An Ordinance providing for the issuance of Improvement Bonds
of the City of Salina, Kansas in the sum of $13P776.29
to pay the cost of improving certain streets in said
City.
WHEREAS, in pursuance of proceedings duly had according
to law, contracts have been let and performed for the:
Curbing, guttering, excavating, grading and
surfacing with sand clay Jewell Avenue in the
City of balina, Kansas from the east line of
Santa Fe venue to the west line of Osborne Street
in said City;
Curbing and guttering Baker Street in the
City of Salina, Kansas from the south line of
South Street to the north line of Morrison Avenue
in said City;
Curbing and guttering Phillips Street in
the City of Salina, Kansas, from the south line
of Washington Avenue to the north line of Mor-
rison Avenue in said City;
Curbing and guttering -Washington Avenue in
the City of Jalina, Kansas from the west line of
Eleventh Street to the east line of Phillips
Street;
Curbing and guttering Twelfth Street in
the City of Salina, Kansas from the south line
of %shington Avenue to the north line of Prescott
Avenue in said City;
Curbing and guttering Prescott Avenue in
the City of Oalina, Kansas from the west line of
Eleventh Street to the east line of Twelfth Street
in said City;
Curbing, ring, excavating, grading
and payixig Th3[�th Street in the City of
Salina, Kansas from the south line of Ash Street
to the north line of State Street in said City;
Curbing and guttering Third Street in the
City of Salina, Kansas from the south line of
Iron Avenue, thence south to the Smoky Hill Riv-
er in said City;
Excavating and grading and surfacing with;
sand clay Prescott Avenue in the City of Salina,
Kansas from the west line of Eleventh Street to
the east line of Twelfth Street in said City3 and

WHEREAS, the total cost of said improvements has been
ascertained and the portion thereof to be paid by a general
tax to be levied upon all of the taxable property within
said City for the improvement of squares and areas formed
by the crossing of streets and alleys for which bonds are
to be issued as herein after provided, has been ascertained
nad is hereby determined and found to be the sum of
$2,450.28, and;
WHEREAS, the portion thereof to be paid by special
assessments levied upon the lots and pieces of ground
liable therefor has been ascertained and is hereby found
and determined to be the sum of k2,059.00, which said
last amount has been heretofore duly assessed and appor-
tioned to the several lots and pieces of ground on such
streets liable therefor, payable in ten equal installments
according to law and as provided in ordinances of the City
of `'alina, Kansas duly passed and approved, and;
WHEREAS, the amount of said special assessments for
which bonds are to be issued as herein provided in antici-
pation of said special assessments which remain unpaid has
been ascertained and is hereby determined and found to
be the sum of 11,326.01, the difference between said last
two named amounts having been paid by the property owners
of said above named streets whose property has been dis-
charged from any further assessments for the cost of
said improvements in the amount so paid, NOW THEREFORE,
BE IT ORDAINED by the Board of Commissioners of the City
of Salina, Kansas:

Section 1. That the cost of such improvements, after
deducting therefrom the assessments heretofore paid thereon
as aforesaid, including the cost of the improvements of
the squares and areas formed by the crossing of streets
and alleys and of City property, shall be paid in ten

substantially equal annual installments instead of levying the
entire cost at one time; the first installment of which is
to be paid with the taxes for the year 1926 and one install-
ment with the taxes for each succeeding year thereof until
the whole amount thereof shall have been paid and that for such
improvements there shall be and are hereby issued Improvement
Bonds of the City of Salina, Kansas in the aggregate sum of
$139776.29.
Section 2. Said issue of bonds shall consist of twenty
(20) bonds all bear"ing interest at the rate of Four and Three-
quarters per cent (4-3A%) per annum, interest payable semi-
annually on the 1st days of November and May of each year after
the date of said bonds; except that the first interest payment
as hereinafter described shall be due and payable on the 1st
day of November 1926, and thereafter all interest shall be
payable semi-annually as above provided for. All of said bonds
shall be dated November 1st, 1925:
Said bonds shall be numbered, the amount due each year
and the dates of maturity of said bonds shall be as follows:

Section 3. Said bonds shall be signed by the Mayor and
attested by the Clerk of the City of Galina. Kansas and shall
have the corporate seal of said City attached thereto. Interest
coupons to said bonds shall be signed by the lithographed sig-
natures of said Mayor and Clerk and both bonds and coupons
shall be paid at the fiscal agency of the State of Kansas in
the City of Topeka, Kansas.
Section 4. Said bonds shall be executed in the form
and shall contain recitals substantially as follows:

INTERNAL—IMPROVEMENT—BOND
KNOW ALL MEN BY THESE PRESENTS: That the City of Salina,
in the County of Saline, State of Kansas, for value received
hereby acknowledges itself to be indebted and promises to pay
the bearer the sum of
in lawful money of the United States of America on the first
day of November 19 , with interest thereon from the date
hereof at the rate, of four and three-quarters per cent (4-3/4%)
per cent per annum, payable semi-annually on the first days
of May and November of each year after the date hereof until
the said prinicpal sum shall have been paid, (except that the
first interest coupons shall become due on November let, 1926)
upon presentation and surrender of the interest coupons hereto
attached, bearing the lithographed signatures of the Mayor and
City Clerk of said City, as said coupons severally become due;
both principal and interest of this bond being payable at the
office of the State treasurer in the City of Topeka, Kansas.
And said City of .Salina in the State of Kansas is held and
firmly bound by these presents, and the full faith, credit and
resources of said City are hereby .irrevocably pledged for the
prompt payment of said principal and interest at maturity.
THIS BOND is one of a series of 20 bonds of like date
and tenor, except -denomination and maturity, aggregating -the
principal sum of 13,776.29 issued by the City of Salina, Kansas
.for the purpose of paying the cost of improving certain streets
in said City by the authority of and in full compliance with
the provisions, restrictions and limitations of the Constitu-
tion and Laws of the State of Kansas, including Sections 10-101
to 10-115 and Sections 12-601 to 12=610 and Section 13=1011 of
the Revised Statutes of Kansas 1923, and all other provisions of
the laws of said State applicable thereto and this bond and
all other bonds of said series and all interest thereon are to
be paid by said City of Salina, Kansas.

AND IT IS HEREBY DECLARED AND CERTIFIED, that all acts,
conditions and things required to be done and to exist precedent
to and in the issuance of this bond, have been done and performed
and do exist in due and regular form and manner and that the
total indebtedness of said City, including this series of
bonds does not exceed any constitutional or statutory limi-
tation.
IN FATNESS WHEREOF, the said City of Salina in the State
of Kansas by its Board of Commissioners has caused this bond
to be Aigned by its Mayor and its corporate seal to be hereto
affixed, attested by its City Clerk, and the coupons hereto
attached to be 09ned with the lithographed signatures of said
officers and this bond to be dated this first day of November
1925.

Section 5. The first interest coupon to be attached to
bonds 1 to 2J inclusive, which mature November 1st, 1926, shall

Jection 6. The Major and City Clerk are hereby authorized,
directed and empowered without unnecessary delay, to prepare
and execute said bonds, and coupons as in this ordinance provided
aY4 when executed, said bonds shall be registered with the City
Clerk of the City of Salina, Kansas and with the Auditor of the
State of Kansas as required by law, and shall be by the Mayor
of said City delivered to the contractor or contractors construct-
ing ;`':`;: such improvements inproportion to the amounts due such
contractor or contractors in payment of the amount due them for
such work and improvements; PROVIDED, however that such bonds
shall not be sold or delivered to such contractor or contractors
at less than par value thereof nor in a greater sum or amount
than the whole amount due to said contractor or contractors under
their respective contracts with said City, or the Board of
Commissioners may,sell said bonds at not less than their par
value and out of the proceeds thereof pay said contractor or
contractors for said work and improvements.
Section 7. Said Board of Commissioners shall make pro-
visions for the payment of the principal and interest on said
bonds as the same becomes due and payable by levying a tax on
the property liable therefor.
Section 8. This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper.
