WHEIRIT4k5, a petition has been presented to the Mayor and Coun- cil requesting the lyiayor and Uouncil to pave, curb and gutter, ex- cavate and grade Crawford avenue in the city of Salina, Kansas, from the east line of Santa Fe ,Avenue to the west line of Fifth Street, and WHEREAS, said petition has been examined and found to contain the names of a majority of tht resident owne5s of property liable for taxation, NOW THEREFORE11, BE IT ORWiINED by the Mayor and Councilmen of the City of Salina', Kansas; Section 1. That it is necessary and hereby ordered that Crawford Avenue in the City of Salina, Kansas, from the east line of Santa -Fe Avenue to the west line of Fifth Street -be paved with J such material as the yilayor and council shall hereafter select and designate. Such paving to be of such width as the Mayor and Coun- cil shall hereafter determine and shall extend to the lot line on such street at the intersection of such street with any other strew or alley. Section 2. It is necessary and hereby ordered that said. streets, within the limits afores aid, be curbed and guttered on both sides thereof with cement curb and gutter, the curb part thereof to be six(G) inches in thickness and the gutter part there- of to be forty-two t(42) inches in width from the back edge of such curbing and guttering to the paving line on said Streets. The lot line edge of such curbing and guttering shall be set such dis- tance f rom the center of said street as the Mayor and Council shall hereafter determine; Provided, however, that at the intersections of such street with any other streets and ai leys such curbing and guttering shall return to the lot line of such streets Section ,3.. All excavatf)ng,. rolling; and €;riding for the proper construction of .such paving, .curbing, and guttering shall be done and such paving, curbing, and guttering shall be laid and constructed on the established grade of said street as heretofore or hereafter established by the ordinances of the City of Salina. Section 4'. The City Engineer's plans and spa cificat ions and estimates of cost for the making of the impzv vements herein pro- vided for, filed with the City Clerk on the 15th day of September, 1919, are hereby adopted and approved by the C®until. 1 1 1 1 A Section 5. The Mayor and. Uouncil shall hereafter by ord- inance determine the kind .of paving, curbing and guttering to be placed on the above described street, and shall let a contract for the construction of such paving, curbing and guttering to the ° most satisfactory and responsible bidder or person. Section 6: After the passage and publication of this ordi- nance the'lvlayor-and Council shall appoint three disinterested hous- holders of the City who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment and taxation for the cost of said improvements, shall, within ten days after having been notified of their appointment proceed to appraise said lots and pieces of ground liable to taxa- tion for such improvements without regard to the improvements there- on, and after making said appraisement shall return the same to the Mayor and Council, the said Mayor and Council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement s, of which special ses- sion, due notice shall given in the official City paper, and at sail special session the Mayor Council shall, and if they deem it just and proper alter or change such appraisement.. Section 7. For the purpose of paying for such paving, curb- il g , gut t e'ring , excavating and grading, the I01ayor and Council a -re hereby directed and authorized to issue bonds of the City of Sali- na, in an amount not to exceed the contract price therefor, and to run for such period of time as 'tile P,,.ayor and Council shall deter- mine, not to exceed, however, ten years, from the date of such bonds, and to be payable in equal amounts each year during the life of such bonds, together with interest not to exceed the rate of five per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas, and for the purpose of pay- ing the principal and interest on such bonds as they severally be- come due, the Mayor and Council shall each year during the life of such bonds, levy an assessment against the lots and pieces of ground liable for taxation for the improvements herein provided for, in an amount sufficient to pay the principal and interest for that year; Provided,. that for the purpose of defraying the cost of paving and excavating the squares and areas formed by 'the crossing of the streets and alleys, as well as where the improvement is through or adjacent to `'ity property, for which the City would be liable, ass- essments shall be Trade against all of the taxable property of the City., and the City Clerk shall certify said assessments as they are severally made, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes are certif- ied, and said assessments shall be liable to the same penalties as other taxes; provided, that the Mayor and Uouncil shall by ordi- nance apportion and assess the special assessments a.-oresaid, against the lots and pieces of ground in the taxing districts for said improvements, which assessment and apportionment and hold good for all the installments that are to be collected from the specific property chargeable with said improvements. WHEREAS, a -petition has been'presented to the I:Iayor and Council requesting the Idayor and Council to pave, curb and gutter, excavate and grade Crawford Avenue in the City of Salina,ransas, from the 'Last line of Santa Pe Avenue to the +test line of ,Fifth Street, and WHEREAS, said petition has been examined and found to contain the names of a majority of the resident owners of real property liable for taxation, NOW THEREFORE, BE PP ORDAINED by the Iu!ayor and Councilmen of the City of Salina, Kansas: Section 1. That it is necessary and is hereby ordered that Crawford Avenue in the City of Salina, Kansas, from the East line of Santa Fe Avenue to the West line of Fifth Street be paved with such material as the Ida yor and Council shall hereafter select and designate. Such paving to be of such width as the Yayor and Council shall hereafter determine and shall extend to the lot line on such street at the intersection of such street with any other street or alley. Section 2. It is necessary and hereby ordered that said streets, within the limits aforesaid, be curbed and guttered on both sides thereof with cement curb and gutter, the curb part thereof to be six (6) inches in thickness and the gutter part thereof to be forty-tvao (42) inches in width from the back edge of such crubing and guttering to the paving line on said streets. `!he lot line edge of such crubing and guttering shall be set such distance from the center of said street as the Mayor and Council shall hereafter determine; Provided, however, that at the interesection of such street with any other streets and alleys such curbing and gutter- ing shall return to the lot line of such streets. r-� 2. Section 3. All excavating, rolling and grading for the proper construction of such paving, curbing and guttering shall be done and .such paving, curbing and guttering shall be laid and constructed on the estab- lished grade of said streest as heretofore or hereafter established by the ordinances of the City of Salina. Section 4.
