2275 Improving Streets1 1 0 i i 355 ORDINANCE 140. 2275 (lublished in The Salina Evening Journal august An ordinance providing for the paving, curbing, guttering, excavat- ing and grading of certain streets in the.citir of Salina, Kansas, specifying the manner of construction, providing for the cost thereof and the manner, of payment and letting the contract therefor. WHERF Z, petitioners have been presented to the Mayor and Council of the City of Salina, Kansas, requesting said Mayor and Council to excavate, grade and pave Fifth Street from the south line of Prescott Avenue to the south . line of Bond `'treet and to curb, gutter, excavate, grade and pave Fifth Street from the south line of Bond Street to the south line of R3public Avenue in said City, and _ WHEn A,S,' s aid petitions have been examined and found to contain the names of a majority of the resident owners of real property liable to taxation and a ssessment therefor, NOW, THERE- FORE, Be it ordained by .the Mayor and Council of the City of Salina: Section 1. That it is necessary and hereby ordered that Fifth Street from the south line of Prescott Avenue to the south line of Bond Street be paved with such material as may be hereinafter de- scribed and designated and that Fifth Street from the south line of Bond Street to the south line of Republic avenue be curbed, guttered and paved with such materias as may be hereinafter d6 - scribed. All of said pavement to be 26 feet in width from gutter to gutter.'All excavating, rolling and filling necessary for the proper construction of such improvements shall be done and such paving shall be laid and constructed on the established grade of said street. Section 2. Said Fifth Street from the south line ,of Bond Street to the south line of Republic Avenue shall be curbed, and guttered with either one piece or two piece curb and gutter as the City Engineer may hereafter designate.. Such curb to be six_ (6) inches in thickness and gutter 24 inches in width arid -the lot line edge of such curbing shall be 15 feet from and parallel with the centet line of said street. All of said street within the limits above defined shall be paved with Texaco Asphaltic Concrete paving material on. a five (5) inch concrete base according to the plans and specifications of the City Engineer made and filed with the City Clerk_ on July 21st, 1919, which said specifications are hereby adopted and approved as and for the specifications for such improve- ments and are hereby made a pari, of this ordinance. Section 3. A contract is hereby let to M. R. Amerman for the paving and excavating of such streets at and for the following prices to -wit: For the paving of such streets with the paving mate r- ial specified herein laid on a five (5) inch concrete base, Two and 30100($2.30) Dollars per square yard. For the excavation of such street as may be necessary the sum of Ninety (90;x) cents per I cubic yard. For the curbing and guttering of said street where necessary, for one-piece curb and gutter One and 20100($1.20) Dollars per lineal foot and for two-piece curb and gutter One and 40/100 01.40) Dollars per lineal foot. The curb and gutt- er to be installed shall be selected by the City Engineer of the City of Salina, Kansaas . All of said prices aref cDund to be less than the estimated prices and cost of such improvements as made by the City Engineer of said City and now on file in the office of the City Clerk. Section 4. After the passage and. publication of this ordinance the Mayor and Cotiulcil shall appoint three disinterest- ed appraisers who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment for the cost of said improvements shall, within ten days after having been notified of their appointment, pro- ceed to appraise said lots and pieces of ground, according to law, and, after making said appraisement, shall return the same to the Mayor and Council at the first meeting thereof after such appraisement shall have been made and completed, and after said appraisement is returned the Mayor and Council shall desig- nate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official City paper; and at such special session the Mayor and Council shall, if they deem it just and proper, alter or change such appraise- ment . Section 5. Such contract is awarded upon the express con- diyion that such work and improvement shall be done in strict accordance with and in compliance with the plans and specifica- tions of the City Engineer of the City of Salina, therefor, hereby making said plans and specifications a part of this ord- inance -and of the contract hereby awarded and upon the further conditions among others, that the said M. R. Amerman shall give to the city of Salina, Kansas, a surety bond in the amount ap- proximating the sum of the cost of such improvements, guarantee- ing uarantee- ing the proper and workmanlike construction of all of such im- provements and guaranteeing such pavement aainst all defects for a period of five (5) years and such curb and Anter for a period of two (2) years from the date of its final completion and acceptance by said City. 1 1 1 i i 1 i - Section 6. For the purpose of paying for the improve- ments in this ordinance specified the Mayor and Council are hereby authorized to issue bonds of the City* of Salina, in an amount not to exceed the cost of such improvements, and to run for a period not to exceed ten years and payable in equal installments each year together with interest not to exceed five per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the pur- pose of paying principal and interest on said bonds as they severally become due and Payable the Nlayor and Council shall by ordinance apportion and assess against the lots and pieces of ground in the taxing district of such improvements special assessments covering the cost of said improvements, and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeabel with the cost of such improvements. Such assess- ment and apportionment ordinance shall contain the total amcurt of tax a ppoet Toned to each tract, piece and parcel of land with- in the taxing district and shall state the number of annual in- stallments in which such tax is to be collected; and thereaftee the City Clerk shall.annually, at the same time other taxes are to be certified, certify to the County Clerk_ of Saline County, Kansas, a full list of all property liable for the cost of such work and improvements together with the respective amounts due on each of such tracts, pieces and parcels of land, which amount shall include the annual installments and the in- terest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, and such amount so certified shall be collected as other taxes are collected. I. That it is necessary and 'hereby ordered that Fifth Street from the South line of Prescott Avenue to the South line of Bond Street be paved with such material as may be hereinafter described and designated and that Fifth Street from the South line of Bond Street to the South line of Republic Avenue be curbed, gattered and paved with such material as may be hereinafter described. R. -Amerman shall give to the City of Salina, Kansas, a surety bond in the amount approximating the sum of the cost of such improve- ments, guaranteeing the proper and workmanlike construction of all of such improvements and guaranteeing such pavement against all defects for a period of five (5) years and such curb and gutter for a period of two (2) years from the date of its final completion and acceptance by said City. Section 6. For the purpose of paying for the improvements in this ordinance specified the idayor and Council are hereby authorized to issue bonds of the City of Salina, in an amount not to exceed the cost of such improvements, and to -run for a period -riot to exceed ten years and payable in equal installments each year together with inter- est not to exceed five per cent per annurii, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the pur- pose of paying principal and interest on said bonds as they severally become due the Iayor and Council shall by ordinance apportion a -rid assess against the lots and pieces of ground in the taxing district of such improvements special assessments covering the cost of said improvements, and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with the cost of such improvements. Such assess - merit and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are to be certified, certify to the County Clerk of Saline County, Kansas, a full list 4. of all property liable for the cost of such work and improvements together with the respective amounts due on each of such tracts, pieces and parcels of land, which amount shall include the annual installments0-a�npd�t'e inte--est on all unpaid balances for one year at the -rate of/Ifive cr cent per annum, and such amount so certified shall be collected as other taxes are collected. Section 7. This ordinance shall take effect and be in full force and effect from and after its publication once in the official City paper.
