The 1981 Budget contains $6,000 in Revenue Sharing to lease the
Stimmel School property from USD #305. The school district and
the Recreation Commission are .in concurrence on this lease and
the lease is attached.
I am asking authority to sign the lease. The lease is effective
January 1, 1981 and continues to run on a year to year basis,
with the monthly rent of $500. Eighty percent of the amount is
to be applied to the option to purchase. The appraisers have
valued the property at $45,000.

The Recreation Commission will attempt to make arrangements with
USD #305 so they can use the property starting this fall.

This Lease Agreement. made and entered into this day of
, 1980, by and between the City of Salina, Kansas, a
municipal corporat-ion, hereinafter referred to as the "Ci ty", and Unified
School District Nlunber 305. hereinafter referred to as the "District",
WITNESSETH: .
WHEREAS, the District is the owner of property commonly known as Stimmel
School and legally described as follows, to wit

which said proper1y is hereinafter referred to as Stimmel School; and,
WHEREAS, the City is interested in leasing the Stimmel School for the
purpose of use by the City Park Department and the Salina Recreation
Commission; and,
NOW THEREFORE, it is mutually agreed by and between the City and the
District as follows:

(2) Rental:
The District hereby lets and leases unto the
City the property commonLy known as Stimmel
School for a period of one year, commencing on
$eptember 1, 1980.
In consideration of the Lease of the above '
premises by the District to the City, the City
hereby agrees to pay the District a sume of
five hundred dollars ($ 500.) per month for the
use of said premises. The said rental shall be
payable monthly, in advance.
(3) Maintenance: The Ci~y agrees that it will, at its 'own
expense, maintain the pr~misesin a good state
of repair and will. at the expiration of the the
term of this lease, return the said property to
the District in as good condition as received,
normal wear and tear excepted.
(4) Indemnity: The City agrees to hold and save the District
harmless from any and all liability for property
damage and/or bodily injury claims which may
result from its use of the premises.

(5) Te:'mination: After the primary term of this lease, it
shall continue on a y("ar-to-year basis, .subj ect
to the right of eithc)' p1.rty to terminate. In
the event that either pzrty desires to terminate
this lease, it shall give to. the other party
thirty (30) days writ~en notice prior to the end
of any year of its intention to. .terminate.
(6) Structural Changes: No structural changes will" be made to, or on
the property by the City without consent of the district.

(7) Option of Purchase: In the event that the City, after
leasing the above premises for a consecutive term
of years, desires to purchase the above pro~erty,
the District gr'ants the City the option to pur-
chase the property for the sum of forty-five
thousand dollars ($45,000) less deduction or
four-fifths (4/5) of all lease money paid to the
District by the City, except that the deductions
will not amount to more than thirty thousand
dollars ($30,000).
(8) Extent to Agreement: This agreement shall be binding
upon the successors and assigns of the respective
parties to this agreement.
IN WITNESS WHEREOF, the respective parties have herein to caused this instru-
ment to be executed on its behalf by its duly authorized officers, all on the
day and year first above written.
