Amending Sections 5 and 12 of Re solution 05-6229 as to the adv isability of and authorizing
construction pursuant to KSA 12-6a01 et seq. of street and drainage improvements in Golden Eagle
Estates Addition and Golden Eagle Estates Addition No.4 to the City of Salina, KS
BACKGROUND:
The original Resolution No. 05-6229, authorizing this project was adopted on December 12, 2005.
Paragraph 3 of Section 5 of that resolution identifies the specific properties to benefit from installation
of a “backyard swale/concrete ribbon drainage system. The Attorney General’s office has noted that
the description in the petition rela ting to this specific benefit includes the terminology “all in the
Golden Eagle Estates Addition No. 4”, whereas Resolution 05-6229 omits that language.
The original resolution was also amended by Resolution No. 06-6273 on April 3, 2006, increasing the
authorization from $553,037 to $590,424.53. However, the amending Resolution No. 06-6273, did
not specifically provide that we intended to also reimburse ourselves from Bond proceeds for the
additional amount.
Resolution 06-6295 rectifies both oversights.
FISCAL NOTE:
The action has no direct fiscal impact, however, it does clarify the intent of the actions leading to the
bond issue.
RECOMMENDED ACTION:
Approve Resolution Number 06-6295.
