ORDINANCE NUMBER 94-9640
AN ORDINANCE AMENDING CHAPTER 5, ARTICLE IV, DIVISION 2,
SECTION 5-143 OF THE SALINA CODE REGARDING THE TRANSFERABILITY OF
A CLUB OR DRINKING ESTABLISHMENT LICENSE AND REPEALING THE
EXISTING SECTION.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That Section 5-143 of the Salina Code is hereby
amended to read as follows:
"Section 5-143. Transferability.
A club or drinking establishment license issued under
this chapter shall be transferable only if the following
conditions are met:
(1) Ownership. The ownership must
not have transferred from one
person to another or to any firm,
partnership or corporation,
containing members not included in
the membership of the original
applicant; and
(2) Name. The name of the business
must remain the same, with no
additions or deletions; and
(3) Location. The new location meets
current zoning requirements.
If one or more of the conditions are not met, the
applicant must apply for a new license and pay the
applicable fee.
Section 2. That the existing Section 5-143 of the Salina Code is
hereby repealed.
Section 3. That this ordinance shall be in full force and take
effect from and after its adoption and publication once in the official city
newspaper.
