Background
On July 6, 1992, the City Commission approved a three-party agreement for
construction engineering services in the amount of $205,580 with Bucher, Willis
& Ratliff and the Kansas Department of Transportation (KDOT) for the Schilling
Road/I-135 Interchange Project. The attached supplemental agreement amends that
original agreement by increasing the total construction engineering working days
by over 193 days and the upper limit of compensation to $286,243.
As you know, the project began construction in August, 1992 and was
substantially complete in December, 1993. The project was plagued with bad
weather which lead to numerous time extensions and project change orders. The
local share of the original construction engineering agreement was 40 percent of
$205,580 or $82,232. If this supplemental agreement is approved, the local
share will increase by $32,265.20.
RECOMMENDATION
It is recommended that the City Commission approve the supplemental agreement
for Project No. 135-85K-3707-01 for construction engineering services on the
Schilling Road/I-135 Interchange.

SUPPLEMENTAL AGREEMENT
THIS AGREEMENT entered into this day of ,
19 , by and between the city of Salina, hereinafter referred to as
the "LPA" (Local Public Authority) or "Governmental Entity", as
principal, and the consulting engineering firm of Bucher, Willis &
Ratliff, hereinafter called the "Consultant", and the Secretary of
Transportation of the State of Kansas acting by and through the
Kansas Department of Transportation, hereinafter referred to as the
"Secretary".
WITNESSETH:
WHEREAS, The LPA, the Consultant and the Secretary entered
into an agreement dated July 20, 1992, hereinafter referred to as
"Original Agreement" for the Construction Engineering Services on
this project, and
WHEREAS, the Consultant had to provide additional inspection
services for one hundred ninety-three (193) days when inspection
was required but no working days were charged, for three (3) days
when inspection was directed by the Secretary and for forty-seven
(47) days to check traffic control, and
WHEREAS, the Consultant, because of these additional costs,
proposes to increase the upper limit.
NOW, THEREFORE, in consideration of the covenants of the
parties and to give this agreement full force and effect in
providing the benefits hereinbelow mentioned, the parties hereto
mutually agree as follows:
1. Section III(A) of the Specific Construction Provisions of
the Special Attachment No. 1 of the Original Agreement is null and
void, and is replaced by the following:
Compensation for services provided by the Consultant under the
terms of the Agreement shall be made on the basis of the
reimbursable Consultant's actual cost plus a net fee amount of
$25,667.00. The actual cost shall be incurred in conformity
with the cost principles established in the Federal-aid Policy
Guide and Title 48 Code of Federal Regulations (CFR) Chapter
1, Part 31 et seq. The upper limit of compensation for
services detailed in the Agreement shall be $286,243.00.

2. It is mutually agreed that all terms, provisions,
conditions and covenants of the Original Agreement shall remain in
full force and effect and shall apply fully to the project except
as herein modified and amended.
3. It is further understood that this agreement and all
contracts entered into under the provisions of this agreement shall
be binding upon the LPA, the Consultant and the Secretary and their
successors in office.
IN WITNESS WHEREOF the parties hereto have caused this
agreement to be signed by their duly authorized officers on the day
and year first above written.
