COMMISSION INFORMATIONAL MEMORANDUM

ITEMS OF INTEREST
1. In the CIM dated November 16, 1979, I mentioned that Lee Hardware is
questioning their property tax and I had Larry Bengtson look into
the matter. Larry has written a letter to Tom Hampton, attorney for
the Lee Company (copy attached). We will await their response and
keep you posted on developments in this matter.
2. Enclosed is a copy of a letter I sent to Morris Kulmer concerning
Alabama Street.
3. Enclosed is a copy of a letter I sent to the Park Board and the Rec-
reation Commission informing them of the Commission's desire to have
those respective boards investigate the lighting of the Lower Indian
Rock baseball complex.
4. Also, enclosed is a xerox copy of the publicity information in which
lighted baseball diamonds are promised in Lower Indian Rock Park.
5. Enclosed are letters from Wanda Macy, Coordinator of Salina Coalition
for Prevention of Child Abuse, and Harold Crowther, Sec.-Treas. of
the Salina Municipal Band, concerned about the possible combination
of the Human Resources Department under a parks and recreation de-
partment. A response has been sent.
6. Enclosed for your study and review is an analysis of the fire pro-
tection problems in South Salina and specifically at the Salina
Municipal Airport. I suggest that you read this report and we should
discuss it at your convenience.
ADMINISTRATIVE BRIEFS
1. The City Clerk will accept bids for the City life insurance program
until 10:00 A.M. Thursday, December 6. The City Commission will
award the bid at the Commission meeting on December 10, 1979.
The bid specifications are identical, with only a few exceptions.
First, only those companies carrying an "A" rating by the Vest Com-
pany will be eligible to bid. Second, life insurance coverage for
dependents will be paid by the City. This will cost the City approx-
imately $1,500 per year. The City can now pay the cost of dependent
coverage because life insurance coverage for all City employees will
cost less than anticipated.

2. In the event you have questions or concerns about the appearance of
the metal prefab restrooms being constructed in Ivey Park, the gal-
vanized metal will be allowed to weather until next spring at which
time it will be painted a tan or brown color to blend with the near-
by wood structures. It will also have a cedar shake shingle roof
to help it blend in with the other structures. Right now, its ap-
pearance is a stark contrast to the other structures.
3. The Street Department started November 26, 1979, repairing the rough
spots on the deck of the channel bridge on East Iron. It is very
time-consuming and they will not be completed until next week some-
time.
The project wasn't included in the overlay project done this last
summer because the overlay process would put too much weight on the
bridge support structure.
The Capital Improvements Program has included $50,000 for the bridge
deck to be renovated in 1980.
4. Attached is the schedule and instructions which the Planning Depart-
ment has developed and distributed to the various departments,
boards, and agencies for updating the Capital Improvemen~Program.
5. As a result of the editorial in the Journal, November 28, criticizing
us for not repairing the railing along the river opposite the Water
Treatment Plant on South Fourth Street, Bill Harris visited with John
Estes on the matter Thursday morning. The railing is in a condition
where it is quite obvious we should have replaced it without being
prompted by an editorial. We are unable to locate the editorial
which they say they wrote six months or so ago on the matter. Of
course, that's not important. John told Bill he recalled it and
thought it appeared possibly two or three months ago.
John also stated he and the Street Superintendent have been giving it
thought on the best way to replace the railing so it will be stronger
and will not need to be replaced within a few years. He plans to set
guard rail posts in concrete just inside of the heavy timber which is
serving as a type of curb and on which the present railing is mounted.
He will then bolt metal guard railing to the posts. This will reduce
the street width by 9" or 10", but will not impede traffic and will
be a much better installation than going with another wood rail. John
advised it has simply been a matter of lack of time to do the work;
however, it is in bad need of attention and will be taken care of
right away.
6. Estes reported 11-26-79, due to increased amount of trouble with the
storm sewer on Fourth Street, south of Cloud, following the last two
significant rains, they lamped the sewer and found a piece of tile
had broken loose from the top and was partially blocking the sewer.
The section was dug out and replaced. This repair returned the sewer

to maximum capacity, but will not improve the situation on South
Fourth. Mentioned only to point out that the Department is keep-
ing an eye on the problem areas and endeavoring to see that defects
are handled as soon as possible.
6. Enclosed is the Administrative Update.
MONDAY'S MEETING
1. Enclosed is an application from C. L. Clark, representing Gerald
Palmer, Norman Macy, and Boyd Smith, M.D.'s, to construct a medical
clinic in the 300 Block of North Front Street. The information was
provided based on the Commission's established policy. The required
$500 fee has been paid.
It has been the City's policy in the past to put these on the agenda
and then to convene into Executive Session.
2. Enclosed is information on other items on the agenda. If any Com-
missioner has any questions or cannot attend the meeting, please
contact me.

'Ihis will acknowledge receipt of your letter of November 20th
concerning the above captioned matter. I also have been furnished with
a copy of your letter of November 9th addressee. to Mr. Keith Lilly,
Saline County Treasurer, in regards to the same subject matter. In
reply to your letter I wish to submit the following:
Ordinance No. 6929 dated August 1, 1966, was adopted at the request
of the Salina Airport Authority pursuant to the autb.ori ty granted to
cities under the provisions of K.S.A. 27-302.. In its written request
for this ordinance the cha.irrran of the Salina Airport Authority in a
letter dated May 16, 1966, requested that the City adopt an ordinance
exerrpting the property in the Schilling Subdivision fran all city taxes
and providing that the property a.vners make a payment;. in lieu of taxes
to the City in the arcount of 12.75 mills for the first five years after
annexation, 15.00 mills for the next three years and thereafter an
arcount equal to the mill levy requested to finance the city I s general
operating fund. After several conferences between the City Camtissioners
and the directors of the Salina AirpJrt Authority it was mutually agreed
that the in lieu of tax payment would be 12. 75 mills for the first five
years, 15.00 mills for the next three years, the general fund levy for
the next five years and the nonnal city tax levy thereafter.
For the past several years the City officials have been aware that
Ordinance No. 6929 is ambiguous in several aspects, Section (2) states
that all real and personal property in the Schilling Subdivision shall
be exempt fran taxes for fifteen years, but makes provisions for an lieu
of tax payment for only thirteen years. Certainly it was not the
intention of the Board of Carrrnissioners to exempt this property both
fran the nonnal taxes and the payment of in lieu of taxes during the
extra two year period. As you will note, Section (2) (a) (b) (c) of the

Ordinance No. 6929 refers to taxing years January 1, 1967, through
January 1, 1979, inclusive. In discussing t.rus m3.tter with t.~e Co1.1nty

ordina~ce for Schilling Subdivision was made in 1966 for use to supply
funds for the 1967 budget, ,vtllch cc::mrenced on January 1, 1967. I>1r.
Armstrong advises rre t.'r1at t."f1e tax levy, which is certified in August of
each year, is to suppJrt t.~e next year's budget and as such the "tax
year levy for 1980" is actually the levy which was adopted by the City
Corrrnission and certified to the County Clerk in August of 1979. The
above circumstances were the basis for my opinion to the County Clerk
COveri.-lg t.~e levy which was cer+-ified for t.~e budget year 1980 or the
taxing year which camences on January 1, 1979.
A defect in the above rrentioned ordinance which is probably of
greater significance than the discrepancy above rrentioned is the legal
question as to whether the City had any authority to exerrpt personal
property fran any taxes. K.S.A. 27-321 provides in part as follON's:
"Allor any part of the real estate constituting a
part of the property located within the boundaries of the
Authori ty m3.y be annexed and taken wi thin the corpJrate
limi ts of the City. . . and t.~e City may exempt such
real estate fran any city taxes which the Governing
Body of the City shall determine."
In an opinion to Saline County dated January 3, 1979, the Attomey
General of Kansas reviewed the above ordinance and rrade the follo.vi.ng
CClIl:1reIlts thereon:
"Whereas, the statute authorizies the exemption
of real property, the ordinance goes further to exernpt
personal property as well. Al though the Authority for
the exenption of personal property is not at all' clear
to rre, I will pass that question and proceed to your
specific inquiry."

At the t.i.rre the Attomey General wrote this opinion he did talk to
rre by telephone and he advised rre that he felt the ordinance was void
insofar as it att.err'pted to exernpt personal property from taxation. In«an opinion issued last Stm1Ter in regards to an ordinance passed by the
Ci ty of Oakley which exernpted certain airpJrt personal property from
taxation the Attomey General indicated that "Cities have no consti-
tutional or statutory aub'!ori ty to exempt f€rsonal property fran
taxation and that only the legislature has the authority to make such
exe:nptions." In reviewing t..'!e provisions of K.S.A. 27-321 I feel the
Attomey General's opinion is correct.
As you knON', Ordinance No. 6929 has been very unpopular with t.~
Saline County Taxpayers league and m3.ny other individual businessrren who

that if litigation does develop concerning this ordinance that t..1Us
specific Cjuestion as to the authority of the City to exempt ];€rsonal
property will be determined. If tile court should determL'1e t...1.is
ordinance invalid as to the exemption of ];€rsonal pror:;erty, t...'le question
then arises as to whether the City can go back and collect the taxes
which were forgi va'1 and if so, for haw many years. I &'TI sure that t.~
people that are unhappy with this ordinance would insist that an attempt
J::;e made to recover t...'1e taxes which sp.ould not have been exempted from
the levy.
I am unable to answer your question as to how many other real
estate ONIlers there are in the Schilling Subdivision. To my knawledge
the only real estate which has been sold by the Aut.'1ority are a few
tracts along CenteTh.'1ial Road in t.'1e vicinity where 'The Lee Company is
located. I would estiJ:ate these to be three or four tracts.

further.

The Salina City Commission in formal session on November 19,
1979, directed me to prepare this letter.
It is the decision of the Salina City Commission that prior
to final plat approval or submission for' said approval of the
Wheatridge Addition plat or any other plat, by whatever name,
covering the area generally north of Schilling Road and roughly
west of the existing Hollybrooke Addition shall meet the follow-
ing requirements~
An improvement petition be signed for street
improvements to the existing Alabama Street,
north of Schil~ing Road.
Said legally binding petition sha~l provide
for the complete removal of the existing ,
street surface and base and replacement in
its entire length with 8-inches of full depth
asph~tic concrete per the existing City spec-
ifications.
Provided furthermore that no public agency
will participate in the financing of-the street
improvements.

Over at the Memorial Hall the other day we heard that there is
a. plan, or consideration oI, putting the Human Resources under
authority oI the Recreation Department. We are concerned about the

The Municipal Band has racei ved such consideration with the
present organization of Memorial Hall that fmY change could be
detremental to us.
Doem't the Memorial Hall receive federal funding? If so,

1. Dean Boyer, the architect and builder made an inspection of the
Animal Shelter last Friday. A punch list of items to be com-
pleted, dressed up, etc. was compiled. Dean stated it should
be safe to assume everything will be completed within a month
and the City can take possession. During that time, Dean is to
develop plans for extending the parking and providing access to
the front door so the public will not have to track through mud
to get to the building. The Police Department has been instructed
to proceed with the purchase of food and water dispensers and
stainless steel cages for cats. A desk and other furniture are
on hand. * (See additional comments at end of report)
2. At the Department Head meeting next Tuesday, staff will be asked
to report on the progress being made on the review of their assigned
Chapters of the Salina Code and development of recommendations for
updating of same.
3. Thepreliminary rough draft of the Policy Manual is in the typing
stages. It is difficult to estimate how soon we will be able to
present a finished product; however, we are continuing to work on
it in between other projects.
4. A state approved auditor will conduct an energy audit around Decem-
ber 15 on the following buildings: Memorial Hall, Golf Course
Clubhouse, four Fire Stations, and the Community Theatre. This
will cost the City approximately $550. Information gathered by
the auditor will be processed by computer and will generate an
audit report to be used in the technical assistance phase (Phase
III) of the Energy Conservation Grant Program. Federal grants
in the technical assistance phase of the energy grant program
will be distributed for 50% of the cost of modifications to the
seven buildings.
5. The first draft of a comprehensive Animal and Fowl Ordinance has
been completed and distributed to selected staff for their per-
usual. Input from interested community groups will also be sought.
Curt advises a final draft of the proposed ordinance can probably
be completed before January 1, 1980, and distributed to the City
Commission.
The proposed Salina Animal and Fowl Control and Protection Ordin-
ance will draw upon the City of Wichita Ordinance, Chapter 8 of
the Salina Code, recommendations proposed by the Mayor's Animal
Control Committee, the Kansas City, Missouri Ordinance, the Humane
Society of the United States Model Ordinance, and the American
Humane Association Model Ordinance.

6. As you instructed, Dean Boyer and I have begun compiling infor-
mation for the December Commission Focus Session on the river
beautification project. This will include an update on the status
of the applications for Federal grants submitted by Wilson and
Company, a review in chronological order of Commission actions,
etc., over the past few years on the matter, and other pertinent
information.
7. Curt is compiling the information you requested concerning sales
tax for the Commission Focus Session on December 13.
8. Department Heads will submit their estimates for use in developing
the Projected 1981 Budget by next Tuesday, A.M. We will make
every effort to complete the assignment during the next week.
9. The Department Heads will submit their preliminary draft following
the suggested format for Quarterly Reports at the Department
Head meeting on December 4th. These reports will be reviewed
and utilized to determine any desirable changes in the format, as
well as the composition of the information to be submitted by the
departments in preparation for the first Quarterly Report in 1980.
10. It was mentioned in the Administrative Update of October 31, 1979,
that the Hay Personnel Classification and Pay Plan is in need of
several modifications prior to the first of the year. This work
has begun. There are numerous changes to be made in order to up-
date various segments of the "Job Content Evaluation and Salary
Plan". This involves primarily the incorporation of new job
classifications, such as those involved with the Bicentennial
Center and several reevaluations of individual classifications.
11. The Building Code Advisory Board met Wednesday evening, November 28,
1979, and spent considerable time on the matter of building permit
fees. Their recommendations for charging for building permits on
both new construction and remodeling, along with minutes of the
meeting, will be provided next week and can be placed on the Decem-
ber 10, 1979, agenda for City Commission consideration.
12. There continues to be several problems and/or deficiencies in need
of correction at the Bicentennial Center. Mickey and his staff
are working with Bucher and Willis and Virg Lundberg on these
matters.
Delays, foot dragging, etc., becomes more and more frustrating
as time goes on. All we can do at this point is stay on the back
of Bucher and Willis, and they in turn, on the general contractor.
As an example, nothing has been done about numerous roof leaks,
but Shelby advises they have to go through a certain process of
notifying and renotifying the general contractor and be in a
position to document it before they can threaten to have it done
by someone else and deduct the cost. Shelby assures me they are
doing everything they can to press G. E. Johnson to take care of
these types of problems.

They continue to experience problems with the heating, cooling
and ventilation system. As an example, when they had the go-
cart races Tuesday evening, the louvers did not open. Smoke
from the engines collected up towards the ceiling. Mickey said
fumes were not bad for the spectators due to the fact they were
seated low in the arena.
Virg Lundberg had scheduled a meeting on these mechanical problems
for Wednesday, November 28, 1979, so the problems are being dealt
with; but again, results seem to come at a snails pace.
13. Another item concerning the Bicentennial Center - the landscape
contractor began Wednesday on the replacement of the dead and
otherwise unacceptable trees and shrubs.
In discussing this matter with Shelby Willis, he stated they have
been hassling with the landscape contractor on the way he is re-
placing the trees and shrubs. They are watching it very closely.
According to the contract, once the plants are replaced, they are
ours. I asked Bob Ash to take a look at them this morning. He
reported the plants look healthy. Some of them do not have the
most desirable shape, however, he feels they can be properly
shaped as they develop.
Ron Williamson is to meet with the contractor at the Center at
8:00 a.m. this Friday to make sure the plants going in meet the
specifications. I asked Shelby if he had any objection to Bob
Ash participating in the meeting since he will have the respon-
sibility for caring for the stock once we take it over. This was
fine with Shelby. ** (See added comments at end of report)
14. Planning is waiting for instructions from the Assistant City
Attorney on what action should be taken regarding the three
urban renewal redevelopers who have not fully complied with
their commitments: two in the Northeast Industrial Park and
one in the Central Business District area.
15. Bob Ash reports a new sign is nearing completion for display in
front of the Memorial Hall Neighborhood Center. As soon as they
have it out of the way, they will begin working on one for Friend-
ship Center. Bob stated it will probably be large wood letters
mounted high on the building where it will be less vulnerable
to vandalism.
16. Curt Wood taught two classes at the Fire Department, one on
Municipal Finances and another on Municipal Government. There
were approximately 15 Fire Department personnel in attendance
at each class. These are participants in the Fire Science
Technology Program being conducted through KTI. The classes
were each two hours in length.

The class on Municipal Finance dealt with the issues of budget
preparation, theory of budgeting, methods of financing, budget
types, and involved a simulation budget preparation session.
The class on Municipal Government surveyed the different forms
of government, the roles of the Manager and Commission, and
involved a simulation case study and mock City Commission meeting.
The response and interest in both classes were exceptionally
good. Classes of this kind are an excellent in-service training
technique for employees, not only to learn more about their
own department, but develop an appreciation for other departments
in the City and gain an overall perspective of local government.

Friday morning the architect reported the contractor should have
everything finished by sometime next week. The Police Department
and Animal Shelter personnel are still undecided on the best
type of food and water dispensers to install. They will try to
get a decision made right away and get the equipment ordered.

Bob Ash reported Friday morning he and Ron Williamson met at the
Bicentennial Center; however, the contractor failed to appear.
Bob and Ron checked every tree and shrub on the site. Bob re-
ported at least 50% of the stock does not meet specifications
as to size, form, variety, or location. Examples:
(1) Of the 52 pine trees planted, only 10 comply with
the specified size of 5' to 6'. The rest are
smaller.
(2) All of the green ash planted in the islands were to
be 10' to 12' in height and they are only 6' to 8'.
(3) The biggest concern was the shrubbery up close
around the building. Many of them are too small
or of the wrong variety.
Williamson will be writing the contractor a letter concerning
these deficiencies and instructing him on what will be required
to satisfy the contract.
