Re: Letter of Understanding - Provision of Interim Prosecutorial Work for City of Salina
Dear Ellen:
Thank you for offering to provide your services to the Salina Municipal Court. We truly appreciate your
assistance and are confident that services provided to the City Prosecutor's Office will be of the highest
quality. This letter of understanding is intended to provide a basic summary of our interim work
arrangement in order to ensure that all parties are clear regarding their responsibilities, as follows:
. Attorney agrees to provide services to the City Prosecutor's Office at the Attorney's option and
upon request by the Municipal Court.
. Primary services are to include the prosecution of Municipal Court appeal cases and charge-out of
offenses, but may include other services as requested and agreed upon. For services requested
which require the delegation of the City's sovereign authority, such authority shall be considered as
granted.
. All services shall be billed at a rate of $50 per hour.
. Both parties expressly understand that the Attorney, in performing the services under this
Agreement does so as an independent contractor. The City shall neither have nor exercise any
control or direction over the methods by which the Attorney performs services hereunder. The sole
interest and responsibility of the City is to see that the services covered by this Agreement are
performed and rendered in a competent, efficient, and satisfactory manner. The Attorney shall be
exclusively responsible for all taxes and other legally required State or Federal withholdings and
reporting.
I hope this letter provides clear guidance. Please feel free to contact the Municipal Court for questions
regarding logistics or regarding this letter of understanding. Thank you once again for assisting the
City. Your help is very much appreciated.
