MEMORANDUM OF UNDERSTANDING and AGREEMENT
Housing Rehabilitation Program Services
This memorandum of understanding and agreement is entered into this 20th of
November, 2006 by and between the CITY OF SALINA, KANSAS (the "CITY")
and OCCK, Inc. ("OCCK").
Recitals
A. The CITY operates a program through the Neighborhood Services
Division of its Development Services Department known as City of Salina
Housing Rehabilitation Program to provide housing rehabilitation services
to income-qualified homeowners within the boundaries of the City of
Salina, Kansas.
B. OCCK operates a program known as Independent Connection of OCCK,
Inc. to provide persons with mental or physical disabilities with an array of
independent living services, including information and referral, advocacy,
independent living skills training, and peer counseling.
The parties agree to cooperate as follows to further the public interest in
providing safe affordable housing by working as partners during certain housing
rehabilitation projects.
1. Desianation - The CITY and OCCK agree that all partnership projects are to
be located within the boundaries of the City of Salina.
2. Types of Services - The CITY and OCCK have mutually agreed to collaborate
in providing housing rehabilitation services to qualified applicants as follows:
(a) OCCK will provide access to grant funds, provide client intake,
qualification and case management, make financial decisions, pay
contractors and service providers and perform all administrative duties
as required by separate grant agreements with public or private
grantors. OCCK will furnish details to the CITY of any grant-required
work standards for eligible housing rehabilitation services before initial
project inspection.
(b) The CITY will provide housing rehabilitation technical services
including conducting Housing Quality Standards inspections,
preparing scopes of work to meet required grant standards, insuring
that required building permits are applied for and inspections take
place, preparing bid sheets, soliciting bids for work, analyzing bids for
OCCK decision, coordinating delivery of housing rehabilitation
services between contractor, client and OCCK; monitoring work in

progress and assisting OCCK to insure satisfactory completion of the
scopes of work developed for each project.
3. Primarv Financial Resources - The CITY and DCCK mutually agree
partnership projects shall be funded as existing public and private funds
become available to OCCK. The CITY shall furnish technical services,
furnish building permits and furnish building permit inspections at no charge.
4. Optional Jointlv Funded Proiects - When the CITY and DCCK mutually agree
it is clearly in the public interest, financial resources may be pooled on a
project by project basis. Contribution of CITY funds to joint projects shall not
deplete seasonal reserves necessary to provide emergency assistance to City
of Salina Housing Rehabilitation Program applicants. The CITY and DCCK
agree that in the event of jointly-funded projects, current City of Salina
Housing Rehabilitation Program project qualification guidelines shall apply,
including assisting only homeowner-occupied units and declining assistance
to mobile homes or to properties with existing Nuisance Code violations.
5. Record Keeping - In order to provide a means of evaluating the results of
partnering, the CITY and OCCK agree each shall maintain and exchange
reasonable records of the number of applicants, funded projects, amount of
resources contributed to each project including cash, in-kind services, waived
fees and approximate staff hours devoted to joint projects.
6. Contact Persons - The CITY's primary contact for technical services shall be
Chuck Powell, Housing Rehabilitation Specialist. The OCCK primary contact
For administrative services shall be Jean Modin, Independent Living
Specialist.
7. Standards of Service - The CITY and OCCK agree to meet certain standards
of service towards maintaining a productive working relationship. OCCK
agrees to share and keep updated grant requirements and client information
necessary to arrange for CITY's staff to make inspections, develop
appropriate scopes of work and schedule contractors. OCCK agrees to alert
the CITY when possible of upcoming projects. The CITY agrees to respond
to OCCK requests for routine inspections within five business days and within
24 hours for highly urgent needs. The CITY agrees to present to OCCK
written project scopes of work within five business days for routine projects
and at least preliminary scopes within 24 hours for emergency needs. The
CITY agrees to provide scopes of work compliant with any State or Federal
grant requirements as well as local building codes. The CITY and OCCK
agree to require any post-bid changes to a project scope of work be made in
writing and signed by the CITY, OCCK, the client and any contractor(s)
affected.

8. Term - This cooperation agreement shall commence upon its execution by
the City Manager and by the President of OCCK, Inc. The agreement shall
not have a specific termination date.
9. Cancellation - This agreement may be canceled by either the CITY or OCCK
upon 30 days written notice. Notice may be waived by mutual agreement of
the parties. The CITY and OCCK agree to finish any and all work on any
joint projects undertaken before the date of notice but not yet complete by the
date of termination.
