Access EasementN ACCESS EASEMENT THIS INDENTURE, made this �day of September, 1988, by and between the CITY OF SALINA, KANSAS, a municipal corporation (the "City"), and GARY L. WOOSTER and NAOMI A. WOOSTER, husband and wife (the "Grantees"). WHEREAS, the City holds flood protection system right-of-way on the north side of State Street adjacent to commercial real estate owned by the Grantees; and, WHEREAS, Grantees desire to obtain and the City wishes to grant an access easement to Grantees to provide access to an overhead door located in Grantees' commercial building. WITNESSETH: The City does hereby grant and convey an access easement unto the Grantees, as joint tenants with right of survivorship and not as tenants in common, over and across a certain portion of land owned by the City, more particularly described as follows: A Tract of land located in the Southwest 1/4 of Section 11, Township 14 South, Range 3 West of the Sixth Principal Meridian, in the City of Salina, Saline County, Kansas, more particularly described as follows: Beginning at a point 250 feet East and 75 feet North of the Southwest corner of said Section 11, said point being on the North right-of-way line of State Street and the East right-of-way line of the Flood Control Dike; Thence north northeasterly along the East right-of-way line of the Flood Control Dike a distance of 220.70 feet to a point which is 220 feet North and 17.6 feet East of the Point of Beginning; Thence south southwesterly a distance of 132.31 feet to a point which is 90 feet North and 7 feet West of the Point of Beginning; Thence south a distance of 20 feet to a point which is 70 feet North and 7 feet West of the Point of Beginning; vp Thence south southeasterly a distance of 70.35 feet back to the Point of Beginning. The above described Tract of land contains 1632 square feet, more or less. for all right of ingress and egress by the Grantees, their employees, contractors, suppliers, customers, and assigns in order to provide access to an overhead door located in Grantees' commercial building located adjacent to the access easement described above. RESERVATION: The City hereby reserves the right to rescind the access easement granted herein in the event that the City determines that the access easement is in any way interfering with the public purpose served by the City's ongoing maintenance and operation of the flood protection system.
