GRANT OF PERMANENT UTILITY EASEMENT
David A. Tillberg and Karla K. Tillberg, husband and wife and Michael P. Murray and
Cheryl T. Murray, husband and wife, (the "Grantors"), being the owners of the hereinafter
described real estate, do hereby give, grant, dedicate, and convey unto the City of Salina,
Kansas, a municipal corporation, (the "Grantee")
A Permanent Utility Easement, in perpetuity, on the real estate legally described on
the attached and incorporated Exhibit A and on the attached and incorporated Exhibit
B for the purposes of locating, constructing, excavating, and maintaining poles, wires,
conduit, pipeline, and junction boxes for the purposes of conducting, transmitting, and
distributing water, sewage, electricity, gas and electronic communications by the City,
its franchisees, and its licensees.
Grantors acknowledge that this Grant of Permanent Utility Easement shall
neither alter nor affect the Grantors obligation to maintain the described real estate.
Grantors hereby covenant that they are the lawful owners of the described
premises and have the right, power, and authority to convey the rights granted hereby.

Utility Easement Description
A tract ofland for use as a utility easement located in Block Four (4) of the River Trail
Addition in the City of Salina, Saline County, Kansas, more particularly described as
follows:
Commencing at the Southwest comer of Lot Twenty-five (25) of said Block Four (4);
Thence on the platted bearing of North 00012'04" West along the West line of said Lot
Twenty-five (25) for a distance of Twenty and Zero hundredths (20.00) feet to the North
line of an existing Twenty (20) foot wide utility and drainage easement, said point being
the Point of Beginning;
From the Point of Beginning, thence South 89019' 19" West along the North line of said
existing Twenty (20) foot wide utility and drainage easement for a distance of Ten and
Zero hundredths (10.00) feet;
Thence North 00012'04" West along a line Ten (10) feet West of and parallel with said
West line of Lot Twenty-five (25) for a distance of One hundred Thirty and Thirty-three
hundredths (130.33) feet to a point on the South line of Eaglecrest Avenue;
Thence along said South line on a curve to the Left having a radius of Two hundred
Twenty-five and Zero hundredths (225.00) feet, an arc length of Twenty and Twelve
hundredths (20.12) feet, and a chord bearing North 83040'27" East for a distance of
Twenty and Twelve hundredths (20.12) feet;
Thence South 00012' 04" East along a line Ten (10) feet East of and parallel with said West
line of Lot Twenty-five for a distance of One hundred Thirty-two and Thirty-one
