CONTRACT FOR COMPACTING AND HAULING METAL
THIS CONTRACT, made and entered into this -'-- day of

Kansas, hereinafter referred to as City, and Wayne c.
Gossett, hereinafter referred to as Gossett.
WITNESSETH:
In consideration of the promises,
covenants and
agreements made by the parties hereto, said parties agree as
follows:
1. Gossett agrees to provide the City with a
compacting and hauling service for certain metals deposited
at the City's landfill and expressly agrees as follows:
(a) Gossett shall process certain metals deposited on
a designated site at the City's landfill, compacting and
hauling off said metals frequently enough so as not to
consti tute a nuisance or to interfere with the landfill's
operations and/or appearance.
(b) Gossett shall pay to the City One Dollar ($1.00)
per ton for the metal processed and removed from the City's
landfill.
(c) Gossett shall provide all labor and equipment
necessary
for
the
compacting and processing
of
the
designated metals.
(d) Gossett
shall
be
responsible
for
insurancp
coverage on the equipment used by him in the compacting and
hauling business.
(e) Gossett is an independent contractor and shall
provide adequate security to protect against personal injury
and property damage sustained as a result of his operation.

(f) Gossett shall indemnify and hold the City harmless
from and for any damages which may be sustained by persons
on account of his operation.
(g) Gossett shall not interfere at any time with the
operation of the City's landfill.
(h) Gossett shall conduct his operation only during
the hours the landfill is open to the public, or as
otherwise directed by the City.
(i) Gossett shall not burn any refuse at the landfill
during his compacting and hauling service.
2. The City shall provide to Gossett for his
compacting operation, an area of sufficient size, for the
depositing of metals to be crushed,
to operate the
compacting machine, and to store crushed metals until
removed by Gossett.
3. The City shall deposit all metals to be crushed by
Gossett on the designated site.
The metals to be crushed
include washing machines, refrigerators, hot water heaters,
stoves, air conditioning units, and furnaces.
Gossett will
not accept for compacting, and the City shall not deposit on
the designated site, any commercial hot water heaters, gas
tanks, wire, wood, tra~h, nor heavy irons. Any metals not
accepted by Gossett shall be removed from the designated
site by the City.
4. Gossett is in no way associated with Garry
Dunnegan,
d/b/a American Recycling,
who previously had
compacting and hauling contract with City. In entering into
this contract, Gossett in no way accepts or ratifies any
rights, responsibilities, obligations I or liabilities that
American Recycling and/or Garry Dunnegan had with the City.
5. This contract shall be in effect from ...j '" L I
