Resolution establishing surplus city property.
BACKGROUND
The City Commission recently approved the vacation of part of the
street right-of-way for $moky Hill Drive between Columbia Avenue
and Penn Avenue. During that public hearing, the staff was
directed to prepare the resolution establishing as "surplus city
property" the remaining excess right-of-way for Smoky Hill Drive.
The City Commission may also recall that part of the right-of-way
for Smoky Hill Drive between Penn Avenue and the alley must remain
in-place to provide access to private properties and utility
companies.
The attached resolution, legal description and drawing establish as
surplus property the 0.37 acres of excess Smoky Hill Drive right-
of-way. The tract of land is odd-shaped and includes a partial
water line easement. The tract has frontage on two public roads,
Columbia to the east and Smoky Hill Drive to the north. With
adequate earth filling, it is possible that a structure could be
built on this property.
If this resolution is approved, the next step in the process is to
set a bid date to receive sealed bids from interested parties for
this property.
RECOMMENDATION
It is recommended that the City Commission approve the resolution
establishing surplus city property.

SURPLUS PROPERTY ON SMOKY HILL DRIVE
Beginning at a point on the west line of Columbia Avenue extended,
said point being forty-one and twenty hundredths (41.20) feet south
of the southeast corner of Lot Thirteen (13), Block Twelve (12),
0akdale Addition;
Thence south along the west line of Columbia Avenue extended,
a distance of forty-one and twenty hundredths (41.20) feet to the
high bank of the 01d Smoky Hill River Channel;
Thence southwesterly along said high bank a distance of three
hundred sixty-nine and four tenths (369.4) feet to a point on the
east line of vacated Penn Avenue;
Thence north along the east line of vacated Penn Avenue a
distance of seventy (70) feet to the south right-of-way of Smoky
Hill Drive said point being seventy (70) feet south of the
southwest corner of Lot twelve (12), Block Twelve (12), Oakdale
Addition;
Thence easterly on a line seventy (70) feet south of and
parallel with the south line of said Lot twelve (12) a distance of
one hundred eighty-seven (187) feet to a point on the east line
extended of the North-South alley in Block Twelve (12), 0akdale
Addition;
Thence north along said east line extended a distance of
twenty-four and two tenths (24.2) feet to a point which is fifty-
four and seven tenths (54.7) feet south of an iron pin marking the
southwest corner of Lot thirteen (13), Block Twelve (12), 0akdale
Addition;
Thence northeasterly a distance of one hundred seventy-two and
sixteen hundredths (172.16) feet back to the Point of Beginning.
The above described tract of land contains sixteen thousand
three hundred seventeen (16,317) square feet or thirty-seven
hundredths (0.37) acres, more or less, and is subject to the
following water line easement;
Beginning at a point on the east line of vacated Penn Avenue,
said point being sixteen and four hundredths (16.04) feet south of
the south right-of-way of Smoky Hill Drive;
Thence south along the east line of vacated Penn Avenue a
distance of twenty-one and ninety-three hundredths (21.93) feet;
Thence northeasterly a distance of ninety-five and six
hundredths (95.06) feet to a point on the south line of Smoky Hill
Drive, said point being eighty-six and seventy hundredths (86.70)
feet east of the east line of Penn Avenue;
Thence west along the south line of Smoky Hill Drive a
distance of fifty and eight hundredths (50.08) feet;
Thence southwesterly a distance of forty and fifteen
hundredths (40.15) feet back to the Point of Beginning.
The above described easement contains one thousand three
hundred fifty-two (1352) square feet or three hundredths (0.03)
acres, more or less.
