North `Tine of Elm Street --north to' the Mis- souri Pacific Railway Tracks, specifying the manner of con- struction, providing for the costs thereof and the manner of payment. WHEREAS, a petition has been presented to the Mayor and Council requesting the Mayor and Council to pave, curb, gutter,_ . excavate and grade Fifth Street in the City of Salina, Kansas, Brom the north line -of Elm Street north to the Missouri Pacific Railway Tracks, and VJHEHE'AS,, said petition has been examined and found to con-. Iain the names of a majority of the resident owners of real pro perty liable for taxation, NOW THEREFORE, BE IT CRDA.INED by the Mayor and Councilmen of the City of Salina, Kansas: Section 1. That it is necessary and hereby ordered that Fifth Street in the City of Salina, Kansas, from the north line of Elm Street north to the Missouri Pacific Railway Tracks be paved with such material as the Mayor and Council shall hereafter select and designate. Such paving to be of such width as the Mayor and Council shall hereafter determine and shall extend to the lot line on such street at the intersection of such street with any other street or alley. 4 Section 2. It is 'necessary and hereby ordered that said streets within the'limits aforesaid, be curbed and guttered on both sides thereof.,. with cement curb and gutter, the curb part thereof to be six (6) inches in thickness and the gutter part thereof to be forty-two (.42) inches in width from the back edge µ. of such curbing and guttering to the paving lire on said streets.. The lot lineedge of such curbing and guttering shall be set such distance from the center of said streets as the Mayor and Coun- cil shall hereafter determine) Provided, however, that at the intersection of such street with any other streets and alleys such curbing and guttering shall return to the lot line of such streets. Section 3. 1111 excavating, rolling and grading for the proper construction of such paving, curbing and guttering shall be done and such paving, curbing and guttering shall be laid and constructed on the established grades of said streets as hereto- fore or hereafter established by the ordinances of the City of Salina. 1 1 1 7 1 1 1 1 1 1 Section 4. The City Engineer's plans and specifications and estimates of cost for the making of the improvements herein provided for, filed with the City C.1erk on the 15th day of Septem- ber, 1919 are hereby adopted and approved by the Council. Section 5. The Mayor and Council shall hereafter by ordi- nance determine the kind of paving, curbing and guttering to be placed on the above described street, and shall let a contract for the construction of such paving, curbing and guttering to the most satisfactory and responsible bidder or person.- Section erson. Section -6. After the passage and publication of this ordi- nance the Mayor and Council shall appoint three disinterested householders of the City, who, after having taken an oath to faith- fully and impartially appraise all lots and pieces of ground lia- ble to assessment and taxation for the cost of said improvements, shall, within ten days after having been notified of their ap- pointment proceed to appraise said lots and pieces of ground lia- ble to taxation for such imrpovements, without regard to the im- provements thereon, and after making -said appraisement shall re- turn'the same to the 'Layor and Council, and after such appraise- ment is returned to the Mayor and Council, the said Mayor and Coun- cil shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisements of which special session due notice shall be given in the offi- cial City paper, and at said special session the Mayor and Coun- cil shall, if they deem it just and proper alter or change such appraisement . Section 7. For the purpose of paying for such paving, curb- ing, urb-ing, guttering, excavating and grading , the Mayor and Council are hereby directed and authorized to issue bonds of the City of Salina, in an amount not to exceed the contract price therefor, and to run for such a period of time as the Payor and Council shall determine, not.to exceed however ten years, from the date of such bonds, and to be payable in equal amounts each year during the life of such bonds, together with interest not to exceed five per cent per annum, which bonds shall be payable at ' the fisdal agency of the State of Kansas; and for the purpose of paying the princi- pal and interest on such bonds as they severally become due, the mayor and'(, ounci l shall each year during the life of such bonds levy assessments against. the lots and pieces of ground liable for taxation for the improvement herein provided. for, in an amount sufficient to pay the principal and interest for that year; Provided, that for the purpose of defraying the cost of paving and excavating the squares and areas formed by the crossing of the streets and alleys, as well as where the improvement is through or adjacent to City property, for which the City would be liable, the assessment shall be made against all.of the taxable property of the City, and the City Clerk shall certify said assessments as they are severally made, to the County Clerk of Saline county, Kansas, at the same time and in the same manner as other taxes,. are certified, and said assessments shall be liable to the same penalties as other taxes; provided, that the Mayor and Council shall by ordinance apportion and assess the special assessments aforesaid against the lots and pieces of ground in the taxing districts for said improvements, which assessment and apportion- ment shall hold good for all the installments that are to be collected from the specific property chargeable with said Improve-. ments. Section 7.
