2309 Improving College Ave10 436 URiil J4iNGE N.C. 2309 (rublished in The Salina Evening Journal January 24th, 1920.) An ordinance providing for the paving, curbing, guttering, exca- vating, and grading of College -venue in the City of Salina, from the south line of Walnut Street to the north line of South Street, specifying the manner of construction, pro- viding" for the cost thereof and the manner of payment. WHEREAS, a petition has been presented to the Mayor and Council requesting the Mayor and Council to pave, curb, gutter, excavate and grade College Avenue_ in the City of Salina, from the south line of Walnut Street to the north line of South Street,. and WHERF,&S, said petition has been examined and found to con- tain ontoin the names of a majority. of the resident owners of real pro- perty liable for taxation, NOW T.I EREFOFE, BE IT ORDAINED by the Mayor and Councilmen of the City of Salina, Kansas: Section 1. That it is necessary and is hereby ordered that College Avenue in the City of Salina, Kansas, from the south line of Walnut Street to the north line of South Street be paved with such material as the Mayor and Council shall hereafter select and designate. Suchpaving to be of such width as the Mayor and Uouncil shall hereafter determine and shall extend to the lot line on such street at the intersection of such street with any other street or alley. Section 2. It is necessary and hereby ordered that said street, within the limits aforesaid, be curbed, and guttered on both sides thereof with cement curb and gutter, the curb part thereof to be six (6) inches in thickness and the gutter part thereof to be forty-two (42) inches in width from the back edge of such curbing., and guttering to the paving line on said Streets. The lot line edge of - such curbing a -rid guttering shall be set such distance from the center of said streets as the Mayor and Council shall hereafter determine; Provided, ho`wever,-that at the inter- section of such street with any other streets and ai leys such curbing and guttering shall return to the lot line of such streets. Section 3 411 excavating, rolling and grading for the proper construction of such paving, curbing and guttering shall be done and such paving, curbing, and guttering shall be laid and constructed on the established grade of said streets as hereafter or heretofore established by the ordinances of the City of Salina. Section 4. The City Engineer's plans and specifications and estimates of cost for the making of the improvements herein pro- vided for, filed with the City Clerk on the 19th day of January, 1920, are hereby adopted and approved by the Council. 1 1 1 1 1 1 1 1 Section 5. The Mayor and. Council shall hereafter by ordinance determine the kind. of paving, curbing and guttering to be placed on the above described street, and shall let a contract for the construction of such paving, curbing and guttering to the most satisfactory and responsible bidder or person. Section 6. After the passage and publication of this ordi- nance the Mayor and Council shall appoint three disinterested ap- praisers p- praisers of the City who , after having taken an oath to faithful- ly and impartially appraise all lots and pieces of ground liable to assessment and taxation for the cost of said improvements, shall, within ten days after having been notified of their appoint- ment, proceed to appraise said lots and pieces of ground liable to taxation for such improvements, without regard to the improvement s thereon, and after making said appraisement, shall return the same to the Mayor and Council, and after such 'appraisement is returned to the Mayor and Council, the said Mayor and. Council shall desig- nate a time for holding a' special meeting for the purpose of hear- ing complaints and equalizing said appraisemer_ts; of which special session due notice shall be given in the official City paper, and at said special session the Mayor and Council shall, if they deem it just and proper, alter or change such appraisements . Section 7, For the purpose of paying for such paving, curb- ing, guttering, excavating and gradingn,, the Mayor and Council are hereby directed and authorized to issue bonds of the City of Sali- na, in an amount not to exceed the contract price therefor, and to run A:for such a period of time as the Mayor and Council shall de- termine, e- termine, not to exceed hoever, ten years, from the date of such bonds, and to be payable in equal amounts. each year during the life of such bonds, together with interest not to exceed the rate of five per cent per annum, which bonds shall be payable at the fiscal agency of the State of Kansas, and for the purpose of paying the principal and interest on such bonds as they severally become due, the M@yor and Council shall each year during the life of such bonds, levy assessments against the lots and pieces of ground lia- ble for taxation for the improvements herein provided for, in an amount sufficient to pay the principal and. interest for that year; Provided, that for the purpose of defraying the cost if paving and excavating the squares and areas formed by the crossing of the streets and alleys, as well as where the improvement is through m adjacent to City property, for which the City would be liable,% the assessment shall be made against all of the taxable property" of the City, and the City Clerk. shall certify said assessments as they are severally made, to the County Clerk of. Saline County, Kansas, at the same time and in the same manner. as other taxes are certified, adn said .assessments shall be liable to the same' penalties as other taxes; Provided that the Mayor and Council shall by ordinance apportion and assess the special assessments aforesaid against the lots and pieces of ground in the taxing districts for said improvements, which assessment and apportion- ment shall hold good for all the installments that are to be col- lected from the specific property chargeable with said improve - merits .
