APPROVED FOR AGENDA: BACKGROUND: This petition was submitted on October 30, 2000 by Mr. Richard E. Brown, President of Smoky Hill Inc., requesting vacation of a portion of the platted drainage easement in Lot 3, Block 1, Schilling Subdivision No. 7. The shop facilities for Smoky Hill L.L.C. are located on this property. A sketch of this property's location has been attached for your review. The east portion of the lot contains a platted drainage easement. A sketch of the lot has also been attached. The drainage easement serves a well-defined channel which drains most of the Airport Industrial Area north into the Dry Creek Channel system. The purpose of this request is to allow more developable area for the Smoky Hill L.L.C. facility. City staff has been working closely with Smoky Hill, L.L.C. over the last two years regarding the redesign and realignment of this major drainage channel. Smoky Hill L.L.C. recently completed major improvements to the channel, at their own cost, including realignment and installation of a concrete rip-rap lining. The realigned channel is located in the portion of the drainage easement to be retained. Photos of the before/after conditions in this drainage channel are attached. This improvement, which was initiated, financed and implemented by Smoky Hill, L.L.C., may become the model for future improvements to the Dry Creek Channel. Smoky Hill, L.L.C. should be commended for their outstanding work on this project. None of the utility companies are affected by this request. RECOMMENDATION: It is recommended that the City Commission approve the ordinance vacation a portion of the platted drainage easement in Lot 3, Block 1, Schilling Subdivision No. 7. SUBSTITUTION of the drainage easemem described in Attachment B. Attachments C-1 and C-2 describe the net vacated area when comparing the original easement with the new, proposed easement. Attachment C-3 is a drawing of both the old and new drainage. A Narrative Description of the change and the rea-mn therefore is attached as Attachment D. T.,.,.0.e .,.-,,,.r,- ADDRESS ATTACHMENT D CONCERNING REQUESTED VACATION OF DRAINAGE EASEMENT LOT 3, BLOCK 1, Schilling Subdivision No. 7 Property is owned by Smoky Hill, Inc. Property is used by Smoky Hill, L.L.C. This property is a long, narrow tract located between the large storage tanks east of Centennial and the Railroad Track. The original drainage channel entered the south end of the property at the approximate midpoint of the south property line, and then wandered somewhat east as it went north to Magnolia Road. It effectively reduced the usable space to 2/3 of the total available. In order to rectify this situation, Smoky Hill constructed a new drainage channel along the east property line and lined it with concrete riprap. The old drainage channel was filled in with dirt from the new channel. The result is that all the useable property is now on the same side of the drainage channel. The purpose of this Request to Vacate is to reflect the relocation of the drainage channel, and make the previously unusable land available for appropriate uses. SUBtX~TTED BY: Richard E.
