Supp. No. 3 Water Treatment PlantSUPPLEMENTAL AGREEMENT NO. 3 for PROFESSIONAL SERVICES between THE CITY OF SALINA, KANSAS and WILSON & COMPANY, ENGINEERS & ARCHITECTS This SUPPLEMENTAL AGREEMENT NO. 3, made as of D?cemty-K ((a , 2002, by and between the City of Salina, Kansas, (OWNER) and Wilson & Company, Engineers & Architects, (ENGINEER), a partnership of corporations, with an office at 1700 East Iron Avenue, Salina, Kansas. WHEREAS: The AGREEMENT for PROFESSIONAL SERVICES between the OWNER and the ENGINEER dated 10 July 2000, SUPPLEMENTAL AGREEMENT NO. 1, dated 18 December 2000, and SUPPLEMENTAL AGREEMENT NO. 2, dated 05 June 2001, set forth the required performance of professional engineering services and payment for Phase II improvements to the existing municipal Water Treatment Plant (PROJECT). The PROJECT included: Final Design Services, Bidding Services, Construction Related Services, Geotechnical Services, Resident Project Representative Services, Public Water Supply Loan Fund (PWSLF) Services, and Public Art Services for the Phase II improvements. The PROJECT is to be partially funded by a loan through the PWSLF program as administered by the Kansas Department of Health and Environment (KDHE). WHEREAS: The OWNER desires to revise the original scope of professional engineering services to add Public Art Final Design Services and; WHEREAS: The OWNER is authorized by law to employ Consulting Engineers to render professional engineering services and to make payment for their services. WITNESSETH: The OWNER and ENGINEER mutually agree that this SUPPLEMENTAL AGREEMENT NO. 3 shall be subject to the provisions of the AGREEMENT FOR PROFESSIONAL SERVICES between the City of Salina, Kansas, and Wilson & Company, Engineers & Architects, dated 10 July 2000, SUPPLEMENTAL AGREEMENT NO. 1, dated 18 December 2000, and SUPPLEMENTAL AGREEMENT NO. 2, dated 05 June 2001, and is hereby modified in accordance with the attached SUPPLEMENT NO. 3. IN WITNESS WHEREOF, the parties hereto have made and executed this SUPPLEMENTAL AGREEMENT NO. 3 as of the day and year first written above. Iron Salina, KS 67401 01 SUPPLEMENT NO. 3 To the AGREEMENT for PROFESSIONAL SERVICES, dated 10 July 2000; To SECTION 1 — BASIC SERVICES OF ENGINEER, add the following: 1.11 Public Art Final Design Services. After written authorization to proceed with the Public Art Final Design Services, ENGINEER shall provide the following services to allow for the incorporation of public art components into the project. 1.11.1 Contact and arrange for subcontract services with an "artist" to assist in the development of the Final Design of the public art components developed and selected in Paragraph 1.10. The selected components are as follows: a) Type III Barricade at Fourth Street (north and south ends of block). b) Perimeter security fence. C) Crash protection at electrical transformers (northwest corner of site). d) Concrete tank walls at four locations (facing west). e) Water feature with plant identification and mailbox. 1. 11.2 Schedule and attend a preliminary design meeting with representatives of the Salina Arts & Humanities Department to present and receive ideas for preliminary design concepts to be incorporated into the project. 1.11.3 Present and review public art final design and opinion of probable costs with OWNER. 1. 11.4 Schedule and attend a meeting with representatives of the Salina Arts & Humanities Department to present art components to be included in the project. 1.11.5 Prepare and deliver five (5) bound copies of the Final Design Drawings and Report to the OWNER.
