equal amounts each year during the life of such bonds, together with interest not to exceed the rate of five, per cent per annum, which bonds shall be payable at the fiscal agency of the State of I{ansas, and for the purpose of pay- ing the principal and interest on such bonds as they severally be- come due, the Mayor and Council shall each year during the life of such bonds, levy an assessment against the lots and pieces or ground liable for taxation for the improvements herein provided .for, in an amount sufficient to pay the principal and interest for that year;, Provided, that for the purpose of defrying the cost t of having and excavating the squares and areas formed by the cross- ing of the streets and alleys, as well as where the improvement is through or adjacent to gity property, for shish the City would be liable, the assessment shall be made against all of the takable property of the City, and the City Clerk shall certify said assess- ments as they are severally made, to the County Clerk of Saline. County, Kansas, at the same time and in the same manner as other taxes are certified, and said assessments shall be liable to the same penalties as other taxes; Provided, that the Mayor and Council shall by ordinance apportion and assess the special assessments aforesaid against the lots and pieces of ground in the taxing districts for said improvements, which assessment and apportionment shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements.
