Approval of Advisability and Authorization Resolution No, 07-6347 related to establishment of a

BACKGROUND:
The attached Petition No, 4290 was submitted by Mr. Tim Howison, Vice President of Golden Eagle
Estates, Inc" on December 20, 2006 requesting certain street, drainage, water, and sewer
improvements to serve 23 residential lots in Golden Eagle Estates Addition No, 4, Please see the
attached petition and preliminary engineering feasibility report for a detailed description of the benefit
district
It is prescribed by Kansas State statutes that the City Commission consider a petition for street,
drainage, sewer, and water improvements and establish sufficiency on the basis that anyone of the
following three conditions be met:
1, The petition is signed by a majority of the resident owners of record of property liable for
assessment under the proposal.
2, The petition is signed by the resident owners of record of more than half of the area liable for
assessment under the proposal.
3, The petition is signed by the owners of record, whether resident or not, of more than half of the
area liable to be assessed under the proposal.
In this case condition No, 1 above is met. Therefore, the petition clearly meets the statute
requirements for sufficiency, The Saline County Treasurer has indicated there are no delinquent
taxes or special assessments on any property within the benefit district owned by the petitioners,
The engineering feasibility report for these public improvements is attached for your review, The
report describes the scope of the project, the improvement district, the method of assessment, cost
estimate breakdowns for each improvement, and identifies and describes the properties in the benefit
district. One Hundred percent (100%) of the cost of the improvements are proposed to be assessed
to the benefit district. These cost estimates include construction, construction contingencies,
inspection, design, and bonding/interest costs,
The property owners may choose to pay their share of the project costs as a lump sum payment in
the spring of 2008 or as a special assessment tax over a 15-year period beginning in December,
2008, The petitioner has the option of submitting a letter of credit for 35% of the project costs or 20%
in cash for financial security which will be due before the City Commission can award the bid, The
bid date for the project is tentatively scheduled for February 6, 2007,

We, the undersigned, owners of record of property located within the City of Salina, Kansas (the "City") do
hereby respectively request that the Governing Body of the City create and designate an improvement
district for the purpose of making certain improvements in the manner provided by K.S.A. 12-6aOl, et seq.
1. The general nature of the proposed improvements are as follows:
The curb, gutter, pavement, grading and drainage for approximately 1,124 lineal feet of Red Hawk Lane
and 125 lineal feet of Wayne Avenue (the "Street Improvements");
The installation of approximately 517 lineal feet of storm sewer, inlets, and all appurtenances thereto (the
"Drainage Improvements");
The installation of approximately 1,233 lineal feet of six-inch and eight-inch water main, fire hydrants,
valves, fittings, service connections for water lines and all appurtenances thereto (the "Water System
Improvements");
The installation of approximately 1,214 lineal feet of eight-inch and ten-inch sanitary sewer main, service
connections for sewer lines, manholes, and all appurtenances thereto (the "Sanitary Sewer Improvements");
(the "Improvements").
2. The estimated or probable cost of the Improvements is:
Five hundred thirty thousand forty-six dollars and twelve cents ($530,046.12).
3. The extent of the proposed improvement district to be assessed is:
Lots 18-23, Block 3; Lots 1-11, Block 4 all in the Golden Eagle Estates No.4 Addition and
unplatted parcel of land described on Exhibit "A" in the City of Salina, Kansas.

4. The proposed method of assessment shall be:
