THIRD AMENDMENT TO EMPLOYMENT AGREEEMENT
/l-J.J, . This Third Amendment to Employment Agreement is made and entered into this
I~.'day of August, 2002, by and between the CITY OF SALINA, KANSAS, a Kansas
municipal corporation, ("Employer") and DENNIS M. KISSINGER ("Employee").
Recitals
A. Employer and Employee entered into an Employment Agreement dated
January 10, 1988 (the "Employment Agreement").
B. Employer and Employee entered into an Amendment to Employment
Agreement dated December 19, 1994 (the "First Amendment to Employment
Agreement").
C. Employer and Employee entered into a Second Amendment to
Employment Agreement dated August 17, 1998 (the "Second Amendment to
Employment Agreement").
D. Employer and Employee have identified certain specific further
amendments they wish to make to the Employment Agreement as amended by the First
Amendment to Employment Agreement and Second Amendment to Employment
Agreement.
THEREFORE, the parties agree:
Section 1. Salary. In accordance with Section 4 of the Employment Agreement,
the Employee's annual base salary effective September 1, 2002 shall be $99,371.
Subsequent changes shall be in accordance with adjustments to the Position
Classification and Salary Plan as adopted by resolution, unless otherwise determined by
the city commission.
Section 2. Amendment of Section 8. Section 8 of the Employment Agreement as
amended by the First Amendment to Employment Agreement is further amended to
provide as follows:
"Section 8. Automobile Allowance.
Employee shall receive an allowance of $500 per month for
business use of his vehicle. For business trips outside the City, Employee
shall receive additional compensation for each mile driven pursuant to the
city mileage reimbursement policy."
Section 3. Amendment of Section 9. Section 9 of the Employment Agreement is
amended to provide as follows:
Section 9. Vacation, Sick and Military Leave.
A. Employee shall accrue, and have credited to his personal
account, paid vacation leave at the rate of twenty (20) days per year and
sick leave at the same rate as other employees of the Employer.
B. Employee shall be entitled to military reserve leave time
pursuant to state law and city policy.
C. The Employee may, at the Employee's discretion, elect to
receive payment at his currently hourly pay rate for up to 120 hours of
accrued sick leave in any calendar year on the same one-third basis as the
Employer's policy for payment of accumulated sick leave to employees
upon termination of employment in good standing. (For example: If the
Employee elects in 2003 to receive payment for 100 hours of accumulated
sick leave, Employee will be paid for 100 hours at his 2003 hourly pay
rate and Employee's accumulated sick leave account will be reduced by
300 hours.)
Section 4. Effective Date. This Third Amendment to Employment Agreement
shall be effective as of September 1, 2002.
Section 5. Ratification. Except as specifically amended by this Third
Amendment to Employment Agreement, the terms of the Employment Agreement as
amended by the First Amendment to Employment Agreement and Second Amendment to
Employment Agreement are ratified and confirmed.
IN WITNESS WHEREOF, the duly authorized officers of the Employer and the
Employee have caused this Third Amendment to Employment Agreement to be executed
the day and year first above written.
