EASEMENT TO RELOCATE TANK BATTERY AND RELATED PIPES
THIS EASEMENT is hereby granted, on this '7tJ( day of
May, 1984, by the City of Salina, Saline County, Kansas, unto
Gary D. Ray and Robert D. Smith, partners d/b/a GARO Invest-
ment Company of Salina, Kansas.
WHEREAS, the West 40 acres of the East Half (E/2) of
the Northwest Quarter (NW/4) of Section Twenty (20), Township
Fourteen (14) South, Range Two (2) West of the Sixth Principal
Meridian in Saline County, Kansas is owned by the City of
Salina and is subject to an oil and gas lease originally made
in favor of Don McKeller, d/b/a Don McKeller Oil Explorations,
recorded February 18, 1963 at 11:50 a.m. in Book 25 of Oil and
Gas, pages 197-198. The said Gary D. Ray and Robert D. Smith,
partners d/b/a GARO Investment Company, are the successors in
interest to the said Don McKeller and presently constitute
the holders of the entire working interest with respect to
said oil and gas leasehold.
WHEREAS, a producing well operates on and pursuant to
said lease, whose tank battery is presently located near the
western boundary of the subject tract at a point approximately
1,700 feet south of the northern boundary of said Section 20.
The immediate vicinity of said tank battery is being developed
for residential purposes to which the battery constitutes a
nuisance, thus requiring its relocation to a new site remote
from residential development where the battery would not
constitute a nuisance.
SO NOW, THEREFORE, the City of Salina does hereby grant
unto the said Gary D. Ray and Robert D. Smith, partners d/b/a
GARO Investment Company, the right, privilege and easement to
relocate the tank battery and related pipes to a new location
on land owned by the City in Section 20, Township 14 South,
Range 2 West of the Sixth Principal Meridian in Saline County,
Kansas, which would not interfere with the City's operation
and maintenance of the City Municipal Golf Course.
PROVIDED, HOWEVER, Rufus Nye, City Manager for the City
of Salina, is hereby authorized and directed by the City
Commission to approve the exact location of the tank battery
and related pipes for and on behalf of the City.
