ITEMS OF INTEREST
1. As you have heard in the press, the U.S. Environmental Protection
Agency (EPA) has released the results of a comprehensive study
linking chlorinated water and cancer. Chlorine is added to water
as a disinfectant. Its purpose is to kill bacteria and it is used
in almost all public water supplies and has been for centuries.
The EPA study demonstrates a significantly higher rate of cancer
of the colon, rectum, and prostrate for persons drinking chlorinated
water versus another group drinking water that was not chlorinated.
Although there has been some evidence that such a link exists, this
study is the first solid scientific evidence.
The cancer is caused from carcinogens which are compounds which
are created when the chlorine combines chemically with other sub-
stances that are in the water. The most noticed compound is chlor-
iform.
The government will require that cities the size of Salina reduce
the level of these carcinogens by 1983. Salina at the present
time exceeds the allowable limits. We are planning to recommend
that the City enter into a contract with Wilson and Company for a
scientific analysis and recommendations on how the City may reach
these objectives. There are several possible routes to be followed
and some of them could be very expensive. The most expensive one
probably would be to change the present water treatment process to
a charcoal additive system. Wilson and Company has the laboratory
and scientific expertise to assist us in this area.
I think it is important that the matter of this link be kept in
perspective. It appears that science daily discovers another sub-
stance that produces cancer in human beings. The scientists in
the EPA study feel that the chlorine created compounds may be linked
to the increased incidence of cancer, but there may be other unrelated
causes from the public water supplies. Also, chlorine disinfectant
powers have reduced the enormous public health hazards of water-born
diseases. Water-born diseases, such as typhoid, are no longer the
public health hazard they once were.

4. My efforts to get some information on the economics of underground
utilities versus overhead utilities has hit some snags. I have
talked with several of my associates in the utility institutes
and they know of many technical reports on the subject, but are
not able to lay their hands on an economics study that will answer
our questions. They are convinced that the cost will balance out
and particularly with the improving technology in the underground
systems which, of course, is spurred by more underground installa-
tions.
The only studies they know of are ones that have been privately
financed and cannot be released. The study I saw 5 years ago was
prepared by a consultant for a client and that consultant will not
release the study, but is willing to prepare a new one for the City
at a cost of between $25,000 and $30,000. I told him I felt the
Commission was not interested to that degree.
The Edison Institute promised to look into this matter, but felt
they can not get to it because of the holidays and vacation sched-
ules for several weeks.
5. We will encumber from the 1980 Budget an additional $20,000 for
payment to the Central City Task Force. These funds will be from
the City Commission contengency. As you know, this is not budgeted
in the 1981 Budget and this will allow the City to meet its obli-
gation for this project.
6. I will be out of town from Wednesday, December 31, through Saturday,
January 3.

Underground Utilities

Due to the discussion on what the proposed supplemental underground utilities
ordinance will or will not do, I have attached a copy of the ordinance as approved
by the Planning Commission at their January 15, 1980 meeting. A short summary
of the provisions of the ordinance, as well as, a few editorial comments might
also be in order.
The ordinance as proposed would require all new utilities to be placed under-
ground in the City of Salina after the effective date of the ordinance. This
would apply to both new and existing subdivisions.
The ordinance would not require any existing above ground utilities to be placed
below ground. If there is some interest in this, we would probably have to
amortize their removal over a substantial period of time.
Sections 3 and 4 provide for temporary and permanent exceptions to the ordinance.
The most notable permanent exception deals with lines of 3,000 KVA or more. This
would, essentially, bury all the "single phase" 1 ines behind homes, but would not
bury the main supply lines to a subdivision. For example, in Dow Addition
(along the east side of Ohio, south Republic) the 3-phase lines along Ohio
would not have to be buried, but those extending into the subdivision would.
Section 7 prohibits underground utilities in areas habitually covered by water,
such as flood plains or major drainage ways.
This underground utilities ordinance is very similar to the one passed in
Lawrence in June, 1976. There are some slight differences in wording. Their
ordinance was accepted after some initial opposition and KP&L feels fairly
comfortable with the ordinance as it is presently proposed. Evidently, Pat
Morgan was commenting, at last Monday.s meeting, on an earlier draft which did
not contain revisions we made after consultation with Norm Jackson.
If the City Commission accepts the underground utility section of the proposed
Subdivision Regulations, this ordinance will be prepared and presented to them
in February, 1981.

towers, supports, wires~ conductors, guys, stubs, platforms,. cross-arms,. braces,
line: transformers, insulators'~ cut~uts, switches', ccrrmunication circuits,
appliances~ attachments and appurtenances located above ground upon, along,
across or over streets, a 11 eys and easements and use-d in sU+Jp 1 yi ng eT ectri c,
communication or similar or related service.
Section z.. Under9round InstaTlation Required..
ATl new,. overhead utility structures used in supplying electric, communication
or related service for the purpose of providing service to unserved areas shall be
placed underground. After the effective date of this ordinance~ it shall be unlaw-
ful,. except as specifically provided herein, for any ~erson or util ity to erect or
construct any overtlead utility structure within the. corporate limits of the City
of Sa 1 i na" Kansas.
The subdivider, developer or owner of any area which does not have electrical
or cOlTmtJnications services installed on the effective date of this ordinance shall
make the necessary arrangements for installation of underground facilities, including
circu.its for street lights and traffic signals where detennined necessary by the City
Engineer or his designee. Such arrangements shaTl be made with each of the companies
or persons supplying the electrical and communications service in accordance with
the establ ished charges of such company or person. .
Nothing in this ordinance shall prevent. a subdivider, developer o~ owner from
making arrangements with a private contractor, qualified to the satisfaction of the
u.tility involved, for the installation of underground facilities in accordance with
the established specifications of the companies controlling the utility or communi-
cations service.
All futuM! wiring shall be. underground after the adoption of this ordinance.
All exi sting overhead: uti li ty structures located. on property subdivided after the
effective data of this ordinance shall be placed underground prior to the completion
of development.. Nothing in this. ordinance will prevent the replacement of poles,
overhead wires and associatea stTuctures on these lines when necessary for the
purpose of maintaining the line or upgrading the capacity thereof, or' in the case
of s.i ngl e phasa 1 i nes,.. the add; ti on of necessary faci 1 i ti es to three phasi ng. of
the line.
Section 3. Temporary Exceptions.
The City Manager, or his designee, may grant special pennission in cases where
temporary electrical power or :omrnunication servics is r~quire<! for emergencies or
for building construction purposes or' other temporary purposes to erect, construct,
install and/or maintain overhead utility structures for a period not to exceed 120
days. rn the event the purpose for whi cn the temporary excepti on referred to 'Has

material, natural disaster, strikes or other circumstances, beyond the control of
the parties or by unusual hardsh;p~ then the time may be extended an additional

Structures on carner lots, in streets and alleys, and on easements'
adjacent thereto, i~a new subdivision, in cases whe~e.e~ectrical

ary from an area where overhead wires are not prohi bited, may be
connected to said overhead wires and are hereby exempted from the
provisions of this ordinance.
All overhead utility structures that are continuously attached to
a structure by means of a bracket or other fixture and extending
from one location on a structure to another- location on the same
structure or' to another structure without crossing a property 1 ine.

Notwithstanding any other proviSions of this ordinance, the City CommiSSion,
after review by the City Engineer, may grant special exceptions on a permanent or
temporary basis to the proviSions of this ordinance under such terms as the City
Commission may deem appropriate in cases of emergency or unusual circumstances
to any party to construct, maintain and operate overhead utility structures within
the city.
Section 6. Hold Hannless..
The utilities~ their successors and assigns shall save and hold harmless the
City of Salina, Kansas from all liability, costs, damages and expenses of every
kind, for'the payment of which said City may become liable to any person, firm,
or corporation by reason of any negligence by the utility in the construction"
maintenance and operation of its utility system within the City.

Underground Utility Dist~ibution Facilities Prohibited.
The inst~llation, placement or maintenance of any and all underground utility
distribution facilities" whether above or below ground, shall be prohibited in all
designated flood pl~ins, drainage easements, major drainage 'Hays or any other area
where the possibility of standing water exists. Where underground utility distrib-
ution facilities must cross such drainage areas, easements or ways, they Shall be
elevated and so installed as ta be reasonably free from flood or stann water runoff
darna e.

Any person or utility who shall erect, construct",. place or operate any
overhead utility facilities in violation of this ordinance or who shall otherwise
fail to comply with the provisions of this ordinance shal1 be guilty of a mis-
demeanor and fined not less than one hundred dollars ($100) nor more than five
hundred dollars ($500) for each offense. Each day such violation or fai'lure
to comply is permitted to exist after notification thereof shall constitute a
separate offense.

This project has been completed on West Ash Street. We have
