Re: Application #Z80-4, filed by John W. ~1ize, requesting rezoning of a tract of
land in the Northeast Quarter of Section 35-13-3 (complete legal description
attached), from Districts "A-l(FP)" and "C-5(FP)11 (Agricultural-Flood Plain
and Service Commercial-Flood Plain) to Districts "C-6(FP)" and "1-2(FP)"
(Heavy Commercial-Flood Plain and Light Industrial-Flood Plain). This
property contains approximately 34 acres and is addressed as 500-698 West
Diamond Drive or 2245-2351 North Ninth Street.
At their April 1, 1980 meeting, the Salina City Planning Commission conducted a
public hearing on Application #Z80-4. At that time, a motion was unanimously
approved (6-0) to recommend that this application be approved, subject to
platting, based upon the following findings of fact:
(1) This amendment would be consistent with the intent and purposes of
the zoning regulations, as specifically enumerated in Section 36-101
of the Salina Code.
(2) The permitted uses in the "C-6" and "1-2" Districts would be compatible
with uses permitted on other property in the immediate vicinity.
(3) Through consultation with the Engineering Department, it has been
determined that there are adequate utilities to serve the request area.
(4) No errors in the application of the zoning regulations are known to
have occurred.
(5) Amendment is made necessary due to changing conditions in the area
attributed to development along Diamond Drive.
Therefore, you are asked to place the attached ordinance on first reading today
and postpone second reading no longer than six (6) months or until platting is
complete, whichever is earlier. The County Treasurer has certified there are no
delinquent taxes on this property.
