An ordinance providing for the construction of certain sewers in
the City of Salina, Kansas, Letting the contract therefor
and providing for the payment of the cost thereof.
iHER 'S, plans and specifications for certain sewers here-
inafter described have been made and prepared by the City Engin-
eer and have been approved by the mayor and Council, and
WHEREAS, an estimate of the price of said work has been
filed in the office of the City Clerk by the City Engineer of
said City, and
'JIIEr'ErLS, a bid for the construction of said sewers for
said City has been made and is now on file with the City Clerk
of said City, Now `therefore,
BE IT ORWUNED by the M9yor and Qouncil of the City of Salina:
Section 1. That the Mayor and Council deem it necessary
and hereby order that the following sewers be built and construct-
ed and the following manholes and catchbasins be built and construct-
ed by the City of Salina, Kansas, to -wit:
1. 1000 feet of ten (1) inch sewer pipe on Chicago Street,
South of Elm Street, commencing on Elm'Street east of Chicago
Street thence west to Chicarro, thence south near the center of
Chicago Street to Ash Street, at and for the price of $1.15 per
lineal foot for the number of feet of such sewer actually built
and constructed. Four (4) manholes .at and for the price of $42.50
each.
2. 200 feet of ten (10) krich seiner pipe on Gypsum Avenue
commencing at Oakdale -`venue thence west about 200 feet, at and
for the price of 11.25 per lineal foot for the number of feet
actually built and constructed. One (1) manhole at and for the

price, with trap included, of 1P'�t48.00
3. 230 fet of ten (10) inch sewer pipe on Perin Avenue, com-
mericing at

alley south
of

to the

at
and for the
price of $1.25

constructed. One (1) manhole with trap at and for the price of

4. Three (3) manholes on Phillips Street. one being at
the alley south of N alnut Street, one at the alley south of Cedar
Street and one near the alley south of Spruce Street, at and
for the price of X46.00 each.
5. 400 feet of ten (10) inch sewer pipe at stubs laid
across Phillips Street, at and for the price of $1.35 per lineal
foot for the number of feet of such sewer actually built and
constructed. Five (5) manholes at and for the price of $45.00
each.
6. 525 feet of ten . (1) inch sewer pipe in the alley be-
tween fiirti+yin I-ivenue and C laf lin Avenue from the east line of
Santa Fe avenue east to Fourth Street, at and for the price of
X1.25 per lineal foot for the number of feet of such sewer actu-
ally built and constructed. Two (2) manholes at and for the
price of X45.00 each.
7. Twenty (20) catchbasins will be put at locations speci-
fied by the City Engineer and the brick work therefor will be
built and constructed at and for the price of 615.00 each. Cast
Iron lops for Ccatchbasins in place will be furnished at and for
the hprice of$''15.00 each. Ten (10) inch pipe from manhole to
catchbasins will be furnished and constructed at and for the price
of 80 per lineal foot for the number of feet actually laid and
construe"tedl. Eight (8) inch pipe from manhole to catchbasin will
be furnished and constructed at and for the price of 65/, per line-
al foot for the number of feet actually built and constructed.
Section 2. The plans and specifications of the. City Engin-
eer of the City of Salina, Kansas, for the above described sewers,
dated April 7th, 1919, and now ori file with the City Clerk, are
hereby adopted and approved as and for the plans and specifications
for the construction of the above described sewers and parts of
sewer's and such plans and specifications are hereby made a part
of this ordinance as fully as if set out at length herein, and all
work and improvements herein specifide shall be done in strict
accordinance with the said plans and speficications and under the
direction of the City Engineer aforesaid.
Section 3. That a contract be and -is hereby let to 10. R.
Amerman for the building and construction of the sewers and parts
of sewers hereinbefore specified at and for the prices herein-
before specified; such prices to include and cover all labor and
material necessary for the proper construction and completion
of all of said sewers and parts of sewers, all of such sewers
and parts of sewers in place as a part of the sever system of
the City and as specified in the said plans and specifications '
for the construction thereof.
Section 4. Said 1VI. R.. Amerman shall execute a written
contract with said Glity for the building and construction of
said sewers and parts of sewers according to the terms of said
plans and specifications and this ordinance, and shall file
with the City Clerk good and sufficient bonds to said City in
such amount, not exceeding the total -amount of said contract
price, as the Mayor shall direct, conditioned that they will
build and complete such sewers according; to the said plans and
specifications; that they will properly refill the ditches made.
by them for the construction of such sewers according to the
ordinances of the City; that they will fulfill the guaranty set
out in the above mentioned plans aid specifications; that they
will hold and save harmless the City of Salina from all damage
to persons'or property which may arise by reason of the construc-
tion of sewers and parts of sewers or through the carelessness
or neglect of such contractor, his servants or employees; and
that they will protect the said City from and against all lie.ns
for labor or material'used and employed in the building and con-
struction of such sewers and parts of sewers.
Section 5. The cost and expense of constructing and com-
pleting
such
sewers
and
parts
of sewers
shall
be
assessed
against
all lots
and
pieces
of
ground
contained
in the
G-Ity
of Salina
as a sewer district, :as provided by Ordinance No. 613, passed
and approved December 23rd, 1887, and the Mayor and Council are
hereby authorized to provide for the payment therefor by install-
ments
nstallments instead of levying the entire cost thereof as one special
assessment at one time and for such installments they may issue
sewer improvement bonds of the City of Salina, payable in install-
ments of equal amounts seach year, none of which bonds nbr the
installments thereof shall run longer than ten years nor bear
interest exceeding five per cent per annum, and such bonds may be

delivered to the contractors constructing such sewers in payment
therefor; or the Mayor and council may sell such bonds at not
less than their par value and pay said contractors out of the
proceeds thereof. For the purpose of paying principal and in-
terzst on such bonds, as they severally become due, the Malror and
Council shall each year during the life of such bonds levy a tax
or special assessment against all taxable real property in said
Cityof Shcina, at the assessed value thereof for general revenue
purposes, in an amount sufficient to pay the principal of such
_bonds for that year, and the City Clerk shall certify said assess-
ments and special taxes as they are severally made and levied as a
aforesaid, to the County Clerk of Saline County, Kansas, at the
same time and in the same manner as other taxes of said City are
certified.
Section 6. The said contractors shall properly refill all
excavations made by them in the construction of such sewers accord-
ing to the plans and specifications of the City Engineer aforesaid
and shall properly refull such excavations if any sinking or de-
pression appear therein within a period of one year after the ac-
ceptance of said sewers by. said City.
Section 7. This ordinance shall take effeft and be in full
force from and after its publication once in the official City
paper`.

An Ordinance providing for the construction of certain servers in the
City of Salina, Kansas, letting the contract therefor and pro-
viding for the payment of the cost thereof.
WHEREAS, plans and specifications for certain sewers herein-
after described have been made and prepared by the City Engineer and
have been approved by the mayor and Council, and
WHEREAS, an estimate of the price of said work has been
filed in the office of'the City Clerk by the City Engineer of said
City, and
WHEREAS, a bid for the construction of said sewers for said
City has been made and is now on file with the City Clark of said City,
NOW THEREFORE,

commencing at manhole at the alley South of Penn Avenue, .thence
North to the Vorth side of Penn Avenue, at and for the price of
$1.25 per lineal foot for the number of feet of such sewer actually
built and constrLtzcted. One (1),manhole with trap at and. for the
price of X50.00.
4. Three (3) manholes on Phillips Street. One being at
the alley South of Walnut Street, one at the alley South of Cedar
Street and one near the alley South of Spruce Street, at and for
the price of X46.00 each.
5. 400 feet of ten (10) inch sewer pipe a stabs laid
across Phillips Street, at and for the price of $1.35 per lineal
foot for the number of feet of such sewer actually built and con-
structed. .Five (5) manholes at and for the price of ?45.00 each.
6. 525 feet of ten (10) inch sewer pipe in the alley.

feet actually built and constructed.

Section 2. The plans and specifications of the City
Engineer of said City,?f Salina, Kansas, for the above described

total amount of said contract price, as the lliayor shall direct, con-
ditioned that they will build and complete such sewers according to the
said plans and specifications; that they will properly refill the dit-
ches made by them for the construction of such sewers according to the
ordinances of the City; that they will fulfill the guaranty set out in
the above mentioned plans and specifications; that they will hold and

pleting such sewers and parts of sewers shall be assessed against all
lots and pieces of ground contained in the City of Salina as a sewer

ember 23rd, 1687, and the Mayor and Council are hereby authorized to
provide for the payment therefor by installments instead of levying
the entire cost thereof as one special assessment at one time, and
for such installments they may issue sewer improvement bonds of the
City of Salina, payable in installments of equal amounts each year,
none of which bonds nor the installments thereof shall run longer than
ten years nor bear interest exceeding five per cent per annum, and
such bonds may be delivered to the contractors constructing such sewers
in payment therefor; or the Mayor and Council may sell such bonds at
not 'Less then their par value and pay said contractors out of the pro-
ceeds thereof. For the purpose of paying principal and interest on
such bonds, as they severally become due, the Mayor and Council shall
each year during the life of such bonds levy a tax or special assess-
ment against all taxable real property in said City of Salina, at the
