A RESOLUTION determining the advisabil ity of asphaltic concrete overlay
appl ied to all existing streets in Fox Run Addition to the City of Sal ina,
Kansas; remove and replace all areas of existing pavement that show structural
deterioration; remove and replace defective curb and gutter; and crack seal ing
of existing pavement; estimating the cost thereof, defining the boundaries of
the improvement district, method of assessment, and apportioning the cost between
the improvement district and the City-at-large.
WHEREAS, said improvements were requested by petition of those 1 iable
for the cost of the same, said proceedings shall be without notice, as provided
by K.S.A. 12-6a04.
BE IT RESOLVED by the Governing Body of the City of Sal ina, Kansas:
Section 1. That the Board of Commissioners of the City of Sal ina,
Kansas, hereby finds and finally determines that it is advisable to make the
following improvements:
Three inch (3") asphaltic concrete overlay appl ied to all existing
streets in Fox Run Addition to the City of Salina, Kansas;
Removal and replacement of all areas of existing pavement that show
structural deterioration;
Removal and replacement of defective concrete curb and gutter;
Crack sealing of existing pavement.
Section 2. The extent or boundaries of the proposed improvement
district to be assessed is:
That part of the City of Salina, Saline County, Kansas, described as
follows, to-wit:
All of the lots in Fox Run Addition to the City of Sal ina,
Kansas, except the following described lots and pieces of
property, to-wit:

The South Three Hundred Ninety-nine and ninety-one hundredths
feet (399.91') of Lot Three (3), Block One (I).
Lot Seven (7), Block Two (2).
Lot Eight (8), Block Three (3).
Lot Thirty-five (35), Block Fourteen (14).

All dedicated public park areas, flood control, drainage
and utility right-of-way.
Section 3.
$410,000.00.
The estimated or probable cost of such improvements is
Section 4. The apportionment of cost between the improvement district
and the City-at-large, is as follows:
1. Costs chargeable to private property in the amount of $410,000.00
2. No costs chargeable to the City-at-Iarge.
Section 5. The assessment with accrued interest shall be levied as a
special assessment tax upon the property included within the benefit district
concurrent with the general property taxes and shall be payable in ten (10)
equal annual installments.

Section 6. The method of assessment shall be based on the adjusted
front footage of each lot of land and without regard to the buildings or
improvement of the land.
Section 7. That the advisability of the improvements set forth herein
is hereby establ ished without notice and hearing, as authorized by K.S.A.
12-6a04(1) .
Adopted by the Governing Body of the City of Salina, Kansas, and
approved by the Mayor this 7th day of January, 1980.
