ORDINANCE NO. 2310

An ordinance providing for the paving, excavating and grading
of State Street from the west line of Tenth Street to
the. -east line of College Avenue, specifying the manner
of construction, providing for.the cost therefor and the
manner of payment.
WHEF►EAS; a petition has been presented to the Mayor and
Council. requesting the Mayor and Council to -pave, excavate and
grade Street Street from the west line of Tenth Street to the
east line of College Avenue in the City :of Salina, Kansas, and
WHEREAS, said petition has been examined and found to con-
tain the names of a majority of the resident owners of real pro-
perty liable for~taxation, NOW THEREFORE,
BE IT ORD4,1NED by the Mayor and Councilmen of the City of Salina,
Kansas
Section 1. That it is necessary and is hereby ordered that
Mate Street in the City of Salina, Kansas, from the west line
of Tenth Street to the east line of College Avenue be paved with
such material as the Mayor and fC'ouncil shall hereafter select and
designate.. Such paving to be of such width as the Mayor and Coun-
cil shall hereafter determine and shall extend to the lot line on
such street at the intersection of such street with any other
street or alley.
Section 2. A11 excavating, rolling and grading for the pro-
per construction of such paving shall be. done and such paving shall
be laid and constructed on the established grade of said streets
as heretofore or hereafter established by the ordinances of the
City of Salina, Kansas.
Section 3. The City Engineer's plans and specifications and
estimates of cost for the making of the improvements herein pro-
vided for, filed with the City Glerk on the 15th day of September,
19190 are hereby adopted and approved by the Council.
Section 4. The Mayor and Council shall hereafter by ordi-
nance determine the kind of paving to be placed on the above de-
scribed streets, and shall let a contract for the construction of
such paving to the lost satisfactory and responsible bidder or per-
son.
Section 5. After the passage and publication of this ordi-
nance the Mayor and kaouncil shall appoint three disinterested house-
holders of the City, who, after having taken an oath to faithfully
and impartially appraise all lots and 'pieces of ground liable to
assessment.,and taxation for the cost of said improvements, shall,
within ten days after having been notified of their appointment,
proceed to appraise said lots and pieces of ground liable to taxa-
tion for such improvements, without regard to the improvements
thereon, and after making said appraisement shall return the
same to the Mayor and Council, and after such appraisement is
returned to the Mayor and Gouncil, the said Mayor and Council
shall designate a time for holding a special session for the p.
purpose of hearing complaints and equalizing said appraisements
of which special session due notice shall be given in the offi-
cial City paper, and at said special session the Mayor and Coun-
cil shall, if they deem it just and proper, alter or change
such appraisement.
Section 6-6For the purpose of paying for such paving,
excavating and grading, the mayor and Council are hereby direct'-
ed
irect-ed and authorized to issue bonds of the City of Salina, in am
amount not to exceed the contract price therefor, and to run
for such a period of time as the Mayor and Council shall deter-
mine, not to exceed, however, ten years, from the date of such.
bonds, and to be payable in equal amounts each year during the
(life of such bonds, together with interest not to exceed the
rate of five per cent per annum, which bonds shall be payable
at the fiscal agency of the State of Kansas, and for the pur-
pose of paying the principal and interest on such bonds as
they severally become due, the Mayor and (%ouncil'shall each
year during the life of such bonds, levy assessments against
the lots and pieces of ground liable for taxation for the im-
provements herein probided for, in an amount sufficeient to
pay the principal and interest for that year; Provided, that
for the purpose of . defraying the cost of. paving and excavat-
ing the squares :and areas formed by the crossing of the streets.,
and alleys, as well as where the improvement is through or ad-
jacent to City property, for which the City would be liable
the assessment shall be made against all of the tadable property
of the City, and the City Clerk shall certify said assessments
as they are severally made, to the County Clerk of Saline Coun-
ty, Kansas, at the same time and in the same manner as other
taxes are certified, and said assessments shall be liable to
the same penalties as other taxes: Provided, that the Mayor
and Council shall by ordinance apportion and assess the special
assessments aforesaid against the lots and pieces of ground in
the taxing districts for said improvements, which assessment
and apportionment shall hold good for all the installments that
are to be collected from the specific property chargeable with
said improvements.

Section 7. This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper:

An ordinance providing for the paving, excavating and grading of State
Street, from the `"fest line of 'Tenth Street to the East line of
College Avenue, specifying the manner of const -ruction, providing
for the cost thereof and the manner of payment.
WHEREAS, a petition has been presented to the Ia yor and
Council requesting the Mayor and Council to pave, excavate and grade
State Street from the Test line of Tenth Street to the East line of
College Avenue in the City of Salina, Kansas, and
WHEREAS, said petition has been examined and found to contain
the names of a majority of the resident owners of real property liable
for taxation, 14OW THEREFORE,
BE IT ORDAINED, by the 1.'Layor and Councilmen of the City of Salina, Kansas:
Section 1.. That it is necessary and is hereby ordered that
