07-10379 Zone Grounds of KWU - DENIED(Published in the Salina Journal on March _, 2007) ORDINANCE NUMBER 07-10379 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE tO ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR n THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE,. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -5". PLANNED SERVICE COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to - wit: Lot 68 and the West One Hundred and Ten (I 10) feet of Lots 70 and 72, in the Grounds of Kansas Wesleyan University, an Addition to the City of Salina, Saline County, Kansas (addressed as 1513 S. Ninth Street). shall become a part of District "PC -5". PLANNED SERVICE COMMERCIAL DISTRICT. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "C-5" SERVICE COMMERCIAL DISTRICT regulations except as set out in this ordinance. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: 11I Permitted uses on this property shall be limited to automobile display and sales plus uses permitted in the C-3 district. Development on this property, including signage, shall be subject to the bulk and use limitations of the C-3 district. The grassy area located east of the building shall not be used for storage or display of vehicles, vehicle parts or other components not allowed in the C-3 district. Development of this property shall be completed in substantial conformance with the approved site plan and associated submittals. Section 3. That all prior ordinances in conflict herewith as they relate to the above real estate are hereby repealed. Section 4.
