BACKGROUND: The asphalt arterial sidewalks project is a component of the 2006 Sidewalks and Ramps Program. This category is for the construction of missing pieces of sidewalk along arterial and collector streets that connect sidewalks on either side or connect neighborhoods to other sidewalk systems. There were two (2) locations included in this year’s program: 1) Ray Avenue from Gail Drive to Drainage Ditch, 2) Crawford Avenue from Fairdale Road to Markley Road. Bids were received for this project on Tuesday, August 15, 2006 as follows: Bidder Bid Schedule Davis Concrete Construction,September 1, 2006 - $ 43,935.75 Bennington, Kansas October 31, 2006 Pavers Inc., September 1, 2006 - $ 58,675.00 Salina, Kansas October 31, 2006 PARGA Construction, September 1, 2006 - $ 59,286.25 Newton, Kansas October 31, 2006 Smoky Hill, LLC, September 1, 2006 - $ 76,866.50 Salina, Kansas October 31, 2006 Engineers Estimate$52,355.50 An issue was discovered at the bid opening whereas Davis Concrete Construction had not submitted a bid bond with their bid which is a requirement per the bid documents. Staff has since received a cashier’s check which is an acceptable form of bid security. Due to the discrepancy between the lowest bidder and second lowest bidder and the fact that the low bidder wa s the only bid below the engineer’s estimate, staff is recommending award of the bid to Davis Concrete Construction. Staff has contacted the next lowest bidder to discuss staffs intention to recommend award of contract to Davis Concrete Construction, and they were amenable to the solution when considering the alternative which was to reject all bids and rebid the project. The invitation for bids includes a clause that states “The City of Salina, Kansas, reserves the right to reject any or all proposals and to waive any irregularities therein”, which al lowed staff to make the determination to proceed with this recommendation. FISCAL NOTE: The 2006 Budget allocates $150,000 in special gas tax funds for the 2006 Sidewalks and Ramps Program, including $50,000 for the Arterial Sidewalks Program. RECOMMENDATION: It is recommended that the City Co mmission award the contract for t he Arterial Street Sidewalk Improvements Project, Project No. 06-1573, to Davis Concrete Construction, in the amount of $43,935.75.
