NHE—RawkS, a petition has been presented to the Mayor and Councilmen requesting the paving, excavating and -grading of State Street from the west line of College Avenue to the eaast line of the Palissour.i -Pacific right of way, and WHEREAS, said petition has been examined and found to contain the names of a majority of the resident oriners of real property liable to taxation and assessment for said im- provements, N&tJ THEi'EFORE, BE I`I' ORDI'tINED by the Mayor and Council of the city of Salina: Section 1. That it is necessary and hereby ordered that State Street from the west line of College Avenue to the east line of the Missouri Pacific Railroad Right of uiay within the City of Salina, Kansas, be paved with Asphaltic -Concrete Paving material, as t-nore particularly hereinafter described, said pavement to be 32 feet in width from gutter to gutter; and all excavating, -rollin and filling necessary for the pro- per construction of such paveing shall be done and such paving e shall be laid and constructed on the established grade of said street. Section 2. Such street shall be paved with Texaco Asphaltic -Concrete paving material, or equally as good, on a five (5) inch concrete base according to the speficications for the paving, excavating, and grading of said street adopt- ed and approved by the Mayor and Counc i 1 on the 2nd day of June, 1919, which said specifications are hereby adopted and approved as and for the plans and specifications for said pav- ing and are hereby made a part of this ordinance. ,Section 3. A contract is hereby let to bpi. R. Amerman of Salina, liansas, for the paving and excavating of said State Street within the limits above defined at and for the follow- ing prices, to -wit: For the paving of said street with the paving material specified in the preceding section, laid on a five (5) inch Concrete Base, as specified, at and for the price of 41,2.30 per square yard and for the excavating of said street the price of Ninety (90/) cents per cubic yard. All of said prices are hereby found to be less than the estimated cost of such improvement as made by the City Engineer of said City and now on file with the City Clerlt. 1 1 1 1 1 1 1 1 1 1 Section 4. After the passage and publication of this ordinance the Mayor arid council shall appoint three disinterest- ed appraisers who, after having taken an oath to faithfully and impartially appraise all lots and .pieces of ground liable to assessment for the cost of said improvements, shall, within ten days after having been notified of their appointment, pro- ceed to appraise said lots and pieces of ground, according to law, and after making. said appraisement, shall return the same to the fl+layor and Council at the first meeting thereof after such appraisement shall have been made and completed, and after said appraismenet is returned tht Mo.yor and council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the of- ficial city paper; and at such special session the Mayor and Council shall, if they deem it just and proper, alter or change such appraisement. Section 5. For the purpose of paying for the improvements in this ordinance specified the Mayor and Council, are hereby authorized to issue bonds of the city of Selina, in an amount not to exceed the cost of such improvements, and to run for a period of not to exceed ten Jears and payable in equal in- stallments each ,year together with interest not to exceed five ,(5%) per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the pur- pose of paying principal and interest on said bonds as they severally become due and outing the Mayor and Council shall by ordinance apportion and assess against the lots and pieces. of ground in the taxing district of such improvements special assessments covering the cost of said improvements, and the ap- portionment p-Portionment therein contained shall hold good for all the in- stallments that are to be collected from the specifid proper- ty chargeable with the cost of such improvements. Such assess- ment and appoirtionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land, within the taxing district and shall state the number of annu- al installments in which such tax is to be collected; and there- after the City Clerk sha -1 annually, at the same time other taxes are to be certified, certify to the County clerk of Saline County, Kansas, a full list of all propertt liable for the cost 325 of such work and improvements together with the respective amounts due on each'of such tracts, pieces and parcels of land, which amount shall include the annual installments and the interest on all unpaid balances for one year at the rate of not to exceed five (5) per cent per annum, and such amount so certified shall be collected as other taxes are collected. Section 7. This ordinance shall take effect and be in full force from and after its publication once in the official city paper. Passed and approved,this 2nd day of June, 1919.
