First Reading Ordinance Number 95-9716, providing for the annexation of certain
land in Section 17, Township 14 South, Range 2 West, and repealing Ordinance
Number 91-9483.
Background:
On July 6., 1992, Ordinance Number 91-9483 was passed on Second Reading. This
ordinance annexed a tract of land in the Pheasant Ridge Addition. The legal
description in the annexation ordinance used Lots and Blocks to describe the
addition which did not include streets and right-of-ways in the addition. This
error needs to be corrected by adopting the legal description using Metes and
Bounds for the entire addition and repealing the previous annexation ordinance.
Recommendation:
Adopt Ordinance Number 95-9716 on first reading. Because this was a techicai
oversight, staff would recommend that the City Commission declare an emergency
and adopt the correcting ordinance on second reading at this meeting as well.

AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN
LAND IN SECTION SEVENTEEN (17), TOWNSHIP FOURTEEN (14) SOUTH,
RANGE TWO (2) WEST, IN CONFORMITY WITH THE PROVISIONS OF K.S.A.
12=519 to 12=526, INCLUSIVE; AND REPEALING ORDINANCE NUMBER 91=9483.
BE IT ORDAINED by the Governing Body of the City of Salina,
Kansas:
Section 1. That the following described land, to-wit:
A tract of land being part of the West nine hundred thirty
feet (930.00') of the South six hundred ten feet (610') of
the South Half of the Southeast Quarter of the Southeast
Quarter (S1/2 SE/4 SE/4) of Section Seventeen (17),
Township Fourteen (14) South, Range Two (2) West of the
Sixth Principal Meridian, in Saline County, Kansas, more
particularly described as follows:
Beginning at the southwest corner of the Southeast
Quarter of the Southeast Quarter (SE/4 SE/4) of said
Section Seventeen (17);
Thence North zero degrees one minute forty-five seconds
West (N.00°01'45"W.) a distance of six hundred ten (610)
feet;
Thence North eighty-nine degrees twenty-two minutes
twenty-seven seconds East (N.89°22'27"E.) a distance of
four hundred sixty (460) feet;
Thence South zero degrees one minute forty-five seconds
East (S.00°01'45"E.) a distance of one hundred forty-five
(145) feet;
Thence North eighty-nine degrees twenty-two minutes
twenty-seven seconds East (N.89°22'27"E.) a distance of
four hundred seventy (470) feet;
Thence South zero degrees one minute forty-five seconds
East (S.00°01'45"E.) a distance of four hundred sixty-five
(465) feet to the south line of the Southwest Quarter of the
Southeast Quart of the Southeast Quarter (SW/4 SE/4
SE/4) of Section Seventeen (17);
Thence South eight-nine degrees twenty-two seconds
twenty-seven seconds West (S.89°22'27"W.) along the south
line of said Southwest Quarter of the Southeast Quarter of
the Southeast Quarter (SW/4 SE/4 SE/4) of said Section
Seventeen (17), a distance of nine hundred thirty (930)
feet to the point of beginning.
Containing 11.45 acres, more or less.

12-519 to 12-526, inclusive, is hereby annexed and made a part of the city of
Salina, Kansas.
Section 2. That Ordinance Number 91-9483 is hereby repealed.
Section 3. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
