POPE, Chief Engineer-Director (913) 296-3717 Respond to: 913/296-2933 FAX: (913) 296-1176 February 25, 1992 THE HONORABLE STEPHEN C RYAN MAYOR CITY OF SALINA PO BOX 736 SALINA KS 67402-0736 Dear Mayor Ryan: On February 21, 1992, the Chief Engineer, Division of Water Resources, State Board of Agriculture acting under terms of K.S.A. 12-766, and administrative regulations adopted pursuant thereto (K.A.R. 5-44-1 through -6) has approved 3 of the 4 floodplain zoning ordinances submitted by Mr. Roy Dukark, Director of Planning and Community Development on behalf of the City of Salina. An approved copy of these regulations is returned for your files and one copy is retained in files of this agency. It is understood that these floodplain management regulations were enacted as Numbers 87-9184, 87-9185, and 87-9186 adopted on May 11, 1987. Ordinance Number 86-9146 was not approved because the two Kansas Statutes, K.S.A. 12-715 and K.S.A. 12-734, have been repealed. It is recommended that a new ordinance be drafted to replace Ordinance Number 86- 9146. Because this was received by the Chief Engineer prior to January 1, 1992, it is approved under statutory standards in effect at that time (K.S.A. 12-734 and 735 now repealed). Please be advised that any future amendments or changes to your community's floodplain management regulations are subject to the current statutes and administrative regulations cited above. In particular, the standards specified in K.A.R. 5-44-4 required that the lowest floor (including basement) of any permitted structure be one (l) foot above the base flood (lOO-year) elevation. Exceptions made by FEMA for basements will be accepted by DWR in consideration of ordinance approvals. A copy of the new state administrative requlations is enclosed. This ordinance adopts by reference the Flood Hazard Boundary Map or Flood Insurance Rate Map published by the Federal Emergency Management Agency. The map and any applicable supporting materials are available in this office and will be the reference used in a technical review of any proposed changes to these approved regulations.
