2314 Improving Bond Streeti 1 ORDINANCE NO. 2314 (rublished. in The Salina Evening Journal January 24th, 1920 An ordinance providing for the paving, curbing, guttering, excap vating, and grading of Bond Street from the west line of Highland &venue to the east line of Ninth Street, specify- ing the manner of construction, providing for the cost thereof and the manner of payment. "uHEREIS, a petition has been presented to the Mayor and Coun- cil requesting the Mayor and Gouncil to pave, curb, gutter, exca- vate and grade Bond Street in -the City of Salina, Kansas from the west line of Highland Avenue to the easst line ,of Ninth Ltreet, and utiHERE'S, said petition has been examined and found to contain the names of a majority of the resident owners of real property liable for taxation, NOW THEREI'OFtE, BE IT 0R.DA11,1ED by the Mayor and Councilmen of the City of Salina, Kansas: Section 1. That it is necessary and. is hereby ordered that Bond Street in the City of Salina, Kansas, from the.west line of Highland 'venue to the east line of ninth Street be paved with such material as the Mayor and Council shall hereafter select and desig- nate. Such paving to be of such width as the Mayor and Council shall hereafter determine and shall ext4nd to the lot line on such street at the intersection of such street with any other street or alley, Section 2. It is necessary and hereby ordered that said street within the limits aforesaid, be curbed and guttered on both sides thereof with cement curb and gutter, the curb part, thereof to be six (6) inches in thickness and the gutter part thereof to be forty-two (42) inches in width from the back edge of such curbing and guttering to the paving line on said Streets. The lot line edge of such curbing and guttering shall be set such distance from the center of said streets as the Mayor and Council shall hereafter determine; Provided, however, that at the intersection of such street with any other streets and alleys such curbing and guttering shall return to the lot line of such streets. Section 3. All excavating, rolling and grading for the proper construction of such paving, curbing and guttering shall be done and such paving, curbing and guttering shall be laid and constructed on the established grade of said streets as heretofore or hereafter established by the ordinances of the City of Salina . Section 4. The City Engineers plans and specifications and estimates of cost for the making of the improvements herein provided for, filed with the City Clerk on the 15th day of September, 1919, are hereby adopted and approved by the Council. Section 5. The Yayor and Council shall hereafter by ordinance determine the kind of paving, curbing and guttering be placed on the above described streets, and shall let a contract for the construction of such paving, curbing and gut- tering to the most sat isfactory and responsible bidder or. per- son. Section 6. After the passage and publication of this ordinance the Mayor and Council shall appoint three disinter= ested householders of the City who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the cost of said improvements, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to taxation for such improvements, without regard to the improvements thereon, and after making said ap praisement, shall return the same to the Mayor and Council, and after such appraisement is returned to the Mayor and Council, the said Mayor and Council shall designate a time for hodling a special session for the purpose of hearing complaints and equalizing said appraisements, of which special session, due notice shall be given in the official City paper, and at said special session the Mayor and council shall, if they deem it just and proper alter or change such appraisements . vection 7. For the purpose of paying for such paving,. curbing' ` guttering, excavating and grad ing, the Mayor and noun cil are hereby directed and authorized to issue bonds of the 6ity of Salina, in an amount not to exceed the contract pruce therefor, and to run for such a period of time as the Mayor and Council shall determine, not to exceed however, ten years, from the date of such bonds, and to be payable in equal amounts each year during the life. of such bonds, together with interest not to exceed the rate of five per cent per annum., wrlich bonds: shall be' payable at the fiscal agency of the State of Kansas, and for the purpose of paying the principal and interest on such bonds as they severally become due, the Mayor and Council shall each year during the life of such bonds, levy assessments against the lots and pieces of ground liable for taxation for the im- provements herein procided for, in an amount sufficient to pay the principal and interest for that year: Provided, that for the purpose of defraying the cost of paving and excavating the 1 C 1 n P, 1 1 1 1 squares and areas formed by the crossing of the streets and alleys as well as where the improvement is through or adjacent to City property fir which the City would be liable, the assessment shall be made against all of the taxable property of the City, and the C'-ity Clerk shall ceftify said assessments as they are severally made to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes are certified and said assess ments shall be liable to the same penalties as other taxes; Pro- vided that the Mayor and (;ouncil shall by ordinance apportion and assess the special assessments aforesaid against the lots and pie- ces of ground in the taxing districts for said improvements, which assessment and apportionment shall hold. good for all the install- ments that are to be collected from the specific property charge- able with said improverents. For the purpose of paying for such paving, curbing, guttering, excavating and grading, the Ia?ayor and Council are hereby directed and authorized to issue bonds of the City of Salina, in an amount 3. not to exceed the contract price therefor, and to run for such a period of time as the'Iayor and Council shall determine, not to exceed, however, ten years, from the date of such bonds, and to be payable in equal amounts each year during the life of such bonds, together with interest not to exceed the rate of five per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas, and for the purpose of paying the principal and interest on such bonds as they severally 'become due, the A% yor and Council shall each year during the life of such bonds, levy assessment against the lots and pieces of ground liable for taxation for the improvements herein provided for, in an amount sufficient to, pay the prin- cipal and interest for that year: Provided, that for the purpose of de- fraying the cost of paving and excavating the squares and areas formed by the crossing of the streets and alleys, as well as where the improvement is through or adjacent to City property, for which the City would be liable, the assessment shall be made against all of the taxable property of the City,, and the City Clerk shall certify said assessments as they are severally made, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes are certified and said assessments shall be liable to the same penalites as other taxes: Pro- viaed that the Idayor and Council shall be ordinance apportion and assess the special assessments aforesaid against the lots and pieces of ground in the taxing districts for said improvements, which assessment and app- ortionment stall hold good for all the installments that are to be collect- ed from the specific property chargeable with said improvements.
