Dedication of street right-of-way for the improvement of Waterwell
Road.
BACKGROUND
The City of Salina and Saline County staffs have been coordinating
our efforts for a couple of years toward the long-term improvement
of Waterwell Road from Centennial Road west to Burma Road. Saline
County has been the lead agency for the project because the roadway
lies outside of the city limits. The City's role involves our use
of the road for landfill purposes and, subsequently, our share of
the costs for improvements. We also have an existing water
pipeline and standpipe along Waterwell Road which directly affect
the roadway improvements. The City Manager and City Engineer will
report to the City Commission in the near future regarding the
issues of cost sharing, utility improvements and scheduling of the
project.
The attached "Deed of Dedication" involves a tract of land with an
area of 0.433 acres located on the southeast corner of Waterwell
Road and Burma Road. The City of Salina currently owns the
property. Saline County has determined the need for this permanent
street right-of-way while completing the design of the proposed
improvements to Waterwell Road. Saline County is acquiring right-
of-way from all adjacent property owners to Waterwell Road in
preparation of the project.
The dedication of this small tract of right-of-way has no adverse
effect on the City's land holdings at this site. Furthermore, it
is certainly in the best interest of the City to dedicate the
property without compensation.
RECOMMENDATION
It is recommended that the City Co~f~aission authorize the Mayor to
sign the Deed of Dedication for property on Waterwell Road.
DEED OF D~D'rC~TION
KNOW ALL MEN BY THESE PRESENTS:
That the undersigned, being the owners in fee simple of the
hereinafter described real estate, do hereby grant, dedicate and
convey unto the County of Saline for use as public street, the
following described tract of land, to wit:
A tract of land in the Northeast Quarter of Section Seven (7),
Township Fifteen South (T15S), Range Three West (R3W) of the
Sixth Principal Meridian in Saline County, Kansas more
particularly described as follows:
Beginning at the Northeast Corner of Section Seven (7),
Township Fifteen South (T15S), Range Three West (R3W);
thence S. 0° 11' 22" E., along the East line of the
Northeast Quarter of said Section Seven, a distance of 150
feet; thence S. 89° 48' 38" W. a distance of 40 feet; thence
N. 23° 50' 10" W. a distance of 87.40 feet; thence
N. 82° 33' 00" W. a distance of 151.33 feet; thence
N. 0° 08' 41" W. a distance of 50.00 feet to the North line
of said Northeast Quarter; thence N. 89° 51' 19" E. a
distance of 225.00 feet to the point of beginning.
The described tract contains 0.433 acres, more or less.
Existing Road Right-of-Way 0.223 acres, more or less.
New Acquisition contains 0.210 acres, more or less.
That, pursuant to K.S.A. 1991Supp. 79-1437e, as amended,
the required completion of a real estate sales validation
questionnaire is not applicable to transfers of title when title
is transferred to convey right-of-way or pursuant to eminent
domain, and is, therefore, not applicable to the property
transfer described herein.
That the undersigned hereby covenants that they are the
lawful owners of or have an interest in the above premises and
have the right, power and authority to convey the rights granted
hereby.
