Driveway/Loading Dock AgrDriveway/Loading Dock Agreement
WHEREAS, Waters Realty, Inc. ("the Owner") has requested a 30 ft.
driveway curb cut on Greeley Avenue to serve the rear service area of
the Waters True Value store located on the West 560 ft. of Lot 1 in
Surveyor's Plat No. 52 in the City of Salina (aka 460 South Ohio) and;
WHEREAS, the driveway would be in direct alignment with a loading
dock located in the front yard facing Greeley Avenue which could lead
to delivery trucks backing directly out of Greeley Avenue into the
dock in a manner that could block or interfere with traffic movement
on a public street; and
WHEREAS, the City of Salina Engineering Department ("the City")
is agreeable and willing to issue a driveway permit in that location,
subject however to the following terms and conditions hereinafter set
forth.
NOW THEREFORE, IN CONSIDERATION THEREOF, the Owner and City
hereto mutually agree as follows:
1. The Owner shall install private guidance signs to direct
truck traffic to the site from Greeley Avenue to the east drive-
way opening on Greeley Avenue, then to the south portion of the
lot, then to the west side of the lot, then to the loading dock.
2. The Owner shall install private guidance signs near the
loading dock and turning lane area to direct truck loading and
delivery vehicles into and out of the site without using the
public street (Greeley Avenue) for maneuvering.
3. The Owner shall agree to operate the west (rear) driveway to
the site as an "EXIT ONLY" driveway opening. The owner shall
install signs and pavement markings to designate the exit only
driveway.
4. The Owner shall monitor and control, to the best of his
ability, the use of the driveway and loading dock area by private
truck operators.
5. The City shall install signs on Greeley Avenue east and west
of the driveway to the site to indicate "NO TRUCK LOADING OR
BACKING FROM STREET - VIOLATORS WILL BE PROSECUTED" and/or "NO
LEFT TURN". All enforcement of illegal vehicular movements in
the public right-of-way shall be performed by the Salina Police
Department.
