2268 Issue Sewer Improvement BondsORDINANCE NO. 2268 (Published in the Salina Evening Journal June 21, 1919) An ordinance providing for the issuance of Sewer Improvement Bonds of the City of Salina, Kansas, in the sum of 6,377.03 WHEREAS, the Mayor and Council of the city of Salina, Kansas, have caused to be built and constructed certain sewers F in said City as provided in Ordinances numbered 2240, 2253 and 2266, the total price of which is in excess of $6,377.03; Now Therefore, BE IT ORDAINED by the Mayor and Councilmen of Salina, Kansas: Section 1. That the cost of such sewers shall be payable in ten (10) annual installments instead of levying the entire taxes for such cost at one time, the first installment of which is to be paid with the taxes for the year 1919 and one install- ment each year thereafter until the whole of such sum is paid, and that for such installments there shall be issued Sewer Im- provement Bonds of the City of Salina in the total sum of 6,377.03 as herein provided. Section 2. Said issue of bonds shall consist of twelve (12) bonds of the denomination of Five Hundred ($500:00) Dollars each and one bond of the denomination of Three Hundred Seventy -Seven and 03-100 (377.03) Dollars. They shall be dated July lst, 1919, and payable as follows: $1..877-03 on the first day of July, 1920, and $500.00 on the first day of Jluy of each year thereafter for a period of nine (9) years. Section 3. Said bonds shall bear interest at the rate of four and three-quarters (4-3/4%) per cent per annum, such inter- est to be payable semi-annually on the first day of January and July of each year. Such bonds shall have interest coupons attached and both bonds and coupons shall be payable at the fiscal agency of the State of Kansas in the city of Topeka, Kansas. Section 4. Said bonds shall be signed by the Mayor and at- tested by the Clerk of the City of Salina, Kansas, and shall have the corpor ate seal of said City attached thereto. Interest cou- pons to said bonds shall be signed by the said Clerk. Section 5. KNOW 4 -,LL MEN BY THESE PRESENTS, That the City of Salina in the County_. of Saline and State of Kansas, for value received, hereby acknowledges itself to be indebted and promises to pay the sum of 0-, in lawful money of the United States of America on. the first day of 1.A _ D.19 _, with interest thereon Td at the rate of four d three-quarters per cent per annum, the first installment of which shall be payable January, first, 1920, and interest payable semi-annually thereafter and on the first day of July and January of each year thereafter the date hereof until the principal sum shall have been paid, upon the presenat- ation and surrender of the proper interest coupon thereto attached bearing the signature of the Clerk of said City, as they severally become due and payable. Both principal and interest are payable at the fiscal agency of the State of Kansas, in the city of Tope- ka, Kansas, and the City of Salina, Kansas, is held and firmly bound and its faith and credit and all real and personal property in said city are hereby pledged for the prompt payment of the prin- cipal and interest of the bond upon their maturity. This bond is one of a series of bonds of like date and tenor issued by said City of Salina, Kansas, to pay'for sewer improve- ments in and for said City under and by the authority of and in compliance with the provisions of the laws of the State of Kansas governing cities of the second class, and in compliance with an ordinance or ordinances duly and legally passed by the mayor and Council of said City on the 17th day of March, 1919, 5th day of May, 1919 and 2nd day of June, 1919. And it is hereby declared and dertified that all acts, con- ditions and things required to be done and to exist precedent to and in the issuance of this bond, have been properly done and per- formed and do exist in regular and due form as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said City, 'including this series of bonds does not exceed any constitutional or statutory limit. On the first day of , 19 , the City of Salina, Kansas, will pay to the bearer $:::r , at the fiscal agency of the State of Kansas, in the city of Topeka, Kansas, the same being six months interest on its Sewer Improvement Bond dated July 1st, 1919. The Mayor and Clerk are hereby. authorized and directed to prepare and execute, as soon as practicable the said bonds herein provided for, therein pledging the credit of the said City for the payment thereof, and when executed.. said bonds shall be by the Mayor and Councilmen sold, for nct less than their par value, and out of the proceeds thereof shall be paid the cost of building and construction the sewers aforesaid; and the Mayor and Council shall make provisions -an- nually for the payment of the principal and interest of said vonds as the same shall become due, by levying an assessment on the property liable therefor.
