BACKGROUND: The subject property was acquired as right-of-way for the North Ohio Overpass project to allow the overpass to be built west of the existing Ohio Street alignment, to allow Pacific Avenue to be realigned to intersect with Ohio Street north of the overpass and to provide a location for a stormwater detention pond. This property is all owned by the City of Salina but was outside the ci ty limits when it was acquired. Staff put off annexation with the hope of coordinating the annexation with annexation and platting of the Beverly Trust property located at the northwest corner of Ohio and Pacific. Since those plans did not more forward, staff is recommending annexation of the Cit y owned portion now to establish City jurisdiction over t he entire project area for access control, traffic control and law enforcement purposes. Staff would anticipate the platting or replatting of property around the overpass as a future action item relating to this project. NATURE OF REQUEST: This would be a City initiated unilateral annexation of City owned property. Under K.S.A. 12-520 (a) (2), a city may unilaterally annex land if “the land is owned or held in trust for the city or an agency” because the City as owner is consenting to the annexation thereof. Therefore, the City has the statutory authority to annex this property. No resolution, notice or public hearing is required for this type of annexation. RECOMMENDED ACTION: This annexation would bring the subject property under the City’s control and jurisdiction for overseeing maintenance, access control, traffic control and law enforcement on these portions of Ohio Street and Pacific Avenue. Therefore staff would recommend approval of the attached annexation ordinance on first reading.
