Background
A combined preliminary/final development plan and a zoning Change
. from A-1 and C-5 to MH-P zoning for the Southwestern Mobile Home
.~' Court was recommended for approval by the Planning Commission on
August 6, 1991. Final approval was granted by the City Commission
on August 26, 1991. At this point in time the manufactured home
park is about 2/3 developed. The approval of funding and design
plans for the Magnolia-I-135 interchange has necessitated that the
southern portion of this park be redesigned to accommodate
interchange ramp improvements. A portion of the park site and
adjacent Hageman Avenue right-of-way is being acquired for
interchange right-of-way.
Nature of Current Request
The applicant is seeking approval of an amended development plan
and a replat for the southern 1/4 of this manufactured home park.
The subject property is part of the Southwestern Mobile Home Park
.: Planned Development District and the originally approved layout
can no longer be developed due to KDOT's design requirements for
the northbound ramp at the proposed interchange. The applicant is
not proposing to amend any of the development standards adopted as
part of the zoning change, however, the area covered by MH-P
zoning and the adopted development standards would expand due to
the elimination of the east-west leg of Hageman Avenue along the
southern edge of the park.

Elements of the amended plan are as follows:
1. There would be 19 manufactured home sites instead of the 15
shown on the original plan configuration.
2. The platted east-west leg of Hageman Avenue that connects

accommodate the proposed northbound entrance ramp.
Staff.Comments
The Hageman cul-de-sac may be constructed in stages because an
.' existing manufactured home sits in the proposed cul-de-sac right-
of-way. The bulb would be completed when that home was relocated.
The west half of Hageman is not within this subdivision or
included in the PDD.
Planning Commission Recommendation
The Planning Commission conducted a public hearing on this
application on May 2, 1995. Following presentation of the staff
report and comments and questions, the Commission voted 5-0 to
recommend approval of the amended preliminary and final
development plan subject to certain technical corrections.

approval of an amendment of the development plan for the

Mr. Dudark gave the staff report and stated about 4 years
~' ago the City Planning Commission and the City Commission
approved a change in zoning and a preliminary development
plan for a tract of land behind the Dlllons store, from
commercial to PDD mobile home park and that was for the
purpose of allowing the land owner here who has an
: existing mobile home park to expand that east of Hageman
· and build some new spaces for mobile homes. That project
has proceeded it is working its way from north to south.
This project is a result of an acquisition of right-of-way
for the Magnolia and 1-135 interchange which slices across
this area in about this kind of configuration. It affects
il the plan on the southwest side. The plan that is in
. . effect now, I think we gave you a copy of it, but it is
· essentially patterning these streets that come in this way
~'~ and terminate with the lots going off in a north/south
-~ kind of direction. The gray area is the area that is
~' affected by the change and that is due to this realignment
'"i and the need to realign Hageman Ave. and this acquisition
· of right-of-way. So we have a plan that has been drawn by
the applicant's engineer that covers that south area and
~' ' instead of it coming straight on down and then going on
'" along the south side, Hageman will terminate in this
'~ location and Star Drive comes off at kind of an angle and
· goes over here and terminates like it was originally
intended but there is a small street, Star Circle, that
- comes down and accesses four mobile home sites. So
'- Hageman would no longer loop around, it is going to
terminate at this location. Originally there were 15
sites, this plan produces 19 sites on the property.
: Mainly that is because this right-of-way of Hageman now is
bulldable rather than a street right-of-way and that
accrues to this land owner because it was platted out of
his holdings. The other change is the pond, now it is in
~ this location and will be shifted down to the south it
will have the same capacity with Just a little bit
different configuration but still provides drainage for
'. the development. The cul-de-sac that I mentioned with an
80 ft. paved area and 100 ft. diameter will leave some
room between the paving line and the right-of-way line.
One exception that they are requesting is a 20 ft.
building setback around this cul-de-sac. The rest of it
- would be interior and that is the standard for interior
- streets, for the private streets. The public street
setback is 25 ft. this is a 5 ft. change. We don't see
any problem with that. This will be for one unit.
Basically it will be off the cul-de-sac at least 20 ft.
there won't be a driveway, the driveway will likely be
over here so it will not be impacted by that. The
automobile will be in that location. The other thing I
would mention is that there is a water line that comes
down Hageman that goes kind of straight south and then
curves along the existing Hageman right-of-way that may
· : have to be relocated over to approximately this area.
~- This will be the fence line so we are not sure whether
KDOT will allow a water line to be located in the ramp
right-of-way, they may allow that and they may not. But
we do have an easement shown here in case it has to moved
over to here. So there is a provision for it to be
relocated if necessary. This is a plan and the next item
-. is a replat of the same area but they are designed to work
"- together and you only see the east half of this right-of-
way and the west half of this cul-de-sac right-of-way is
. in a different legal description, so it will have to be
dedicated separately and not a part of this plat. But all
'~ of the development standards, and ! think we had mentioned
something about attachment one, we did pass that out,
those remain the same, there are no changes to those.

Essentially what we are doing is reconfiguring the plan to
accommodate this right-of-way situation and enable the
developer, the applicant here, to continue to move ahead
with his mobile home park development.

and to recommend to the City Commission that the amended

i~. factors presented tn the staff report as being consistent
with the character of the neighborhood, all of the
~' proposed development conforms with and is suitable for the
~?: existing uses and existing zoning and the proposal places
-~- no strain on existing public facilities and adequate
~' precautions have been made for possibly moving the water
· ;' line and it is consistent with the Comprehensive Plan.

:' Mr. Dudark gave the staff report and stated this is very
similar to the previous one, it doesn't have all the lot
,~ lines where the individual units would be located, but it
· has all the easements for utility lines, there are some
· existing utility lines that go down through this, there is
~ a storm sewer easement that goes down to this drainage
ditch. It does have this line here that shows where the
future right-of-way would be on the plat. That is not
being dedicated as a part of this plat. It will be
" acquired from the owner through the acquisition of right-
of-way. It does have Hageman Ave. here which is a
dedicated part of the street. Not being labeled future,
so this is a dedication of public right-of-way to enable
· the cons'truction of this cul-de-sac. It does show the
relocation of the drainage pond easement. It also has
easements for utility lines which would simply be at the
.' rear location of the mobile home for power lines,
telephones and those kind of things. I think that is
'?' really all I need to point out on here. I did mention
~: that it coincides with the boundaries of the previous plan
so the two plans are consistent.

: approval of Application #P95-5/SA specifically that the
final plat approval of the replat of Lot 9 and the S 75'
· of Lot 8 in the Wallerius Addition be approved referring
~ to the condition that there be technical corrections made
and also to approve the waiver of the cul-de-sac
requirement which would allow construction of an 800 ft.

ORDINANCE NUMBER 95-9690
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND
THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND
PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY
AND PRESCRIBING THE PROPER USES THEREOF.
WHEREAS, all conditions precedent for the amendment of the Zoning
District Map, the rezoning of certain property therein, hereinafter described
has been timely complied with, and SO NOW, THEREFORE,
BE IT ORDAINED by the Governing Body of the City of SaUna,
Kansas:
Section 1. AMENDMENT. DISTRICT ~PDD/MHP~. PLANNED
DEVELOPMENT DISTRICT FOR MANUFACTURED HOMES. That the Zoning
District Map of the City of Salina, Kansas, duly adopted and published as a
part of Ordinance Number 8526, the same being Chapter 42 of the Salina
Code, be and is hereby amended so that the following described property be
rezoned as follows, to-wit:
The South Seventy-five (75) feet of Lot Eight (8), Lot Nine (9),
plus vacated Hageman Avenue in Block One (1), Wallerius Addition
Number Two (2) to the City of Salina, Saline County, Kansas.
shall become a part of an amended District "PDD/MHP". PLANNED
DEVELOPMENT DISTRICT FOR MANUFACTURED HOMES.
Section 2. CONDITIONS OF APPROVAL. That the use of said
described property shall be subject to all the conditions, restrictions and
limitations as made and provided for in Ordinance Number 8426, the same being
Chapter 42 of the Salina Code with reference to the PLANNED DEVELOPMENT
DISTRICT FOR MANUFACTURED HOMES, as amended. Development of the
property shall be subject to the plans on file with the Planning Commission
and/or City Clerk and the following conditions, to-wit:
1. Approval is subject to the approved Site Development Plan
which is on file in the Zoning Administrator's office and herein
incorporated by reference.
2. The section developed with Manufactured Homes must comply
with the requirements of Section 42-222 thru 42-224
(Manufactured Home Parks) and 22-16 thru 22-38 (Mobile
Homes and Trailers) of the Salina Code and in addition:
a) Housing units placed in this development must have been
constructed after June 15, 1976, and must contain a seal
indicating they were built according to National
Manufactured Home Construction and Safety (HUD Code)
Standards.
b) The units must have a minimum width of fourteen (14)
feet and a minimum main floor area of seven hundred
eighty (780) square feet.
c) All main buildings and detached garages shall have a
pitched roof. Metallic roofing surfaces must be coated
with a nonreflective and nonmetallic material. Use of
corrugated metal or plastic panels shall not be permitted.
d) All housing units shall be tied down and blocked as
designated by K.S.A. 75-1226 thru 75-1232.
e) All housing units shall be skirted with a solid and wind
resistant material designed for exterior use. Skirting
shali be securely attached and shall enclose the total open
area under the manufactured home.
f) The unit must be permanently connected to all utilities in
conformance with applicable city codes.
g) Each lot shall have a separate entrance from a paved
public or private street and two off-street parking spaces.
h) The tongue (hitch) of a manufactured home must be
removed if it is bolted on, but may be left intact if it is
permanently attached to the manufactured home, provided
that the tongue (hitch) is enclosed with a suitable,
attractive enclosure and is landscaped.
3. The proposed new internal streets (Star Drive and Star Circle)
be paved to either public or private street standards.
4. The applicant shall install or submit a valid petition for the
installation of a public water line of a size to be determined
by the City Engineer running from the terminus of the six
inch (6") water line in Hageman Avenue to the existing twelve
inch (12") line near Ninth Street and Magnolia Road.
5. The applicant will satisfactorily complete construction of the
relocated ponding area prior to issuance of any occupancy
permits for housing units in this development.
6. The applicant will prepare a maintenance agreement providing
for maintenance of the ponding area and any inlets, ditches or
pumps associated with moving storm water off the site.
7. The amended manufactured home park plan shall be recorded
in the office of the Saline County Register of Deeds.
Section 3. That this ordinance shall be in full force and effect
from and after its adoption and publication once in the official city
newspaper.
