Authorize the Mayor to sign amendment to contract for signal
light synchronization.
The contract between the City and Mr. Howard M. Baker was first
executed in September, 1963. There are 23 intersections with
the timing of traffic signals synchronized via telephone lines
and Mr. Baker's equipment. All of the intersections are within
the central business district with the exception of Santa Fe
and Crawford.

This amendment increases the fee to be paid Mr. Baker from $836.00
1:',\,1 to $989.00 per month per intersection. The annual total increases
from $2,306.00 to $2,760.00. This adjustment is provided for in
account number 295, page 37 of the 1981 budget. The City also pays
the cost of the telephone lines which at the present time is $216.00
per month.

AMENDMENT TO CONTRACT FOR
SIGNAL LIGHT SYNCHRONIZATION
THIS AMENDMENT becomes effective the first day of
January, 1981, and amends the original agreement made and
entered into the 9th day of September, 1963, by and between
the CITY OF SALINA, Saline County, Kansas, referred to as
the "City", and HOWARD M. BAKER, of Salina, Kansas referred
to as "Baker".
Section 1: In consideration of the payments to be made
to him by the City of Salina as hereinafter described, Baker
agrees to install and maintain an electrical system for the
synchronizing of signal lights at the intersections herein-
after described. The synchronizing system will facilitate
control and maintain the continuous even flow of traffic
between all of the designated intersections which are ap-
proximately equal distance apart, provided that the moving
traffic shall not be slowed, hindered or delayed by other
means. The total one minute cycle for the stop and go sig-
nals, as now established, need not be modified, but the
portion of that cycle for stop signal and the portion thereof
for the go signal shall be subject to modification and con-
trol by the City, which ratio may be changed at any time
without adverse effects upon the synchronization system.
The system shall be installed so as to synchronize the
lights at the following intersections in the City of Salina:
Prescott and Santa Fe
Mulberry and Santa Fe
Ash and Santa Fe
Ash and Fifth Street
Walnut and Ninth Street
Iron and Fifth Street
Iron and Ninth Street
Sears Center and Santa Fe
Walnut and Santa Fe
Elm and Santa Fe
Crawford and Santa Fe
Ash and Eighth Street
Walnut and Eighth Street
Iron and Seventh Street
Walnut and Seventh Street
South and Santa Fe
Iron and Santa Fe
Elm and Ninth Street
Ash and Ninth Street
Walnut and Fifth Street
Iron and Eighth Street
Elm and Seventh Street

Section 2: The synchronization system shall consist
of one (1) metal box at each of the designated intersec-
tions, which box shall be mounted on the traffic light pole
which shall in turn be connected with electrical power at
the traffic control box along with the necessary telephone
control lines terminated on the synchronization equipment
box.
Section 3: Baker shall pay the entire cost of any
equipment and the installation of additional intersec-
tions, and the maintenance of the system. The City shall
pay the monthly rental charge to Southwestern Bell Telephone
Company for the telephone wire service required to operate
the synchronization system.
Section 4: The City agrees to pay Baker $9.89 (nine
dollars and eighty-nine cents) per month per intersection for ;.! ^i
rental of the system. Baker shall be paid at the same monthly
rate for any intersections added to the system during the term
of this agreement.
Section 5: A switch shall be provided in a traffic
control box at each intersection so that the Traffic De-
partment of the City may disable the synchronization
system for the lights in that intersection at any time.

Section 6: This agreement shall continue on a monthly
basis indefinitely unless terminated as herein provided:
Either party may terminate this agreement by the
service of written notice upon the other of the
intention to so terminate the agreement not less
than ninety (90) days prior to the effective date
of termination; provided, however, that this right
of termination by the City is conditioned upon the
payment of the rental specified in Section (4)
above for each month that the system shall be in
operation.
Section 7: In the event that the synchronization sys-
tem shall fail to function because of some internal defect
for more than 48 reorty-eigh~continuous hours, the rental
charge for that month shall be reduced as to each intersec-
tion improperly functioning in the same ratio as the number
of days of improper functioning of the system at that inter-
section bears to the total number of days of the month for
which the system should have functioned; provided, however,
that there shall be no reduction in rent if the reason for
non-functioning of all or any part of the system is due to
failure of the electrical power and telephone connnections.
Section 8: It is understood and agreed that all equip-
ment installed by Baker as part of the synchronization sys-
tem shall be and remain the property of Baker at all times
and shall be subject to removal by Baker as and when this
agreement shall be terminated for any reason, provided
that Baker shall repair any damage that might have been
done to any property of the City by virtue of the attach-
ment of the synchronization equipment to that City property.
This amended agreement executed in Salina, Kansas, this
day of December, 1980.
