An ordinance providing for the construction of certain sewers *
in the city.of Salina Kansas, letting the contract there-
for and providing for the payment of the cost thereof.
WHERFAS, plans and specifications for certain se,,,,,ers
hereinafter described have .been ,made and prepared by the City.
Engineer and have been approved by the Mayo r and Coundil,.and.
WHM.E&S, the estimate of the cost Of said work has been
filed in the office of the City Glerk by the City Engineer of

said City; and
WHEREAS, a bid for the construction of said sewers for said
City has-been made and is now on file with the said C. ity Clerk,
NOW THEREFORE,
BE IT ORDAINED by the Mayor and Council Of the City of Salina:
Council 1. That the Mayor and deem it necessary
and hereby order that the following sewers - be built and construct-
ed and the following manholes and catchbasins be built and con-
structed by the City of Salina, Kansas, to -wit:
l.. 1000 feet of fifteen (15) inch sewer pipe on State
Street in the city of Salina, Kansas, commencing at the inter-
section of Clark Street and State Street thence west to Dry Creek
at and for the price of $1.90 per lineal ;foot forr-thb number of f
feet of such sewer actually built and constructed.- Five (5)
round manholes at and for the price Of Fifty -Two ($52.00) Dollars
ea , dh.. one (1) square manhole with 'trap at and -for the price of
Ninety ($90.00) Dollars. Vrickwork for two catchbasins at and.
for the price of $15.00 each..
.2.' 80 feet of twelve -(12) inch sewer pipe across state
Street at Chicago Street at and for the price of 1.50 per line-
al foot for the number of feet of such sewer actually -built and
constructed. 50 feet of ten (10) inch pipe from the-catchbas'in
on the north side of State Street-tothe catchbasin and manhole
on the south side of State atre*et at and for the price of $0.80,
per 'lineal foot for the number of feet I actu�lly laid and construct-
ed'.'

Section 2. The plans and specifications of the City Engin-
eer of said City of Salina, .Kansas, for.the above described sew-
ers, dated August 4th,. 1919, and now on.file with the City Clerk,
are hereby adopted and approved as and for the plans and specifi-
cations for the construction of the above described sewers and
parts of sewers and such Plans and specifications are hereby made
a part Of this ordinance as fully as if set out at length herein,
and all work and improvements herein specified shall be done in
strict accordance with the said Plans and specifications and un-
der the direction of the Gity Engineer a-foresaid.
Section 3. That a contract be and
is hereby let to C. T.
Snyder for the building and construction of the sewers and parts
of sewers hereinbefore specified at and for the prices hereinbe-
fore specified; such prices to include and cover all labor and
material necessary for the-Properconstruction and completion of

of sewers, all of such sewers and
parts of s I ewers in place I as a part of the sewer system of the City
and as specified in the said plans and specifications for the
construction thereof.
Section 4.1 Said G. T. Snyder shall execute a Written:

tract with said City for the building and construction of said
sewers and parts of sewer's according to the term's of said plans.

Mayor shall direct, conditioned that they will build and complete:
such sewers according to the ordinances of the City; that they
will fulfill the guaranty set out in the above mentioned plans
and specifications; that they will save and hold harmless -the City
of Salina from all damage to persons or property which may arise
by reason of the construction of sewers and parts of sewers or
through the carelessness Or neglect Of such contractor, his ser..!!
vants or employees; and that they will Protect the said
'City from,
and against all liens for labOr-or material used and employed in
the building and, construction of such sewers and parts of sewers.'
Section 5. The cost and expense of -constructing and complet-
ing such sewers and parts of sewers shall be assessed against all
lots and pieces of ground contained in the. City of Salina as a sew-
er distrixt, as provided by Ordinance No. 613- passed and approved
December 23rd, . 1887, and the mayor and Council are hereby author-

ized to provide for the payment therefor by installments in-
stead of levying the entire cost thereof as one special assess-
ment at one time, and for such installments their me.y issue sew-
er Improvement Bonds of the City of Salina, payable in install-
ments of equal amounts each year, none of which bonds nor the
installments thereof shall run longer than ten years nor bear.
interest exceeding five per sent per annum, and such bonds may
be delivered to the contractors constructing such sewers in
payment therefor; or the Wayor and Council may sell such bonds
-at not .less than their par value and pay said contractors out of
the proceeds thereof. For the purpose of paying principal and
interest on such bonds, as they severally become due, the May
or =and Council shall each year during the life of such bonds
levy a tax or special assessment against all taxable real pro-
perty in said 'ity of Salina, at the assessed value thereof for
general revenue purposes, in an amount sufficient to pay the
principal of such bonds for that year, and the City Clerk shall
certify said assessments and special taxes as they are severally
Made and levied as afore -said, to the County Clerk of Saline
County, Kansas, at the same time and in the s ame manner as
other taxes of said City are certified.
Section 64 The said contractors shall properly refill
all excavations made by them in the construction of such sew
ers according to the plans and specifications of the City Engin-
eer aforesaid and shall properly refull such excavations if any
sinking or depression appear therein within a period of one year
after the acceptance of said sewer by said city.
Section 7. This ordinance shall take effect and be in
full force from and after its publication once in the official.

Section 2. The plans and specifications of the City Engineer
of said City of Salida, Lansas, for the above described sewers, dated
August 4th, 1919, and now on.file with the City Clerk, are hereby
adopted and approved as and for the plans and specifications for the
construction of the above described sewers and parts of sewers and
such plans and specifications are hereby made a part of this ordinance
as fully as it set out at length herein, and all work and improvements
herein specified shall be done in strict accordance with the said plans
and specifications and under the direction of the City Engineer
aforesaid.
Section 3.• That a contract be and is hereby let to C. T.
Snyder for the building and construction of the sewers and partsof
sewers hereinbefore specified at and for the prices hereinbefore speci-
fied; such prices to include and cover all labor and material necessary
for the proper construction and completion of all of said sewers and
parts of sewers, all of such sewers and parts of sewers in place as a
part of the sevrer system of the City and as specified in the said
plans and specifications for the construction thereof.
Section 4. Said C. 1. Snyder shall execute a written con-
tract with said City for the building and construction of said sewers
and parts of sewers according to the terms of said plans and specifi-
cations and this ordinance, and shall file with the City Clerk good and
sufficient bonds to said City, in suchamount, not exceeding the total
amount of said contract price, as the Ijayor shall direct, conditioned

that they wi.l build and complete such sewers according to the ordinances
of the City; that they will fulfill the guaranty set out in the above
mentioned plans and- specifications; that they will hold and save harmless
the City of Salina from all -damage to persons or property which may
arise by -reason of the construction of servers and parts of sewers or
through the carelessness or neglect of'such contractor, his servants or
employees; and that they, will protect the said City from and against all
liens for labor or material used and employed in the building and con-
st -ruction of such sewers and parts of sewers.
Section 5. The cost and expense of constructing and completing
such sewers and parts of sewers shall be assessed against all hots and
pieces of ,ground contained in the City of Salina as a sewer distY'ict, as

same time and in the same manner as other taxes of said City are certified.
Section 6. The said contractors shall properly refill all exca-
vations made by them in the construction of such sewers according to the
plans and specifications of the City Engineer aforesaid and shall properly
refill such excavations if any sinking or depression appear therein within
a period of one year after the acceptance of said sewer by said City.
Section 7. This ordinance shall take effect and be in full force
from and after its publication once in the official City paper. y
