CONVEYANCE OF EASEMENT
THIS INDENTURE, made this day of December, 1962, by and
between L. S. NELSON and CORA J. NELSON, his wife, of the first part,
hereinafter referred to as I'NELSON" and STEELE, INC., and CL' S, INC., both
Kansas corporations with their principal place of business in Salina,
Kansas, hereinafter referred to as "CORPORATIONS 11 and the CITY OF SALINA,
KANSAS, hereinafter referred to as the "CITyrr, they being the parties of
the second part.
WHEREAS, the parties of the second part desire to obtain an ease-
ment over, upon and through certain land owned by Nelson hereinafter
described; and,
WHEREAS, Nelson is the owner of the fee simple title to said land
and is willing to grant said second parties the desired easement under the
terms and conditions hereof; and,
SO NOW, THEREFORE, witnessed, that Nelson in consideration of the
payment of the sum of $250.00, receipt of which is hereby acknowledged,
does by these presents, grant, bargain, sell and convey unto the Corporations
an easement for the purpose of constructing, installing, repairing, replacing
and maintaining a water line and appurtenances thereto for a term of five (5)
years from the date the lands hereinafter described are incorporated ~~
the limits of Salina, Kansas, and thereafter in perpetuity unto the C~ty in,
over and across that certain portion of land owned by Nelson more particularly
described as follows:
That certain portion of the Southeast Quarter (SE/4) of
Section Thirty-five (35), Township Thirteen (13) South,
Range Five (5) West of the 6th P. M. described as
follows:
Beginning at a point on the West right-of-way line of
U. S. Highway No. 81 Four Hundred (400) feet North of
the South line of said quarter section, thence North
along said right-of-way line Three Hundred (300) feet,
thence West parallel with the South line of said quarter
Section Fifteen (15), thence South by East in a straight
line to a point Five (5) feet West of the place of
beginning, thence East Five (5) feet to the place of
beginning.
IN WITNESS WHEREOF, the party of the first part has set his hand
on the day and year first written.

BE IT REMEMBERED, that on this day of December, 1962, before
me, the undersigned, a Notary Public in and for said County and State, came
L. S. NELSON and CORA J. NELSON, his wife, to me personally known to be the
same person who executed the within instrument of writing, and duly acknowledge
the execution of the same.
