A,n ordinance providing for .the paving, curbing, guttering, exca-
vating., and grading of Ohio Avenue from the north line of
Iron Avenue to -the south line of Ash Street, specifying
the manner of construction, providing for the cost there-
of and the manner of payment.
WHEUAS, a petition has been presented to the Mayor and
Council requesting the Mayor and Council to pave, curb, gutter,
excavate and grade Ohio Avenue from the north line of Iron Aven-
ue to the south line of Ash Street, in the city of Salina, Kan-
sas, and -
rdHEREAS, said petition has been examined and found to con-
tain the names of a majority of the resident owners of real pro-
perty liable for taxation, NOW THEREFORE,
BE IT 01iDxINED by the Mayor and Councilmen of the City of Salin4,
Kansas:
Section 1. That it is necessary and hereby ordered that
Ohio Street in the City of Salina, Kansas, from the north line
of Iron Avenue to the south line of Ash Street be paved with such
material as the Mayor and Council shall hereafter select and de-
signate.' Such paving to be of such width as the Mayor and Coun-
cil shall hereafter determine and shall extend to the lot line on
such street at the intersection of such street with any other
street or alley.
Section 2. It is necessary and hereby ordered that said
street, within the limits aforesaid, be curbed and guttered on
butt[ sides thereof with cement curb and gutter, the curb part
thereof to be six (F) inches in thickness and the gutter part
thereof to be forty-two (42) inches in width from the back edge
of such curbing and guttering to the paving line on said Streets.

shall hereafter determine; Provided, however, that. at the inter-
section of such street with any other streets and alleys such
curbing and guttering shall return to the lot line of such streets.
Section 3. All excavating, rolling and grading for the pro-
per construction of such paving, curbing and guttering shall be
done and such paving, curbing and guttering shall be laid and con-
structed on the established grade of said streets as heretofore
or hereafter established by the ordinances of the City of Salina.
Section 4. The City Engineer's plans and specifications and
estimates of cost for the making of the improvements herein pro-
vided for, filed with the City Clerk on the 15th day of September,
1919, are hereby adopted and approved by the Council.
Section 5. The iviayor and Council shall hereafter by
ordinance determine the kind of paving, 'curbing, and guttering
to be placed on the above described street, and shall let a
contract for the construction of such paving, curbing and gutter-
ing to the most satisfactory and respeonsible bidder or person.
Section 6.1.. After the passage and publication of this
ordinance the payor and Council shall appoint three disinterest-
ed

ed householders of the City who, after having taken an oath to
faithfully, and impartially appraise all lots and pieces of ground
liable to assessment and taxation for the cost of said improve-
ments, shall, .within ten days after having been notified of
their appointment, proceed to appraise said lots and pieces of
ground liable to taxation for such improvements, without regard
to the improvements thereon, and after making said appraisement
shall return the same to .the ii1ayor and Council, and after such
appraisement is returned to the Mayor and Council, the said
Mayor and Council shall designated a time for holding a special
session for the purpose of hearing complaints and, equalizing said
appraisements, of which special session due notice shall be giv-
en in the official City paper, and at said special session the
Mayor and Council shall, if they deem it just a,nd proper alter
or change such appraisement.
6ection 7... °For the purpose of paying for such paving,
curbing, guttering, excavating and grading, the Mayor and coun-
cil are hereby directed and authorized to issue bonds of the
City of Salina, in an amount not to exceed the contract price
therefor, and to run for such a period of time as the Mayor and
Uouncil shall determine, not to exceed, .however, ten years, from
the date of such, bonds, and to -be payable in equal amounts each.
year during the life of such bonds, together ,with interest not -
to exceed the rate of five per cent per annum, which bonds shall
be payable at the fiscal agency of the State of Kansas, and for`
the purpose of paying the principal and interest on such bonds
as they severally become due, the Mayor and Council shall :; ach
year during the life of such bonds, levy an assessments against
the lots and pieces of ground liable for taxation for the im-
provements herein provided for, in an amount sufficient to pay
the principal and interest for that year; :provided, that for
the purpose of defraying the cost of paving and excavating the,
squares and areas formed by the crossing of the streets and al-

legs, as well as where the improvement is through or adjacent to
city property, for which the city would be liable, the assessment
shall be made against all of the taxable property of the City, and
the City Clerk shall certify said assessments as they are sever-
ally made, -to the County Ulerk , of Saline County, Kansas, at the
same time and in the sane manner as other taxes are certified, and
said assessments shall be liable to the sane penalties as other
taxes; :Provided, that the Mayor and Council shall by ordinance
apportion and assess the special assessments aforesaid against the
lots and pieces of ground in the taxing districts of said improve-
ments, which assessment and apportionment shall hold good for -all
the installments that are to be collected for the specific proper-
ty chargeable with said improvements.
Section 8.. This ordinance shall take effect and be in full
force from -and after its publication once in the official City
paper.

providing for the cost thereof and the manner of payment.

Street in the City of Salina, Kansas, and

set such distance from the center of said streets as ,the Mayor and Council
shall hereafter determine; Provided, however, that at.the intersection of
such street with any other streets and alleys such curbing and guttering
shall return to the lot line of such streets.

Section 3. All excavating, rolling and grading for the proper
construction of such paving, curbing and guttering shall be done and such
paving, curbing and guttering shall be laid and constructed un the estab-
lished grade of said streets as heretofore or hereafter established by
theordinances of the City of Salina.
oection 4. The City Engineer's plans and specifications and

principal and interest for that year: Provided, that for the purpose of
defraying the cost of paving and excavating the squares and areas formed
by the crossing of the streets and alleys, as well as where the improvement
is through or adjacent to City property, for which the City would be liable,
the assessment shall be made against all of the taxable property of the
City, and the City Clerk shall certify said assessments as they are
severally made, to the County Clerk of Saline County, Kansas, at the
same time and in the same manner as other taxes are certified, and said
assessments shall be liable to the same penalties as other taxes: Provided
that the Iaayor and Council shall vy ordinance apportion and assess the
special assessments aforesaid against the lots and pieces of ground in
the taxing districts for said improvements, which assessment and apportion-
ment shall hold good for all the installments that are to be collected
from the specific property chargeable with said improvements.
Sectiun a. This ordinance shall take effect and be in full
force from and after its publication once in the official City paper.
