2263 Improving State St1 i 1 1 1 327 ORDIN-61 CE TSO. 2263 ((Published in the Salina Evening Journal June 1919) An ordinance providing for the paving, curbing, Littering and excavating of State Street i'n the city of Salina, Kansas, from the east line of the Missouri Pacific Railroad right of way to the east line of the Dry Creek Bridge, specify- ing, the manner of construction, providing for the cost thereof and the manner of payment and letting the contract therefor. WHEREAS, a petition has been presented to the Mayor and Council requesting the paving, curbing, a.nd. guttering and excava- tion of State Street from the east line of the Missouri Pacific Railroad right of way to -the east line of Ivry Creek Bridge, and WHEREAS, said petition has been examined and found to contain the names of a majority of the resident owners of real property liable to taxation and assessment for said improvements, ZTow, Therefore, BE IT ORDAINED by the Mayor and Council of the City of Salina; Section 1. That it is necess ary and hereby ordered that State Street in the city of Salina, Kansas, from the east line of the 1'4 issouri Pacific aailroa.d right of way to the east line of Dry Creek bridge be paved with asphaltic -concrete paving material, as more specifically hereinafter described, said paving to be 32 feet in width from gutter to gutter. All excavating, rolling and fill- ing necessary for the proper construction of such paving shall be done and such paving shall be laid and constructed on the estab- lished grade of said street. Section 2. It is necessary and hereby ordered that said State Street within the limits hereinbefore defined be curbed on both sides thereof with cement curb and gutter, such curb to be six_ (6) inches in thickness and such gutter to be 24 inches in width and the lot line edge of such curb shall be 1821 feet from and parallel with the center line of said street. Section 3. Such treet shall be paved with Texaco Asphaltic - Concrete paving material on a five (5) inch concrete base, and ac- cording to the plans and slecificati ons for the paving, curbing and guttering of such street adopted and approved by the 'M"ayor and Councilmen on the 2nd day of June, 1919, which said specifications for the improvements herein are hereby adopted and approved as and for the specifications and are hereby made a part of this ordinance . Section 4. A contract is hereby awarded to M. R. Amer- man of Salina, Kansas, for the paving, excavating, curbing and guttering of said State Street within the limits above defined and at and for the following prices, to -wit: For the paving of said street_ with the material specified in the preceding sec- tion, laid on a five (5) inch base, as specified, Two 0;2.30) and 30/100 Dollars per square yard; for the excavating of said street Ninety (900 Cents per cubic yard and for the curbing and guttering of said street, as specified, one 01.20) and 20/100 Dollars per lineal foot. All of such pavement, curb and gutter shall be figured upon the measurements of the City Engineer of the City of Salina, 1'1'ansas, and all such prices are hereby found to be less than the estimated cost of such improvements as made by the City Engineer of said City and now on file with the Cit,\j Clerk. Section 5. After the passage and publication of this ordinance the Mayor and Council shall appoint three disinter- ested appraisers who, after having taken an oath to faithfully and impartially aprraise all lots and pieces of .ground liable to assessment for the cost of said improvements, shall, within ten days after having been notified of their appointment, pro- ceed to appraise said lots and pieces of ground according to law, arid, after making said appraisement,, shall return the same to the Mayor and Council at the first meeting thereof after such ap- praisement shall have been made and completed, and after said appra is ement is returned the P,'Ia y or and Council shall designate. a time for holding a special session for the purpose of Ijear- ing complaints and equalizing said a.pprai Bement, of which spe- cial session due notice shall be given in the official Citi, paper; and at such special session the Tvlayor and Council shall, if they deem it just and proper alter or change such appraisement . Section 6. For the purpose of paying for the improvement'. in this ordinance specified the Mayor and Council are hereby authorized to issue bonds of the city of Salina, in an amount not to exceed ten years and payable in eq_aal installments each year together with interest not to exceed five per cent per annum, which bonds shall be made payable at the fiscal agencir of the IJ State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due the mayor and council shall by ordinance apportion and assess against the 1 F� 1 1 1 1 1 1 1 lots and pieces of ground in the taxing district of such improve- ments covering the cost of said imrpvovements, and the apportion- ment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable ,with the cost of such. improvements . Such assessment and apport- ionment ordinance shall contain the total amount of tax apportion- ed to each tract, piece and parcel of land within the t axing dis- trict and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are to be certified, cer- tify to the County Clerk of Saline COU i-ItAT, Kansas, a. full list of all property liable for the cost of slich work and improvements together with the respective amounts due on each of such tracts, pieces and parcels of land, which amount shall include the annu- al installments and the interest on all unpaid balances for one year at the rate of five �(5 o� ) per cent per annum, and such amount so certified shall be collected as other taxes are collected. Section 7. `Phis ordinance shall take effect and be in full force' from and after its publication once in the official City paper. Passed and approved, June 2nd, 1919. That it is necessary and hereby ordered that State Street in the City of Salina, Kansas, from the East line of the Iaiissouri Pacific Railroad right of way to the East line of Dry Creek- bridge reekbridge be paved withasphaltic-concrete paving material, as mo"r"e spec- ifically hereinafter described, said paving to be u32 feet in width from gutter to gutter. All excavating, rolling and filling necessary for the proper construction of such paving shall be done and such paving shall be laid and constructed on the established grade of said street. Section 2. It is necessary and hereby ordered that said State Street within the limits hereinbefore defined be curbed on both sides thereof with cement curb and guttered GE i.44i me-i:aiti -.� such curb to be six (6) inches in thickness and such gutter to be 24- inches in width and the lot line edge of such curb shall be `18 i feet from and parallel with the center line of said street. 2. Section 3. Such street shall be paved with TexacoAsphaltic Concrete paving material on a five (5) inch concrete base, and accord- ing to the plans and specifications for the paving, curbing and gutter- ing of such street adopted and approved by the Mayor and Cauncilmen on the 2nd day of June, 1919, which said specifications for the improvements herein are hereby adopted and approved as and for the specifications and are hereby made a part of this ordinance. Section 4. A contract is hereby awarded to M. R: Amerman of Salina, Kansas, for the paving, excavating, curbing and guttering of said State Street within the limits above defined and at and for the following prices, to -wit: For the paving of said street with the material specified in the preceding section, laid on a five (5) inch base, as specified, Two ($2.30) and 30100 Dollars per square yard; for the excavating of said street Linety (9011) Cents per cubic yard and for the curbing and guttering of said street, as specified, One ($1.20) and 20/100 Dollars per lineal foot. All of such pavement curb and gutter shall be figui'ed upon the measurements of the City Engineer of the City of Salina, Kansas,�and all such prices are here- by found to be less than the estimated cost of such improvements as made by the City Engineer of said City and now on file with the City Clerk. Section 5. After the passage and publication of this ord- inance the Mayor and Council shall appoint three disinterested app- raisers who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground liable to assessment for the cost of said improvements, shall, within ten days after having been notified of their appointment, proceed to appraise'said lots and pieces of ground, according to law, and, after making said appraise- ment, shall return the same to the Mayor and Council at the first 3. meeting thereof after such appraisement shall have been made and com- pleted, and after said appraisement is returned the Mayor and Council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement,of which spe- cial session due notice shall be given in the official city paper; and at such special session the Idayor and Council shall, if they deem it just and proper, alter or change such appraisement. Section 6. For the purpose of paying for the improvements in this ordinance specified the I.Sayor and Council, are hereby auth- orized to issue bonds of the City of Salina, in an amount not to ex- ceed ten years and payable in equal installments each year together with interest not to .exceed five per cent per annuin, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due the icfayor and Council shall by ordinance appor- tion and assess against the lots and pieces of ground in the taxing district of such improvements special assessments covering the cost of said improvements, and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with the cost of such improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual in- stallments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are to be certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for the cost of such work, and im- provements together with the respective amounts due on each of such tracts, pieces and parcels of land, which amount shall include the 4. annual installments and the interest on all unpaid balances for one year at the rate of five (5%) per cent per artium, and such amount so certified shall be collected as other taxes are collected.
