2266 Construction of Sewers39 ORDL4ANCE NO. 22 66 Published in the Salina Evening Journal Jule 1919 An ordinance providing for the construction of certain sewers in the city of Salina, Kansas, letting the contract there" for and providing for the payment of the cost of the same. WHEREAS, plans and specifications for certain sewers, here- inafter described, have been made and prepared by the City En- gineer, filed with the City Clerk and adopted by the Mayor and ouncil upon the 19th day of May, 1919; and WHER'EAS, one M. Fl, Amerman for and in consideration of the payment of the sum hereinafter mentioned has agreed to construct the same in accordance with such plans and specifications, Now, Therefore, Be it ordained by the Nlayor and Council of the city of Salina - flection 1. That the Mayor and Council deem it necessary and therefore hereby order that a sewer be built and construct- ed and manholes and catchbasins be built and constructed at and for the price and prices mentioned hereinafter, such sewer to be laid and installed on Smoky Hill Drive and the alley south of Park Place, commencing at the manhole on Smok7T Hill Drive in line.with-the alley east of Oakdale"',venue, thence west to Oakdale Avenue, thence dia,,rdnally across Oakdale Avenue to the alley between "smoky Hill Drive and nark Place,' thence. west in said alley to -Front 6treet. The length of such sewer being approxi- mately seven hundred fifty (750) feet. Catchbasins and manholes to be constructed at the places and in accordance with the plans and specifications of the City Engine'er hereinbefore referred to, which said plans and specifications are hereby made a part of this ordinance as fully as though written out at length here- in. Section 2. the said M. R. Amerman, shall be paid for the d'onstruction and installation of such sewer the sum of One ('$,1.25) and 25/100 Dollars per lineal foot for the actual amount of such sewer laid and constructed. He shall be paid the sum of Forty- six Q46.00) Dollars for each manhole built and constructed. Section 3. The plans and specifications of the said City Engineer of Salina, Kansas, for the sewers abvoe described, dated. April 7th, 1919, and now on file with the City Clerk are hereby adopted and approved as a. -Lid for the plans and specifications for such sewers and are hereby made a part Of this ordinance. All work herein specified and descried shall be done in accordance with the plans and specifications and under the direction of the City En-Uineer. I 11 I 1 1 1 1 C Section 4. The contract is hereby let to 10. K. Amer- man for the building and construction of the sewers, catchbas- ins and manholes heretofore described at and for the prices hereinbefore mentioned. ^section 5. It is hereby found and determined that the prices agreed to be paid for each of said sewers, catchbasins and manholes, is less than the estimated cost of such sewers catchbasins and manholes, and the estimates made by the City Engineer therefor, and now on file with the City Clerk. erection G. The person to whbm sa.id contract is awarded as aforesaid shall execute a written contract with the said City _ for the purpose of building and constructing such sewers, catch - basins and manholes as aforesaid, and shall_ file with the City Clerk a good and sufficient bond in the total sum of said contract conditioned that he will build such sewers according to said specifications; that he will refill the ditches made in the streets and alleys under which such sewers shall be laid and constructed; that he will fulfill the guarantee required in said specifications; and that he will hold and save harmless the City of Salina from all damage to persons and property which may arise throe gh the carelessness or neglect of said contractor or his servants and employees; that he will protect said City from all liens or claims for labor and material used and employed in the building of such sewers. Section 7. The cost and expense of constructing such sew- ers shall be assessed against all lots and pieces of ground cont - tained in the City of Salina as a sewer district, as, provided by Ordinance 1+o . 613, passed and approved December 23rd, 1887, and the Mayor and Council, are hereby authorized to provide for the pay- ment of the cost thereof by installments insetead of levying the entire tax or special assessment at. one time, and for such install- ments nstall-ments they may issue sewer improvement bonds of the City of Salina, payable in installments of equal amounts each year, none of which .bonds nor the installments thereof shall run longer than ten years or bear interest exceeding five per cent per annum, and such bonds may be delivered to the contractor building such sewers in payment thereof or the mayor and Council may sell said bonds at not less than their par value and pay said contractor out of the proceeds thereof, and for the purpose of paying principal and interest on each of said bonds, as they severally become due, the Mayor and M Council shall each year, during the life of said bonds levy an assessment or special tax against all taxable real estate in said City at the assessed value thereof for general revenue pur- pose, in an amount cuff iceint to pay the principal and interest of said bonds for that year; and the City Clerk shall certify said assessments and special taxes as they are severally made and levied as aforesaid, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes of said City are certified. Section B. That said contractor shall properly refill_ all excavations made in the construction of the above described sew- ers according to the plans and specifications of the City Enrin eer therefor and shall properly refill said excavations if any sinking or depression appears therein within a. period of one Near after the acceptance of said sewers by the aforesaid City. It is hereby found and determined that the prices hereby agreed to be paid for each of said sewers, catchbasins,and man- holes, is less than the estimated cost of such sevders, catchbasins and manholes, and the estimates made by the City Engineer therefor, and now on file with the City Clerk. Section 6. The person to whom said contract is awarded as. aforesaid, shall execute a written contract with the said City for the purpose of building and constructing such sewers, catch basins and manholes as aforesaid, and shall file with the City Clerk a good and sufficient bond in the total sum of said contract, conditioned that lie will build such sewers according to said specifications; that ile will refill the ditches made in the streets and alleys under which such sewers shall be laid and constructed; that he will fulfill the guarantee required in said specifications; and that he will hold and save harm- less the City of Salina from all damage to persons and property which may arise through the carelessness or neglect of said contractor or his servants and employees; that he will protect said City from all liens or claims for labor and material used and employed in the build- ing of such sewers. 3. Section 7. The cost and expense of constructing such sewers shall be assessed against all lots and pieces of ground contained in the City of Salina as a sewer district, as provided 'by Ordinance No. 613,passed and approved December 23rd, 1887, and the 1ayor and Council are hereby authorized to provide for the payment of the cost thereof by installments.instead of levying the entire tax or special assess- ments at one time, and for such installments they may issue sewer im- provement bonds of the City of Salina, payable in installments of equal amounts each year, none of wi.ich bonds nor the installments thereof shall run longer then ten years or bear interest exceeding five per cent per annum, and such bonds may be delivered to the contractor building such sewers in payment thereof or the Liayor and Council may sell said 'ponds at not less than their par value and pay said contrac- tor out of the proceeds thereof, and for the purpose of paying prin- cipal and interest•on each of said bonds, as they severally become due, the. Mayor anC Council shall each year, during the life of said bonds, levy an assessment or special tax against all taxable real estate in said City at the assessed value thereof for general revenue purpose, in an amount sufficient to pay the principal and interest of said bonds for that year; and the City Clerk shall certify said assess- ments and special taxes as they are severally made and levied as afore- said, to the County Clerk of Saline County, Fanses, at the. same time and in the same manner as other taxes of said City are certified. Section 8. That said contractor'shall properly refill all excavations made in the construction of the above described sewers according to the plans and specifications of the City Engineer therefor and shall properly refill said excavations if any sinking or depression appears therein within a period of one year after the acceptance of said sewers by the aforesaid City.
