Our client, Mr. Paul Warden, has contracted our Architectural firm, Cayton-Jones-Engelhardt-Gillam, to remodel three down- town store buildings, commonly known as the Salina Mercantile Company building, address 102, 104, and 106 North Santa Fe. (All of Lot 105 on Santa Fe Avenue, Original Town). The first phase of the remodeling is a new store front. For aesthetic purposes regarding a new brick front, we are here requesting use of 6" of public property sidewalks. All as per drawings enclosed. Thank you for your consideration. Gill r. -&NG:ks Encs. cc: Mr. Paul Warden t M November 15, 1973 TO: Norris Olson, City Manager FROM: Dean Boyer, City Engineer SUBJECT: Letter from Cayton-Jones-Engelhardt-Gillam, Architects and Engineers, representing Paul Warden, owner of all of Lot 105 on Santa Fe Avenue, Original Townsite, requesting use of six (6") inches of public property for aesthetic purposes. This request is being made under the following section of the Salina Code. Section 32-41. Use of public property for aesthetic purposes by abutting property owners. The board of commissioners may grant a permit to any person to use a portion of any sidewalk, street, avenue, alley or other public property abutting upon their property for aesthetic purposes notwithstanding the provisions of section 32-37. Application for such permit shall be made to the city clerk and shall be referred by him to the board of commissioners. The application for such permit shall be accompanied by a detailed plan and specifications for the proposed project. If the board of commissioners, on consideration of the application, finds that the proposed project will be beneficial to the appearance of the city and in accordance with any comprehensively planned development program for the area, and will not interfere with the use of the sidewalks, street, avenue or alley for the public purpose for which it was intended, the board of commissioners may grant a permit to the applicant for such purpose on such terms, conditions and restrictions as it deems in the public interest: Provided however, that any permit granted hereunder shall be subject to revocation by the board of commissioners in the event that said property is required for public purposes or if the abutting property owners fail or neglect to use the same for the purposes for which the permit was granted or fail or neglect to maintain the same in a good state of repair and in that event, then the abutting property owner shall be required to remove any improvements made under said permit. IV Norris Olson, City Manager Page 2 November 15, 1973 The attached print indicates that this request is to allow them to place a three (3") inch pattern brick facing onto the present front wall of the "Old Salina Mercantile Company" building at 104-106 North Santa Fe Avenue. This is not a projection from the present wall, but a new facing extending the full height of the building. This department would recommend approval of this request.
