AGENDA SECTION: ORIGINATING DEPARTMENT: APPROVED FOR NO. 8 AGENDA: PLANNING ITEM NO. 1, la, lb BY: Dean Andrew BY:.~ Item: First reading Ordinance Number 00-10017, providing for the annexation of certain land in Section 29, Township 14 South, Range 2 West of the Sixth Principal Meridian in Saline County, Kansas; and repealing Ordinance Number 00-10002. ~lackground: On November 6, 2000, Ordinance Number 00-10002 was passed on second reading. This ordinance annexed a one hundred ninety-eight (198) acre tract of land at the northeast comer of Magnolia Road and Markley Road. The legal description in the annexation ordinance inadvertently included the North half of Magnolia Road and the East half of Markley Road in the annexation description. It was the City's intent to leave both of these roadways in the county until the City had annexed properties on both sides of the road. A portion of Markley Road adjacent to Valley View Estates where we have annexed property on both sides of the road has been included in the corrected legal description. The error now needs to be corrected by adopting the correct legal description for the area and repealing the previous annexation ordinance. Recommendation: Because this was a technical oversight and this ordinance is included in the Corporate Limit Resolution to be passed at the last meeting of the year, staff would recommend that the Commission declare an emergency and adopt the corrected ordinance on second reading at this meeting as well. This would expedite the annexation process for this tract. Approve Ordinance Number 00-10017 on first reading. Declare an emergency exists for second reading on the same day. Adopt Ordinance Number 00-10017 on second reading.
