Ohio-Schilling Master PlanSUPPLEMENTAL AGREEMENT NO. 1 for PROFESSIONAL ENGINEERING SERVICES between CITY OF SALINA, KANSAS and WILSON & COMPANY, INC. ENGINEERS & ARCHITECTS Salina, Kansas THIS IS A SUPPLEMENTAL AGREEMENT, made as of �a `-::52003, between the CITY OF SALINA, KANSAS, hereinafter referred to as the CITY; and WILSON & COMPANY, INC. ENGINEERS & ARCHITECTS, with offices at 1700 East Iron Avenue, Salina, Kansas, hereinafter called the ENGINEER. The purpose of Supplemental Agreement No. 1 is for additional services requested and provided as part of the Schilling/Ohio Master Utility Plan. Services include an additional storm drainage study, meeting(s), and preparing railroad crossing exhibit. The CITY and ENGINEER mutually agree that this SUPPLEMENTAL AGREEMENT NO. 1 shall be subject to the provisions of the AGREEMENT FOR PROFESSIONAL SERVICES between the CITY OF SALINA, KANSAS and WILSON & COMPANY, INC. ENGINEERS & ARCHITECTS, dated January 21, 2003, and is hereby modified as follows: Within SECTION 1— BASIC SERVICES OF ENGINEER, add the following paragraphs: 1.2.6.1. Resize the storm drainage ditch that flows north from Water Well Road towards the existing storm drainage ditch located immediately south of Schilling Road. Future developments within the drainage area from Water Well Road on the north to Mentor Road on the south shall be prohibited from free discharging into the proposed storm drainage ditch. These developments would need to maintain existing peak discharges by providing on-site detention systems. Future developments within the drainage area north of Water Well Road to Schilling Road would be allowed to free discharge into the proposed storm drainage ditch. Account for 4:1 side slopes and 1 -foot freeboard at peak design. 1.2.9.1. Meet with the CITY to address any additional concerns that arise with regards to the storm drainage ditch sizing. 1.2.9.2. Generate additional maps for the meeting(s) as required. 1.2.11. Prepare a railroad crossing exhibit and supplemental drawings for the 12 -inch water line north of the Schilling Road and the Union Pacific Railroad intersection. a - Within SECTION 3 — PAYMENTS TO ENGINEER, COST PLUS FIXED FEE METHOD OF PAYMENT, change paragraph 3.1 to add $4,250.00 to the Estimated Cost and $750.00 to the Fixed Fee for a total addition to the Estimated Cost Plus Fixed Fee of $5,000.00. Paragraph 3.1 to read as follows: 3.1. Fee and Method of Payment. For the services described in Section 1 of this Agreement, the CITY agrees to pay the ENGINEER on a cost plus fixed fee basis. Payments shall compensate the ENGINEER for all direct labor costs, reimburseable expenses, overhead rate, fixed fee, and all other direct costs in providing the services. Total payment to the ENGINEER for the services is estimated to be as follows: Estimated Fixed Estimated Cost Cost Fee Plus Fixed Fee $12,665 $2,235 $14,900 IN WITNESS WHEREOF, the parties hereto have made and executed this Supplemental Agreement No. 1 as of the day and year stated on the first page.
